KNOW ALL MEN BY THESE PRESENTS, that Carl Robert Swanson and Helen Swanson, whose
address is 3121 Mountain Shadows Drive, Wheat Ridge, County of Jefferson, State of Colorado, 80215,
hereinafter called the "Grantors" for and in consideration of the sum of TEN AND NO/IOO DOLLARS
($LO 00) and other valuable consideration to them in hand paid by the City of Wheat Ridge, hereinafter
called "Citv", do hereby give and grant to said City PERMANENT EASEMENT on, along, over and
across the following described premises to-wit:
A tract of land lying in the sm;. of Section 29, Township 3 South, Range 69 West of the 6th
Principal Meridian, City of Wheat Ridge, County of Jefferson, State of Colorado, described as:
A portion of that parcel of real property as recorded at Reception Number 91025639 in the
official records of said County of Jefferson, Swte of Colorado, more particuiarly described as:
Commencing at the NW Comer of the SEt,!., of Section 29; thence N89029'16"E on and along the
North line of the SEt,!., of said Section 29, a distance of 56570 feet, thence SOo030'44"E, a
distance of 500 79 feet to the Point of Beginning;
Thence S48036'30"E, a distance of 135 40 feet to a point lying on the westerly Right-of-Way line
of Mountain Shadows Drive, said point being the point of curve of a non tangent curve to the left,
of which the radius point lies S48036'30"E, a radial distance of 52.50 feet; thence on and along
said Right-of-Way line southwesterly along the arc, through a central angle of 08045'54", a
distance of 8 03 feet; thence leaving said Right-of-Way line on a bearing of N48036'30"W, a
distance of 136.01 feet; thence N41 o2TJO"E, a distance of 8.00 feet to the Point of Beginning.
NOTE: All bearings are relative to onc another and are based on the bearing of the North line of
the SEt,!., of said Section 29 being N89029' 16"E.
For the purpose of. The construction and maintenance of a storm sewer
SubJect to the following terms and conditions: To the extent permitted by law, and without
waiving any immunities, protections, or defenses available at common law or under statute,
including, without limitation, the Colorado Governmental Immunities Act, Section 24-10-101, et
seq., C.R.S., the City, individually and for itself only, agrees to hold harmless the Grantors from
ilnd against any suit, claim, attorney's fees, loss or damage, including personal injury or loss of
life, which may occur as a result of negligent construction or maintenance of said storm sewer by
and/or for the City on the property subject to this easement.
Said tract contains 1,085 square feet or 0 0249 acres, more or Jess.
Also known by street and number as. 3121 Mountam Shadows Drive, Wheat Ridge, CO 80215
And the Grantors hereby covenant with thc City that they have good title to the afore described premises;
and that they have good and lawful right to grant this easement.
