September 2, 1971
The one hundred and twenty-third regular meeting of the Wheat Ridge
City Council was called to order at 7 30 p.m at 7390 West 38 Avenue
by Mayor Albert E. Anderson.
Aldermen attending were Dana Bowling, Jack Bramble, Joseph Donaldson,
Robert Howard, Calvin Hulsey and Ray Pepe
Also attending were Mayor Anderdon, Clerk Louise Turner, City Attorney
Maurice Fox, Planning Director Paul Walker, Building Inspector Jack
Prose and interested citizens.
Citizen's Comments were made by C.F Hustede in regard to

and signed a Proclamation making Wheat Ridge the first City to proclaim
September 20th through September 26th, 1971 as National "Men's Garden
Club Week".
Rezoning Case WZ-71-21 came up for decision Applicants M F and Meliak
Cottrell had requested a change from Residential-Three to Restricted-
Commercial-One at 4490 Harlan Court.
Motion was made by Alderman Bowling "I move that the request of
Rezoning Case WZ-71-21 for a change from Residential-Three to Restricted-
Commercial-One be denied for the following reasons The Comprehensive
Plan shows this property to be low density residential, this would be
encroachment on a single-family neighborhood and detrimental to same,
it faces Harlan Court and there is no need to ruin the integrity of
Harlan Court and 45 Avenue." Motion was seconded by Alderman Hulsey
and passed 4-1 with Alderman Pepe voting "nay" and Alderman Howard
abstaining
Paul Walker, Planning Director, presented to Council the Board of
Adjustment Bylaws which had been revised according to recommendations
from the Council and approved as revised by the Board of Adjustment.
Motion by Alderman Bowling "I move that the City of Wheat Ridge adopt
the Board of Adjustment rules of procedure as presented by the Board
of Adjustment." Motion was seconded by Alderman Bramb~e and passed 6-0
The Mass Transit bus proposal was discussed. Mayor Anderson presented
to Council petitions with 96 signatures of persons living west of
Kipling Street asking that service be extended to Youngfield
The Mayor stated that according to the City Attorney negotiation per-
taining to routes prior to acceptance of the ATE Proposal was not possible
The City had the choice only of accepting or rejecting the proposal by
August 31, 1971.
He further stated that the contract had been signed and submitted. He
asked Council for ratification of this action and the provision of money.
Motion by Alderman Bramble "I move that the contract for bus service
be ratified." Motion was seconded by Alderman Hulsey and passed 6-0.
\esolution ~Jo. 135 was introduced by Alderman Bramble.
Motion by Alderman Pepe "I move we adopt Resolution No 135 transferring
money from the unappropriated surplus to Account No. 490 for $26,500.00."
Motion was seconded by Alderman Donaldson and passed 6-0.

It was stated that passage of the Resolution did not constitute
approval of payment - request for such action would be made when the
bill is submitted.
Report on Condemned Building Procedure pertaining to a house at 11535
West 32 Avenue by Building Inspector Jack Prose who requested that
Council set a Public Hearing on the matter in order that a lien might
be established against the property to obtain payment for expenses in-
curred by the City was brought up.
Motion by Alderman Bowling "I move that Council schedule a Public
Hearing on September 30, 1971 at 7390 West 38 Avenue for the consideration
of a report of the Building Inspector ~taining to property at 11535
West 32 Avenue and that notice of said hearing be published and posted."
Motion was seconded by Alderman Donaldson and passed 6-0.
Motion by Alderman Hulsey "I move that the Planning Director of the
City of Wheat Ridge, Paul Walker, be appointed as the City of Wheat
Ridge representative to the Regional Planning Committee of the Denver
Regional Council of Governments" Moiton was seconded by Alderman
Howard and passed 6-0.
Motion by Alderman Donaldson "I move that the Wheat Ridge fire pro-
tection district be allowed to purchase its required petroleum
products from the City of Wheat Ridge." Questions asked by Aldermen
Bowling and Bramble clarified that the same privilege would be accorded
to Prospect Valley Fire District following a merger (now in process)
of the two districts and that Clyde Hobbs, Public Works Director, who
would be responsible for the distribution, though he anticipated some
problems with tax, was thought to be agreeable to the procedure.
Motion was seconded by Alderman Pepe and passed 6-0.
Ordinance No. 90 was brought up for second consideration and read.
Motion by Alderman Donaldson "I move that Ordinance No. 90 amending
Ordinance No. 50 which pertains to weeds be passed on second reading
and be ordered published and posted." Motion was seconded by Alderman
Hulsey and passed 5-1 with Alderman Howard voting "nay".
Ordinance No. 91 was introduced by Alderman Bramble.
Motion by Alderman Bramble "I move that Ordinance No. 91 setting
the salary for the Mayor be approved as read by the City Clerk and
be ordered published and posted." Motion was seconded by Alderman
Bowling and passed 5-1 with Alderman Howard voting "nay".
Ordinance No. 92 was introduced by Alderman Pepe.
Motion by Alderman Donaldson "I move that Ordinance No. 92 setting
the salary for the City Council be approved on first reading and be
ordered published and posted." Motion was seconded by Alderman Hulsey
and passed 6-0.
The 1972 Budget was presented to Council by Finance Officer Walter
Grande who requested that Council set a Public Hearing on it for
September 16, 1971 In answer to a question from Alderman Hulsey,
City Attorney Maurice Fox stated there was time for proper publication
of Notice of Hearing.
Motion by Alderman Donaldson "I move that a Public Hearing be set to
consider and adopt the 1972 Budget at 8 00 p.m., September 16, 1971
and that notice of this hearing be published and posted as provided
by law." Motion was seconded by Alderman Pepe and passed 6~[}.
Meeting was adjourned at 9 05 p.m.
