March 25, 1971
The one hundredth regular meeting of the Wheat Ridge City Council
was called tc order by Mayor Albert E. Anderson at 7:30 p.m. in
the Council Chambers at 7390 West 38 Avenue.
Aldermen attending were:
Howard, Calvin Hulsey and
later.
Jack W. Bramble, Joseph M. Donaldson, Robert
Ray C. Pepe. Alderman Dana Bowling arrived
Others attending were: Mayor Anderson, Clerk Louise Turner, Treasurer
James Malone, City Attorney Maurice Fox, department heads, staff
members and citizens.
Resolution No. 114 was introduced by Alderman Donaldson and read.
Motion by Alderman Pepe:

from the general fund be approved." Motion

Resolution No. 115 was introduced by Alderman Hulsey and read.
Motion by Alderman Donaldson: "I move that Resolution No. 115 per-
taining to the investment of $100,000.00 in funds be approved."
Motion was seconded by Alderman Howard and passed 5-0.
WZ-71-01 Rezoning Case was heard. Applicant SJS Company requested
a change from Residential-Two to Commercial-One for planned future
commercial development on 13.3 acres.
Robert Barr of the Planning Department stated that surrounding zoning
is: North-Agricultural-One; South - 1-70; East - Residential-Three;
and West - Agricultural-One, and that the surrounding land use is:
North - vacant; South - 1-70; East - high density residential, and
West - vacant.
The Planning Department felt the following factors should be considered:
1. The Wheat Ridge Comprehensive Plan shows this area to be
low density residential.
2. Applicant's land borders on 1-70 Service Road (2 lanes),
49 Avenue (2 lanes), and Independence Street (2 lanes).
3. Applicant's area is South of area recently annexed and
zoned Residential-Three and Commercial-One.
4. The possibility exists if this area continues to expand
at its current rate and direction it may be advisable to recommend
reservation (or dedication) of roads due to the increase in traffic
this trend will incur.
5. Area is adjacent to Ficco Subdivision which is zoned
and used as Residential-Three.
6. With the construction of 1-80 South emminent, a commercial
area would be feasible for this area in anticipation of the industrial
and commercial contingencies this would produce.
7. Planning Department recommends approval due to the pre-
vious growth and use pattern and the expected pattern of use.
The Planning Commission recommended approval due to the fact that
expected growth and use patterns in that area will be compatible
with the commercial zoning, provided that the applicant agrees to
dedicate his part of a 60' street (49 Avenue) if needed.

the Comprehensive Plan but that low density residential has not
developed in that area.
That there has been no Residential-One development.
That there has been little Residential-Two.
That there has been a considerable amount of Residential-
Three and Planned Unit Development.
That there has been commercial development where there
is adequate ingress and egress.
That there has been considerable change in the past ten
years and the trend along 1-70 has been toward Commercial and Industrial.
That Jefferson County Planners outlined development for
the 1-70 corridor in 1968 and though the plan was not adopted the
actual development has parallelled what the plan indicated.
That based on the trend of the last ten years commercial
would be the highest and best use of the land.
A copy of the above mentioned Jefferson County Plan and copies of a
breakdown of development since the building of 1-70 were submitted.
Citizens who gave opinions on the case were:
Doug Spelts of 4565 Holland who stated that from an ecological
standpoint - houses, grass and trees were preferable to a steel and
concrete area which would result from commercial zoning.
Pat Tacito of 4325 Carr who stated that zoning is for progress
and progress is something to look forward to.
John Dowling of 4565 Garrison who expressed concern over the
fact that there would be additional traffic on Garrison Street - a narrow
street for which apparently no widening is planned.
Motion by Alderman Pepe: "I move that rezoning Case WZ-71-01 be taken
under advisement for one week and a decision be rendered at 7:30 p.m.
in the Council Chambers on April 1, 1971." Motion was seconced by
Alderman Hulsey and passed 6-0.
WZ-71-04 Rezoning Case was scheduled for heuring. Applicants ~.R.
Blanche, M.A. Blanche, P. Tacito, M.T. :acito and H.W. Hillyard had
requested a change from Residential-Tulo to proposed Residential-Three A
on 20,250 square feet for the purpose fo erecting six condominium
or rowhouse units at 45 Avenue and Holland on lots 53, 54 and 55 of
Sun Valley Subdivision.
The Planning Commission recommended denial because the request was
not compatible with surrounding use. The Planning Department re-
commended denial because the request would constitute spot zoning in
a neighborhood where the use is Residential-One and Residential-Two.
Applicants P. Tacito, M.T. Tacito and H.W. Hillyard were present.
Applicants R.R. Blanche and M.A. Blanche were not present nor was
there an attorney present to represent them.
City Attorney Maurice Fox gave the following ruling that it would be
proper to hear the case for lots 55 and 53, but since neither the
Blanches nor their attorney was present the case as it pertained
to lot 54 could not be heard.
Mr. Hillyard and Mr. and Mrs. Tacito agreed to withdraw the application
and make no presentation.
Motion by Alderman Bramble: "I move that the entire petition of
WZ-71-04 be dismissed for the following reasons: two of the three
applicants have agreed to withdraw and the third did not appear."
Motion was seconded by Alderman Donaldson and passed 5-0.
Motion by Alderman Bowling: "I move that in future planning cases
that the Planning Department which posts the signs, remove those signs
in two weeks time following the hearing." Motion was seconded by
Alderman Hulsey and passed 6-0.

John Downing of 4565 Garland Street asked if there might be assurance
that the request would not come up again and was told that it is the
right of a property owner to request a rezoning.
Building Code Ordinance was brought up for discussion.
Alderman Bramble stated that no action could be taken on the Ordinance
until it had been in the hands of the Council for one week.
Motion by Alderman Pepe: "I move that the Building Code Ordinance
be tabled for one week for study and then be introduced." Motion
was seconded by Alderman Bramble and passed 6-0.
Meeting was adjourned at 10:30 p.m.
