KNOW ALL MEN BY THESE PRESENTS, that WILLIAM A. WAGNER AND JOANN W. WAGNER, ) / J
whose address is 2529 WCR 21, Fort Lupton, Colorado, 80621, hereinafter called the "Grantors" for and in
consideration of the sum ofTEN AND NO/lOO DOLLARS ($10 00) and other valuable consideration to them
in hand paid by the City of Wheat Ridge, hereinafter caIled "~", do hereby give and grant to said City
PERMANENT EASEMENT on, along, over and across the following described premises to-wit:
A tract ofland lying in the SW Yo of Section 23, Township 3 South, Range 69 West of the 6th Principal
Meridian, City of Wheat Ridge, County of Jefferson, State of Colorado, described as:
THE SOUTH 2 FEET OF THE EAST Yz OF THAT PARCEL OF LAND DESCRIBED IN THE
OFFICIAL RECORDS OF THE COUNTY OF JEFFERSON, STATE OF COLORADO AT
RECEPTION NUMBER 80084043
For the purpose of CONSTRUCTION AND MAINTENANCE OF A SIDEWALK.
Subject to the following terms and conditions: The City agrees to hold harmless the Grantors from and
against any suit, claim, attorney's fees, loss or damage, including personal injUl)' or loss of life, which
may occur as a result of negligent construction or maintenance of said sidewalk by and/or for the City
on the property subject to thIs easement.
Said tract contains 108 square feet more or less.
Also known by street and number as, 7815 W 41st Ave., Wheat Ridge, Colorado 80033-4520
And the Grantors hereby covenant with the City that they have good title to the aforedescribed premises; and that
they have good and lawful right to grant this easement.
