but not limited to plant matenal, street furniture and other Items shown m Wheat Ridge Project # S-SCP-02-0 I, including payment
of the water bill for water tap number WRWD #4390 The CIty'S irrigation system and the property owner's water service shall be
and remain mutually exclusive. No inter-connects of \Vater systems shall be allowed.
Subject to the following tenns and conditions: To the extent pemlitted by law, and without waivml!, any n11tl1unities, protections, or
defenses available at common law or under statute, mcludmg, without lmutation, ttle Colorado Governt11entallmmunities Act,
Section 24-10-101, et seq., C.R.S., the City, individually and for itself only, agrees to hold harmless the Grantor(s) from and
agall1st any suit, clarm, attomey's fees, loss or damage, ll1cluding personal mjury or loss of hfe, wlllch may occur as a result of
negligent construction or maintenance of said streets cape elements and irrigallon system by anwor for the City of Wheat Ridge on
the property subject to this easement.
Said tract contains 3,220 square feet (0 0739 acres) ofland, more or less.

And the Crrantor hereby covenants With the City that he has good title to the aforedeseribed premises; and that he has good and lawful right
to grant this easement.
