GRANT OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS:

That Jefferson County School District No. R-I, a quasi-municipal corporation, hereinafter
called "Grantor", for and in consideration of the sum of $1,00 and other good and valuable
consideration the receipt and sufficIency of which is acknowledged, hereby grants,
bargains, sells and conveys unto The City Wheat Ridge herein called "Grantee," a
nonexclusive permanent easement for the purpose of installation, construction, repair,
operation, inspection, maintenance, removal and reconstruction of a storm drain conduit,
Project No, 93037-90 with all rights and privileges as are necessary or incidental to the
reasonable and proper use of such easement, in and to, upon, over, under and across the
following described property which the Grantor owns or in which the Grantor has any
interest, situate in Jefferson County, Colorado to wit:

Grantee agrees to restore all disturbed property including, but not hmited to, trees,
landscaping, sod, fencing (wood and chain link), sprinkler systems, curb, gutter, driveways,
sidewalks and all other improvements to their original condition or better, immediately upon
completion,
By acceptance of this easement, Grantee further covenants to indemnify and hold the Grantor
harmless from any and all claims, including costs and attorneys' fees, for injury to persons or
damage to property which may occur as a result of or in relation to Grantee's possession,
occupancy, maintenance, or use of the easement.
