HomeMy WebLinkAbout07/29/1971 MHJUTES July 29, 1971 The one hundred and eighteenth regular meeting of the Wheat Ridge City Council was called to order at 7390 West 38 Avenue at 7 30 p.m. by Mayor pro tem Dana Bowling. . Other Aldermen present were Joseph Donaldson, Robert Howard, Calvin Hulsey and Ray C. Pepe. Mayor Anderson and Alderman Jack Bramble were absent Also present were City Clerk Louise Turner, City Attorney Maurice Fox, staff personnel, committee members and interested citizens. Citizen's Comments were made by Mrs. Kay Sipple of 9300 West 38 Avenue who read a letter written by her to the Mayor and City Council regarding the requirement that citizens owning property abutting the City ROW pay for removal of trees on said ROWand the fact that this require- ment is placing a heavy burden on citizens during the present outbreak of Dutch Elm disease. A copy of the letter is in the General File under "Citizen's Comments Miscellaneous". WZ-71-17 Rezoning Case came up for decision Motion by Alderman Pepe "I move that Case WZ-71-17 for rezoning at 3840-3850 Harlan Street be approved from Residential-Three to Restricted-Commercial-one for this reason It is in keeping with the use to the southeast and west, the Comprehensive Plan shows this parcel to be commercial, Restricted-Commercial-One is the most restrictive of the commercial uses and the Planning Commission recommended approval." Motion was seconded by Alderman Hulsey and passed 5-0. WZ-71-19 Rezoning Case came up for decision. Attorney Fox in answer to a question ruled that Council would be approving the plan presented, but that changes other tnan major changes could be made at the second presentation and that it would be appropriate that recommendations for changes be presented to the applicant at this time. Alderman Howard stated that he felt 54 units to be excessive and asked Mr. LaPorta if he would consider reducing the number The reply was negative. Motion by Alderman Pepe "I move that Case No. WZ-71-19 be approved from Agricultural-One to Planned Unit Development of multiple units because it was a good design that was presented to Council, it was a good use for the property and the Planning Commission and Planning Department recommended approval." Motion was seconded by Alderman Hulsey and passed 3-1 with Alderman Bramble and Donaldson absent, and Alderman Howard voting "nay". Construction of apartment units by Custom Builders in the Flood Plain came up for decision. A Finding of Fact was read and the following Motion was made by Alderman Howard "I move that a special exception permit as authorized by Ordinance No. 58 be granted to Custom Builders, owner-contractor, for construction of five 5-unit town house buildings at 3705, 3725, 3745, 3755 and 3785 Quail Street as proposed to City Council on July 22, 1971." Motion was seconded by Alderman Donaldson and passed 5-0 Ordinance No. 87 was presented by Rocco Gioso of the Personnel Committee who explained that the Ordinance basically allowed a ~/&o cost of living increase to City employees for the balance of 1971 after September 1, 1971. ..../ / ~ -2- Ordinance No 87 was introduced by Alderman Hulsey and read. Motion by Alderman Donaldson "I move that Ordinance No. 87 allowing a ~/t!o increase in pay to City employees for the balance of 1971 be approved on first reading and be published and posted." Motion was seconded by Alderman Hulsey and passed 5-0. Alderman Bramble was absent. Mr. Gioso explained two other oridnances which the Personnel Committee recommended anD 21 suggestions made by employees _ some approved and some denied by the Committee. Paul Walker, Planning Director, presented deeds from A.L. and M.M. Backer and R L. and A.K. Williams to Council for acceptance. Motion by Alderman Pepe from Mr. and Mrs. Backer was seconded by Alderman "I move that Council accept and Mr. and Mrs. Williams." Donaldson and passed 5-0. the deeds Motion Building Inspector Jack Prose presented to Council the fact that on three pieces of property of the mBny that had been notified, the owners had refused to cut weeds which had grown above the 18 inch limit. He pointed out that according to Ordinance No 50 Council must order them cut. It was further pointed out in answer to questions that such matters would be handled more expediently if ad- ministered by the department rather than by Council and that 8 to 10 inches would be more realistic a weed height limit than 18 inches. Proposed changes to the Weed Ordinance are to be drafted by Mr. Prose prior to the next meeting. Paul Walker, Planning Director, reported on a meeting of the Mass Transit Committee and a consensus of their opinions was presented. A resolution reflecting statements from the joint meeting with Arvada was read. Mr. Fox was asked about the legality of a Motion made at a previous meeting to move the Lower Earth Coffee House. Mr. Fox stated that Council might withdraw its moral support by resolution or motion, but had no authority in regard to evicting a tenant.
