KNOW ALL MEN BY THESE PRESENTS, that Joe Graff and Margaret v.
Graff, 9550 West 39th Avenue, City of Wheat Ridge, Jefferson
County, State of Colorado, hereinafter called the "grantor (s)"
for and in consideration of the sum of Ten and 00/100 dollars
($10.00) and other valuable consideration to them in hand paid by
the City of Wheat Ridge, hereinafter called "City", do hereby
give and grant to said City PERMANENT RIGHT-OF-WAY AND EASEMENT
on, along, over and across the following described premises to-
wit:

A fifteen foot wide tract of land which is located along the west
boundary of a tract of land described as follows:
The West 1/2 of the West 1/2 of the West 1/2 of the Southeast 1/4
of the Southwest 1/4 of Section 22, Township 3 South, Range 69
West of the 6th Principal Meridian; EXCEPT the North 684.8 feet
thereof i EXCEPT the South 390 feet thereof i EXCEPT the West 15
feet thereof.
Also known by street and number as: 9550 West 39th Avenue.
For the purpose of: Constructing and maintaining a drainage
system for stormwater run-off.
Subject to the following terms and conditions: As set forth in
full on Exhibit A and Exhibit B, which exhibits are attached
hereto and expressly incorporated herein.
And the Grantors hereby covenant with the Grantee that they have
good title to the aforedescribed premises i that they have good
and lawful right to grant this easement.
IN WITNESS WHEREOF, We have hereunto set our hands
day of A.D., 1988.

1.
Upon receipt of this Permanent Easement, the City shall
initiate immediate proceedings to vacate the lS-foot roadway
described hereon. Upon vacation of said roadway, the City
shall grant a Quit Claim Deed for same to the owners. The
City shall retain the right to enter upon the easement, upon
notification of the owners, to make emergency repair or
maintenance of the buried pipeline or appurtenances.
2. Following construction, the easement area shall be restored
to original condition or better, as regards fences, gates,
driveways, or grassed areas.
3. This Easement shall further provide for the possible future
construction of a sanitary service line from 39th Avenue
southward to the adjoining property. An engineering
representative for Westridge Sanitation District has
recommended that any future service line be located ten feet
east of, and parallel to, the west boundary of the easement.
Any decision to proceed with application for sewer tap and
construction of the service line shall remain solely with
the owner of the adjoining property to the south.
4. A sketch map of the subject property and easement area is
shown on Exhibit B attached.
