HomeMy WebLinkAbout05/06/1971 MINUTES May 6, 1971 The one hundred and sixth regular meeting of the Wheat Ridge City Council was called to order by Mayor Albert E. Anderson at 7;30 p.m. at 7390 West 38 Avenue. Aldermen attending were: Dana Bowling, Joseph Donladson, Robert Howard and Ray C. Pepe. Alderman Calvin Hulsey arrived later and Ald- erman Jack Bramble was absent. Also attending were Mayor Anderson, Clerk Louise Turner, City Attorney Maurice Fox, staff personnel and interested citizens. A Pre~i~j~~r~He~ring for the transfer of a beer and wine license for Los Panchos Restaurant was held. Applicants Olga Sepulveda, Beatrice Juarez and Attorney Issac H. Kaiser were present. City Attorney Maurice Fox stated that the character of the applicants was the only issue. Motion by Alderman Howard: "I move that Council set the Public Hearing in these chambers at 7:30 p.m. on Tuesday, June 8, 1971 for the business of the liquor license transfer of Los Panchos Restaurant at 6351 West 44 Avenue." Motion was seconded by Alderman Donaldson and passed 4-0 with Aldermen Bramble and Hulsey not present. A request for an increase in funds for Accounts No. 411.41 and 411.46 to adequately fund the animal control program for 1971 was presented by City Clerk Louise Turner. After considerable discussion, numerous questions, suggestions that the employees in the Clerk's Department might be increased, that the request for funds might be cut and that Account No. 463 recommended by the Treasurer's Office as the source for these funds might not have adequate funds for this proposal, the following Motion was made by Alderman Donaldson: "I move that the matter of the Clerk's Budget be tabled for two weeks for study." Motion was seconded by Alderman Bowling and passed 5-0 with Alderman Bramble not present. Park Superintendent Boyd Kraemer explained the proposed request to be made to the Bureau of Outdoor Recreation under H.U.D. - for matching funds for land acquisition and stated that Wheat Ridge High School senior class was planning to donate $750.00 to the program which would also be matched by Federal Funds. The following Motion was made by Alderman Bowling: "I move that the City Council of the City of Wheat Ridge, Colorado, hereby states the followi ng: a. It will make every reasonable effort to acquire the property by negotiated purchase before instituting eminent domain proceedings (including administrative takings and similar proceedings for the compulsory acquisition of real property). b. It will not require any owner to surrender possession of the property until the applicant pays, or causes to be paid, to the owner the agreed purchase price arrived at by negotiation, or in any case where only the amount of the payment to the owner is in dispute, not less than 75 percent of the appraised fair value as approved by the applicant or, if subsequent to HUD concurrence in the acquisition price for the property, as concurred in by HUD. c. It will not require any person lawfully occupying property to surrender possession without at least 90 days written notice from the applicant of the date on which possession will be required." Motion was seconded by Alderman Hulsey and passed 5-0 with Alderman Bramble not present. Motion was made by Alderman Howard, seconded by Alderman Donaldson and passed 5-0 "that a five minute recess be called for study of a proposed Resolution." -2- Resolution No. 121 was introduced by Alderman Howard and read. Motion by Alderman Donaldson: "I move that Resolution No. 121 per- taining to the acquisition and development of land for open space use be resolved and adopted." Motion was seconded by Alderman Howard and passed 5-0 with Alderman Bramble not present. Alderman Howard suggested that a Resolution commending the Wheat Ridge High School senior class or other means of recognition be on the Agenda for May 20, 1971. The following appointments were made to the Mass Transit Task Force: By Mayor Anderson Theodore Erickson of 4075 Carr, By Alderman Pepe Chris Schmidt of 7080 West 34 Place, and By Alderman Howard - Gary Lewman of 4350 Parfet Street. ~e~olu~ion~~ 122 was introduced by Alderman Hulsey and read. Motion by Alderman Pepe: "I move that Resolution No. 122 introduced by Alderman Hulsey and pertaining to land for an access road and sewer line for Field Park be passed."
