HomeMy WebLinkAbout07/22/1971 MINUTES July 22, 1971 The one hundred and seventeenth regular meeting of the Wheat Ridge City Council was called to roder at 7 30 P m by Mayor Albert E Anderson at 7390 West 38 Avenue Aldermen attending were Dana Bowling, Joseph Donaldson, Calvin Hulsey, Robert Howard and Ray Pepe Alderman Jack Bramble was absent Also attending were Mayor Anderson, Deputy Clerk Elise McMillen, City Attorney Maurice Fox, Planning Director Paul Walker, Planning Technician Robert Barr, applicants and/or their representatives for rezoning cases and interested citizens Representatives from the Wheat Ridge Junior Grange, Gail Davis and Crag Hughes presented a check for $15 50 to the City to be used by the Parks and Recreation Department for "No littering" signs The money was earned by selling litter bags for automobiles The members of the Junior Grange range in age from five to fourteen years. A letter was read by Miss Davis and is attached to the Minutes. Rezoning Case WZ-71-17 was heard Applicants D. Wheelock, C.M. Zimmerman, and M.E Bunger were present The rezoning request was for 11,800 square feet at 3840-50 Harlan Street from present zoning of Residential-Three to proposed zoning of Restricted-Commercial One. The purpose is to use the existing buildings for professional offices. Mr Robert Barr from the Planning Department stated the following 1. That the property was properly posted and published. 2. That the Comprehensive Plan shows this parcel to be general commercial 2. Requested zoning is more restrictive than general area commercial districts 3 Secondary problems such as drainage would not occur 4 Off-street parking will be required at time of restricted- commercial uses as per zoning ordinance 5 Planning Department recommends approval. 6 The original application requested a change to Restricted- Commercial and at the Planning Commission meeting the application was amended to Restricted-Commercial One at the request of the Planning Commission afterwhich Planning Commission recommended approval Applicant Dr C M Zimmerman of 4320 Newland stated he wished to use the existing building for a dental office and Mr. Wheelock would use a part of the building for a real estate office He planned to redo the facing of the building and there would be small parking lot use. Applicant M.E. Bunger stated he lives at 3850 Harlan Street and has used part of the house for his business and now plans to use the whole building for his business He stated he has purchased another home and that there are other businesses close by, i.e a beauty college and a nursing home Applicant D Wheelock stated that the land is surrounded by commercial land use on three sides There was no opposition present Motion by Alderman Bowling "I move that Rezoning Case WZ-71-17 be tabled, and a decision to be rendered on July 29, 1971." Motion was seconded by Alderman Howard and passed 5-0. Rezoning Case WZ-71-19 was heard. Applicant Angelo LaPorta was present and was requesting rezoning from present Agricultural-One to proposed Planned Unit Development on 105,900 squqre feet at 4885 Garrison Street for construction of multiple units f i , , -2- Mr Robert Barr stated the following 1 The property was properly posted and published 2 The Comprehensive Plan shows this area to be low density residential 3. General discussion is appropriate because of Planned Unit Development 4 Planning Department recommends approval 5 That this was formerly brought in for Rezoning under Case WZ-71-o8 for proposed rezoning of Residential-Three and was denied on May 13, 1971 The total number of units to be built was 52 6 That under the preliminary plan presented tonight, 54 units are proposed with 108 parking spaces Applicant Mr LaPorta stated he plans to leave all the trees in, the structures will be stucco and frame and will consist of townhouses, two bedroom and one bedroom units Motion by Alderman Howard "I move that questing a change from present zoning of Unit Development be tabled for one week in these chambers" Motion was seconded Rezoning Case WZ-71-19 re- Agricultural-One to Planned for a decision to rendered by Alderman Hulsey and passed 5-0. Case WS-71-D2 Resubdivision of a portion of Karelin Subdivision was brought up. Applicant Jerry V Volavka was present and had speaking for him Frank Callahan, Real Estate agent. Land is at 47 Avenue and Routt Street, is zoned Residential-Two and is to be for doubles Mr Robert Barr stated the following That all the surrounding property owners had been notified. The plat had been before the Planning Commission and had been sign8d by all the required authorities That adequate service would be available from the following Arvada Fire Department, Fruitdale Sanitation District and Valley Water District Motion by Alderman Howard "I move that the resubdivision of a portion of Karelin Subdivision that has previously been approved by the ap- propriate authorities be approved by City Council." Motion was seconded by Alderman Bowling and passed 5-0. Approval for construction of buildings in the Flood Plain Zone was presented. Planning Director Paul Walker stated that according to Ordinances No. 68 and 80 a special permit is to be issued from the Zoning Authority (City Council) when there is proposed building in the designated flood plain area. Also that the buildings to be built are required to be two feet above the 100 year flood plain which at this particular area would be 5,410 feet. The prospective builder is Kenneth Gantenbein of Custom Builders and five buildings with six units per building are to be built at 38 Avenue and Quail. Mr Daniel Aberle, registered engineer, was hired by the builder and stated that acco~ding to his calculations the minimum ground floor elevation of one building would be 5,411 feet and the others would range to 5,412', that no basements would be in the buildings, that there would be no structural damage in case of flood due to reinforced construction and there would be no flotation Paul Walker stated that this area involved is overland overflow area and that all documents required according to the Ordinance have been received and are in proper order. Mr. Jack Prose, Chief Building Inspector, stated that the plans pre- sented have met all building code requirements. r _j' k_ -3- Motion by Alderman Bowling "I move we continue this for a Finding of Fact due to the large size of land involved which is 2 acres and the number of units which is 30 to July 29, 1971 for a decision" Motion was seconded by Alderman Pepe and was denied by a vote of 3-2 with Aldermen Hulsey, Donaldson and Howard voting "nay". Motion by Alderman Pepe "I move this case be tabled for one week and a decision be rendered at that time in these chambers" Motion was seconded by Alderman Bowling and passed 3-2 with Aldermen Hulsey and Donaldson voting "nay". It was brought up that there was need for a second appraisal for the HUD Project to meet the federal requirements. One appraisal had been received from Frank Callahan. This was for 12 discontinuous parcels of land Motion by Alderman Pepe "I move that Mr. Earl R Baugher be retained to complete appraisal for 12 discontinuous land parcels as required for the HUD project and as approved by the Parks Commission. Account No. 454 is to be charged" Motion was seconded by Alderman Donaldson and passed 5-0 Meeting was adjourned at 10 00 p m ( /1 ^' ,,? Mr. Boyd Cramer tells us there is a need for some "Please Do Not Litter" siflns above the trash barrels as well as other signs in the Parks. The money is to be used for this purpose. The children of Wheat Ridge Junior Grange (who range in age from five to fourteen years) earned this money by selling litter bags for automobiles. They are pleased that it will go to further their anti-litter project.
