The one hundred and eighth regular meeting of the Wheat Ridge City
Council was called to order by Mayor Albert E. Anderson at 7 30 p.m.
at 7390 West 38th Avenue.
Aldermen attending were Dana Bowling, Jack W. Bramble, Joseph Donaldson,
Robert Howard, Calvin Hulsey and Ray C. Pepe.
Also attending were Mayor Anderson, Clerk Louise Turner, City Attorney
Maurice Fox, and citizens interested in zoning cases, ordinances and
other City business.
Ordinance No. 85 pertaining to littering along streams was brought up
for second consideration. Students from Devinny School who had written
the ordinance, their teacher, Robert McFadden, and Wilson Roop of the
Agricultural Ditch Company were present and introduced. Ordinance No.
85 was read.
Motion by Alderman Donaldson "I move that Ordinance No. 85 pertaining
to littering along streams be approved on second reading and be published
and posted." Motion was seconded by Alderman Bramble and passed 5-0.
WS-71-02 Subdivision Plat came up for decision.
Motion by Alderman Pepe "I move the Subdivision Plat for Wheatridge
Knolls, submitted by Mike A. Leprino be approved subject to requirements
and restrictions as provided and recommended by the City Engineer and
consulting engineers retained in said case." Motion was seconded by
Alderman Donaldson. Alderman Bramble stated that he wasn't sure that
the City should have the responsibility for safety where a pond was
concerned. Aldermen pepe and Bowling stated they felt there was more
protection if the property was developed under subdivision regulations
than if lots were sold indiVidually. Council was polled and motion
passed 5-1 to approve the Plat with Alderman Bramble voting "Nay."
WL-71-o7 Rezoning Case came up for decision. Applicants Wayne and
Marguerite Selders had requested a change from Agricultural-One to
Residential-Three at 4200 Moore Street.
Motion by Alderman Pepe "I move that Rezoning Case WZ-71-07, request-
ing a change from Agriculture-One to Residential-Three be approved for
the following reasons
1. It would be keeping with the character of the neighborhood.
2. It would be an upgrading of the neighborhood, and
3. Would be acceptable to the whole area."
Motion was seconded by Alderman Bowling and wad defeated 4-2 with
Aldermen Howard, Hulsey, Bramble and Donaldson voting "Nay". The
zoning will remain Agricultural-One.
WZ-71-o8 Rezoning Case came up for decision. Angelo LaPorta, applicant,
had requested a change From Agricultural-One to Residential-Three at
4885 Garrison, North of the Ficco Subdivision.
Motion by Alderman Pepe "I move that WZ-71-o8 be approved for the
following reasons
1. It would be the best use of the property.
2. It would be compatible with the neighborhood.
3. Would be a credit to the area.
Motion was seconded by Alderman Bowling and was defeated by a vote of
3-2 with Aldermen Hulsey, Bramble,and Howard voting "Nay" and Alderman
Donaldson abstaining. Alderman Donaldson explained his abstention in
that he knew the applicant personally. The zoning will remain Agri-
cultural-One.
Resolution No. 123 pertaining to the Clerk's budget was introduced by
Alderman Hulsey and read.
Motion by Alderman Howard "I move that Resolution No. 123 pertaining
to Clerk's budget be approved." Motion was seconded by Alderman
Donaldson and passed 5-0.
A report on paving costs was presented by George Hunter, Superintendent
of Streets. The report included costs of paving areas in improvement
districts. Mr. Hunter stated that there is~60,000 in the street re-
habilitation budget at the present time. Complete report is in the
general file under "Street Paving Report, May 1971."
Motion by Alderman Howard "I move that Public Works Department pro-
ceed with plans and specifications for a project to construct Paving
Improvement Districts 3, 5, 9, and 10 as accepted by this Council and
also proceed with plans and specifications for a street rehabilitation
project in accordance with the list of streets as submitted requiring
bituminous overlay paving. This project shall be advertised for bids
in due time in order that the work be completed prior to seasonal halt
of all bituminous paving operations this year." Alderman Bramble
questioned the fairness to people who have paved their own streets if
the City paves these. Alderman Pepe stated that there did not seem to
be another feasible alternative due to the difficulty of selling high
risk bonds. Council was polled and motion passed 5-1 with Alderman
Bramble voting "Nay".
Motion by Alderman Bramble "I move that the City A;torney be author-
ized to purchase the North 50 feet of Lot 12A, HappiJ~8ia~n Subdivision
for Wheat Ridge Colorado for $2,800." Motion was seconded by Alderman
Hulsey and passed 5-0.
