Simons and Rose E. Simons, 12400 West 44th Avenue, Wheat Ridge, Jefferson County, State of Colorado, hereinafter called the "grantor(s)" for and in consideration of the sum of Five Hundred Twenty Three and 00/100 Dollars ($523.00) and other valuable consideration to them in hand paid by the City of Wheat Ridge, hereinafter called "City", do hereby glve and grant to said City PERMANENT RIGHT-OF-WAY AND EASEMENT on, along, over and across the following described premises to-wit: A parcel of land containing 400 square feet, more or less, which is contained in the tract described at Reception Numbers 84029462 and 84029463, in the office of the Jefferson County Clerk and Recorder; said parcel being more particularly described as follows: )-) Beginning at a point on the centerline of West 44th Avenue; whence a point established by county survey as the intersection of the North and South centerline, Section 20, Township 3 South, Range 69 West, of the 6th Principal Meridian, and the centerline of West 44th Avenue bears North 89050' East 59.4 feet; thence South 0032' East 30 feet to the TRUE POINT OF BEGINNING of said parcel; thence South 0032' East 8 feet; thence North 89050' East 50 feet; thence North 0032' West 8 feet; thence South 89050' West 50 feet to the TRUE POINT OF BEGINNING. The above described utility easement contains 400 square feet, more or less, and is for the purpose of construction and mainte- nance of the pipeline and appurtenant works and embankment of the Bayou ditch. For the purpose of construction and maintenance of the pipeline and appurtenant works and embankment of the Bayou ditch. Subject to the following terms and conditions: Lawns, fences and other improvements within the easement will be restored to original or better condition.
