but not IInuted to plant material, street furnIture and other items shown in Wheat Ridge Project II S-SCP-02-0I, including payment
of the water bdl for water tap numbers WRWD #4390 and WRWD #4391 The City's irrigation system and the property uvmer's
water service shall be and remain mutually exclusive Nu inter-connects of water systel11S shall be allowed.
Subject to the following terms and conditions: To the extent pernutted by law, and without waIving any in1l1lUIlltles, protections, or
defenses available at COnlnl0n law or under statute, including, WIthout limitation, the Colorado Governmental ImmunitIeS Act,
Sectiun 24-10-101, et seq., C.R.S., the CIty, Individually and for Itself unly, agrees to hold harmless the Grantor(s) from and
against any SUIt, claim, attorney's fees, loss or damage, including personal injury or loss of lIfe, which may occur as a result of
negligent construction ur mamtenancc of said streetscape clements and Irn;;atlon system by andior for the City of Wheat Ridge on
the properly subject to thIS easement.
SaId tract contains 1366 square feet (0 0314 acres) ofland, more or less.
Alsu known by street and number as. 5700 & 5712 West 3Sth Avenue, Wheat Ridge, CO S0212.
And the Grantors hereby covenant with the CIty that they have good title to the aioredescribed premises; and that they have good and lawful
right to grant this casement.
