KNOW ALL MEN BY THESE PRESENTS, that WAYNE G. & KAREN J. THIESSEN
whose address is 9560 W. 38TH AVENUE, Wheat Ridge, County of
Jefferson, state of Colorado, hereinafter called the "Grantor(s)"
for and in consideration of the sum of ONE HUNDRED SIXTY SIX AND
TEN/100 ($166.10) and other valuable consideration to them in hand
paid by the City of Wheat Ridge, hereinafter called "city", do
hereby give and grant to said City PERMANENT EASEMENT on, along,
over and across the fOllowing described premises to-wit:

Township 3 South, Range 69 West of the 6th Principal
Meridian, city of Wheat Ridge, County of Jefferson, State
of Colorado,being a part of lot 2, Del Vue Subdivision
and described as:
COMMENCING AT THE NORTHWEST CORNER OF SAID LOT 2, THENCE
NORTHERLY ALONG THE WEST LINE OF SAID LOT 2 A DISTANCE OF
6.60 FEET. THENCE NORTHEASTERLY TO A POINT ON THE NORTH
LINE OF SAID LOT 2 WHICH IS 18.64 FEET EASTERLY OF THE
SAID NORTHWEST CORNER. THENCE WESTERLY TO THE SAID
NORTHWEST CORNER.
For the purpose of: CONSTRUCTION AND MAINTENANCE OF A
SIDEWALK.
subject to the following terms and conditions: SEE
ATTACHED EXHIBIT "A" WHICH IS HEREBY MADE A PART OF THIS
DOCUMENT.
Said tract contains 61.52 square feet more or less.
Also known by street and number as: 9560 W. 38TH
AVENUE, Wheat Ridge, Colorado, 80033.
And the Grantor(s) hereby covenant(s) with the City that they
have good title to the aforedescribed premises; and that they
have good and lawful right to grant this easement.

The City agrees to hold harmless the Grantor(s) from and against
any suit, claim, attorney's fees, loss or damage, including
personal injury or loss of life, which may occur as a result of
negligent construction or maintenance of said sidewalk and
retaining walls by and/or for the City on the property subject to
this easement.
Construction time frame shall be as specified in resolution
number 1435 series of 1994 by the Wheat Ridge City Council on
November 14, 1994.
The City shall construct a 48" high solid cedar fence from the
back of the sidewalk to the front setback limit.
The city shall replace approximatley 270 square yards of concrete
driveway.
The city shall replace four trees on the front of the property
and resod the area between the sidewalk and the driveway.
The City shall plant three trees of the owners choice along the
west property line.
