HomeMy WebLinkAbout06/17/1971 MINUTES June 17, 1971 The one hundred and twelth regular meeting of City Council was called to order at 7 3D p.m Avenue by Mayor Albert E Anderson the Wheat Ridge at 7390 West 38 Aldermen attending were Donaldson, Robert Howard was absent. Dana Bowling, Jack W. Bramble, Joseph and Ray C. Pepe Alderman Calvin Hulsey Others attending were Mayor Anderson, Deputy City Clerk Elise McMillen, City Attorney Maurice Fox, City Treasurer James Malone, department heads, applicants of rezoning cases and interested citizens Mayor Anderson announced that he had received sealed votes from Alderman Hulsey pertaining to the rezoning cases WZ-71-11 Rezoning Case came up for decision The applicanm A Land M.M. Bacher had requested a change from present zoning of Residential- Two to Agricultural-One for a greenhouse at 44 Avenue between Pierce and Quay on the north side Motion by Alderman Pepe "I move that Rezoning Case WZ-71-11 located at 44 Avenue between Pierce and Quay for a zoning change request from Residential-Two to Agricultural-One be approved for the following reasons 1 This would be the best use of the land 2 There was no opposition to the downgrading from Residential- Two to Agricultural-One" Motion was seconded by Alderman Bowling and passed 5-0 including Alderman Hulsey's sealed vote for approval. WZ-71-12 Rezoning Case came up for decision Applicants A.L. and M M. Bacher had requested a rezoning from Residential-Two to Restricted- Commercial for retail sales of potted plants, floral arrangements etc at 44 Avenue between Pierce and Quay Streets on the north side. Motion by Alderman Bowling "I move that Rezoning Case WZ-71-12 requesting a zoning change from Residential-Two to proposed Restricted-Commercial be approved for the following reasons 1. Restricted-Commercial exists in the surrounding zoning. 2 The Comprehensive Plan shows commercial and low density residential land use 3. The Planning Commission and the Planning Department recommended approval" Motion was seconded by Alderman Pepe and passed 6-0 with Alderman Hulsey's sealed vote being for approval. Rezoning Case WZ-71-13 came up for decision Applicant M.L. Gerhardt had requested a change in zoning from Agricultural-One to Residential- Three at 4375 Moore Street for the purpose of building multiple units Motion by Alderman Bowling "1 move that the rezoning request in Case WZ-71-13 from present zoning of Agricultural-One to proposed zoning of Residential-Three be approved because 1 The majority of construction on Moore Street is multi- family 2. The maximum number of single-family dwellings on this property is five and the maximum number of multi-family dwellings is nine 3. The Planning Department recommended approval" Motion was defeated by a vote of 4-3 with Aldermen Howard, Bramble and Donaldson voting "nay" and Alderman Hulsey's sealed vote being for approval making a tie vote, and Mayor Anderson voting "nay". Mayor Anderson stated that he voted as he did because there were not sufficient reasons given to change the land use. -2- WZ-71-14 Rezoning Case came up for decision. Applicant George A Holley requested a change in zoning from Agricultural-One to Commercial-One at 49 Avenue and Kipling on the northeast corner for business uses Motion by Alderman Pepe "1 move that Case No. WZ-71-14 located at 49 Avenue and Kipling at the northeast corner requesting a change in zoning from Agricultural-One to Commercial-One be approved for the following reasons 1 Kipling lends itself to commercial development 2 This would prevent spot zoning. 3 It would allow full development of the land 4 The Planning Commission recommended approval" Motion was seconded by Alderman Bowling and tied with a 3-3 vote with Aldermen Howard, Bramble and Donaldson voting "nay". (Alderman Hulsey's sealed vote was for approval). Mayor Anderson voted "aye" passing the rezoning request and stating that the location of this property and the high traffic use are good for commercial development. WZ-71-15 Rezoning Case came up for Holley requested a change in zoning Three at 49 Avenue and Independence purpose of multiple units. decision Applicant George A from Agricultural-One to Residential- on the northeast corner for the Motion by Alderman Bowling "I move that Rezoning Case WZ-71-15 requesting a change from present zoning of Agricultural-One to Proposed zoning of Residential-Three be denied for the following reasons 1. Development for better use of the land would be Planned Unit Development. 2 The Planning Department stated that highest and best land use cannot be shown for this land and it could be used as any residential zoning district 3 The Plannign Department and the Planning Commission recommended denial." Motion was seconded by Alderman Donaldson and passed to deny the rezoning by a vote of 4-2 with Alderman Pepe voting "nay" and Alderman Hulsey's sealed vote being for approval of the rezoning Maurice Fox, City Attorney presented four deeds for acceptance. Motion by Alderman Howard "I move that two deeds for the north 50 feet of the south Y2 of lot or Tract 12, Happy Valley Gardens be accepted for general purposes." Motion was seconded by Alderman Pepe and passed 5-0. Motion by Alderman Pepe of Wadsworth be accepted the Motion and it passed "I move that a deed for widening 44 Avenue off for road purposes." Alderman Howard seconded 5-0. Motion by Alderman Bowling "I move that the deed for Tract A, Applewood Knolls, 11th filing for road purposes be accepted" Motion was seconded by Alderman Donaldson and passed 5-0 Budget and Appropriations Report was given by James Malone. He stated that the said report was for the period ending May 31, 1971 and that the percentage of expenditures was 31 6 of appropriations and 45.3 percent of the antici- pated revenue had been received Complete report is in the General File He also stated that a petty cash fund had been established at the Court Clerk's Office for $75.00 A presentation of proposed bikeways in Wheat Ridge was presented by Edgar Johnson, part-time consultant to Wheat Ridge Parks and Recreation Commission He stated that the Commission feels bike riding should be a major Wheat Ridge recreation but the existing parks are too small for trails and there are not enough of them He stated there has been a survey of streets for bikeways for the safest routes and a preliminary work-up of experimental bikeway systems. He presented a map showing these routes consisting of 26 miles around the City and to the parks and schools which were routed in numerous loops. He said these trails need to be tried out by bike enthusiasts, that recommendations should be made by the Police Department and Fire Department, and that push button signals, trails along Clear Creek and other areas and the needed land through easements etc and signs need to be looked into. -3- Mayor Anderson presented petitions that had been presented by Calvin Johnston, Wheat Ridge Junior High School teacher for the Eco Action Committee of the school which were supporting bikeways and routes to prevent pollution from cars and internal combustion engines Others speaking in favor of bikeways were Paul Thompson of 105 South Estes, Lakewood, President of Eicycles Now who stated that three possibilities for bicycles are usually used paths on a separate ROW, separate lanes ill the streets, and bikeways paralleling the streets, that the City of Littleton had recently passed a bikeway ordinance, that bicycling is not a fad and many people would bicycle for commuting and recreational purposes if there were safe paths and commuter routes, and that economically the bicycle is a necessity to many young people. Mr Videl, resident of Wheat Ridge Mr. and Mrs. Harry Smith of 3585 Allison Court who were both members of Bicycles Now. Mr and Mrs. Pierre Bonan who were both bicycle commuters. Walter Grande, purchasing agent presented several purchase approval requests. The first request was for the Public Works Department to purchase a Y2 ton pickup, 8 cyclinder, standard shift for traffic div- ision, 3/4 ton pickup, 8 cyclinder, standard shift for street division, and a van, all window, series 200, 6 cylinder, automatic shift, 8 00 X 16 D range tires The prices of each respectively is Y2 ton - $2,104.58, 3/4 ton - $2,463.11 and the van - $2,711 95. The request requires the transfer of funds within the Public Works Department budget Resolution No. 127 was introduced by Alderman Bramble and read pertaining to appropriation adjustments within the Public Works budget. Motion by Alderman Bramble "I move that Resolution No. 127 be approved " Motion was seconded by Alderman Donaldson and passed 3-2 with Aldermen Howard and Pepe voting "nay". Motion by Alderman Bramble "I move that the Purchasing Agent be author- ized to purchase one 3/4 ton pickup truck for the Streets Department, one Y2 ton pickup truck for the Traffic Department, and one all-window van for the Engineering Department The total price for these three vehicles not to exceed $7,300.00." Motion was seconded by Alderman Donaldson and passed 3-2 with Aldermen Pepe and Howard voting "nay". The second request was for one 5,000 gallon and one 2,000 gallon underground gasoline storage tanks with hot tar coating to be installed at the Public Works Shop area. A bid for the job was presented by Eaton Wayne Inc. for $3,987 DO Motion by Alderman Donaldson "I move that purchase for the underground gasoline storage tanks be approved as stated in the quotation and that the purchase be funded from Account No. 463 not to exceed the bid price." Motion was seconded by Alderman Bramble and passed 5-0. The second half of the Denver Regional Council of Governments Dues were announced due Motion by Alderman Howard "I move that the second half 1971 Participating Membership Dues for Denver Regional Council of Governments be approved for payment from Account 419.6." Motion was seconded by Alderman Donaldson and passed 5-0. Next was a request for an adequate water supply for Paramount Park, which has now two 20 foot wells that are diminishing in water supply Park Superintendent Boyd Kraemer had contacted the State Engineer who stated that deeper wells were not the answer because of the decreasing water table The request was for installation of underground sprinkler system and hookup tap to Consolidated Mutual Water District. Low bid for the sprinkler system was from the Rainmakers for $8,555 00 and a tap fee to Consolidated Mutual for $2,266 84 There was discussion as to the possibility of drilling deeper wells -4- Motion by Alderman Bowling "I move that the request for funds for a water supply be tabled for further information" Motion was seconded by Alderman Donaldson and passed 4-1 with Alderman Howard voting "nay". Ordinance No. 83 pertaining to Improvement District No. 10 came up for second reading Motion by Alderman Pepe "I move that the Clerk dispense with the second reading of the Ordinance." Motion was seconded by Alderman Donaldson and passed 5-0. Motion by Alderman Bowling "I move that Ordinance No on second reading and be posted and published." Motion by Alderman Howard and passed 4-1 with Alderman Bramble 83 be approved was seconded voting "nay". It was announced that the City was now two years old.
