HomeMy WebLinkAbout04/29/1971 MINUTES April 29, 1971 The one hundred and fifth regular meeting of the Wheat Ridge City Council was called to order by Mayor Albert E. Anderson at 7:30 p.m. at 7390 West 38 Avenue. Aldermen attending were: Dana Bowling, Jack W. Bramble, Joseph Donaldson, Robert Howard, Calvin Hulsey and Ray C. Pepe, Others attending were: Mayor Anderson, Clerk Louise Turner, City Attorney Maurice Fox, department heads, staff members and interested citizens. The 3.2 Fermented Malt Beverage License of Southland's 7-11 Store No.7 came up for renewal. Mr. Curt Koski of 4747 Harlan Street, Supervisor of seven area stores and Mr. Howard Lyons of 5052 Custer, Denver, Manager of Store No.7 were present. Motion by Alderman Hulsey: "I move that Southland Corporation dba 7-11 Store No.7 at 9130 West 44 Avenue have its 3.2 Fermented Malt Beverage carry-out License renewed." Motion was seconded by Alderman Howard and passed 6-0. The 3.2 Fermented Malt Beverage License for Hillcrest Country Market came up for renewal. Paul Audino of 1201 South Garrison, owner and Robert Audino of 3290 Harlan were present. Motion by Alderman Pepe: "I move that the 3.2 Fermented Malt Beverage license for the Hillcrest Country Market be renewed." Motion was seconded by Alderman Bowling and passed 6-0. The 3.2 Fermented Malt Beverage License for Safeway store #232 at 7575 West 44 Avenue came up for renewal. Manager, Gene Sauer of 3741 South Green Court was present. Motion by Alderman Pepe: "I move that the license of 5afeway at 7575 West 44 Avenue for 3.2 Fermented Malt Beverage be renewed." Motion was seconded by Alderman Hulsey and passed 6-0. Ordinance No. 85 was introduced by Alderman Bowling and read. Motion by Alderman Bramble: "I move that Section 7. The Short Title be amended to read 'this Ordinance may be known and cited as Section I. of the Wheat Ridge Environmental Control Ordinance. '" Motion was seconded by Alderman Donaldson and passed 5-1. Motion by Alderman Donaldson: "I move that the following be added to Section 2. 'This section is not intended to prohibit the grazing of animals or the spreading of manure for agricultural purposes." Motion was seconded by Alderman Howard and passed 5-1 with Alderman Bowling voting "Nay." Citizens making comments were: Shelly Allen of 3725 Union Court of the Wheat Ridge High 5chool Eco- logical Action Committee who asked if specific reference to harmful substances such as phosphates, chemical pesticides and oil might not rightfully belong wit'l this phase of this Ordinance, and E.O. Mattox who questioned the use of manure, even for agricultural purposes within twenty-five feet of a creek. Motion by Alderman Donaldson: "I move that Ordinance No. 85 pertaining to littering along ditches be passed on first reading and be published and posted." Motion was seconded by Alderman Pepe and passed 6-0. Ord):_n_a~e_ No~ the Wheat Ridge Building Code was brought up for second consideration and the title read. -2- Motion was made by Alderman Pepe, seconded by Alderman Bowling and passed 6-0 "that the Clerk dispense with reading the Ordinance." Citizens Comments were made by Harvey Kolesar who felt the Code and the amendments were good. A letter from Richard Ondrusak, Chairman of the Building Code Advisory Committee approving the Ordinance was read. The letter is attached to the Minutes. Motion by Alderman Ridge Building Code as amended on first lished and posted." 6-0. Howard: "I move that Ordinance No. 84, the Wheat which was introduced by Alderman Hulsey and adopted reading, be passed on second reading and be pub- Motion was seconded by Alderman Hulsey and passed The following appointments were made to the Wheat Ridge Mass Transit Task Force: By Mayor Anderson - Rev. John McElderry of 6 Hillside Drive, and Mrs. Ralph Barnhart of 11590 West 39 Place. By Alderman Bowling - Mrs. Wilbur F. Herbert of 3455 Estes Street, and By Alderman Hulsey - Earl G. Elia of 4010 Marshall Street. Additional appointments will be made at the May 5, 1971 meeting. Under the heading of Improvement Districts the following were discussed: The paving of intersections at city expense. Motion by Alderman Bowling: "I move that the City pay for the paving of the intersections involved in any Improvement District before the City at this time." Motion was seconded by Alderman Donaldson and passed 5-0. Also discussed were: The possible paving of remalnlng gravel streets within the City; The possible paving of those gravel streets in areas that are built up; The possible paving of areas where people have pe- titioned for Improvement Districts; The setting up of an annual district with a cut off date; The number of miles of unpaved streets and the cost per mile of surfacing; The possibility of using a designated amount per year for paving; and The costs and risks connected with the selling of bonds for improvement districts as they now stand. Mr. Hobbs estimated the cost of paving to be $20,000.00 per mile and that a full report would be given to Council by May 15, 1971. Motion by Alderman Bramble: "I move streets be tabled for further study." Motion was seconded by Alderman Pepe and passed 6-0. -3- Motion by Alderman Pepe: "I move to authorize the Finance Officer to purchase six 2-way radios for use of the Wheat Ridge Motorcycle Patrol Reserves at a cost not to exceed $5,400.00 to be charged from Account No. 421.3." Motion was seconded by Alderman Bramble and passed 6-0. Following discussion from City Treasurer James Malone and City Attorney Maurice Fox as to which account should be used for money for legal costs which would eventually go toward land acquisition, Resolution ~~ 120 was introduced by Alderman Hulsey and read. Motion by Alderman Donaldson: "I move that Resolution No. 120 per- taining to Budget adjustments be approved." Motion was seconded by Alderman Hulsey and passed 6-0. Police Chief Edward Pinson presented a proposal for shift supervisory personnel. Motion by Alderman Bramble: "I move that the Civil Service Commission be authorized to select two Senior Patrolmen at senior patrolman pay; procedures to be the same as for the selection of personnel Senior Patrolman." Motion was seconded by Alderman Bowling and passed 6-0. Our Committee held two comprehensive review meetings which were also attended by fire safety experts of surround- ing communities, and each member privately studied and researched the proposals.
