Ellsworth Avenue, City of Golden, County of Jefferson, State of Colorado, 8040 I, hereinafter called the "Gran-
tors" for and in consideration of the sum of TEN and NOIlOO ($1000) and other valuable consideration to her in
hand paid by the City of Wheat Ridge, hereinafter called "City", do hereby give and grant to said City
PERMANENT EASEMENT on, along, over and across the following described premises to-wit
A tract of land lying iii the NF'!, of Section 21, TownshilY 3 South, Range 69 West of the 6th Principal
Meridian, City of Wheat Ridge, County of Jefferson, State of Colorado, as described at Reception Number
1'1873463 of the official records of the County of Jefferson, State of Colorado, more particularly described
as.
Commencing at the NE Corner of Section 21, thence SOoo09'23" E on and along the east line of the NE \Co, Section
21, a distance of930.32 feet; thence S890S0'37"W, a distance of 4800 feet to a Point, said Point lying on the west-
erly Right-of-Way IlIie of Kipling Street, being the northeast corner of the parcel found at Reception Number
94115230 and the southeast corner of the Parcel found at Reception Number 1'1873463, as described in the official
records of the County of Jefferson, State of Colorado, and being the True Point of Beginning;
Thence S89049'00"W on and along the southerly line of said Parcel, a distance of S 41 feet; thence NOoo04'00"W,
a distance 01'26306 feet to a point lying on the northerly line of said Parcel, thence N89027'18"E, a distance of
8 00 feet to a point lying on the westerly Right-of-Way line of Kipling Street; thence SOoo09'23"E on and along

Subject to the following terms and conditions: To the extent pernlitted by law, and without waiving any immunities,
protections, or defenses available at common law or under statute, mcluding, without limitation, the Colorado Gov-
ernmentallmmunities Act, SectIon 24-10-101, et seq., CR.S., the City, individually and for itself only, agrees to
hold harmless the Grantor from and against any suit, claim. attorney's fees, loss or damage, including personal injury
or loss of life, which may occur as a result of negligent construction or maintenance of said pedestrian lights and
sidewalk by and/or for the City on the property subject to this easement.
Said tract contains 1,559 square feet or 0 0358 acres, more or less.
Also known by street and number as. Kipling Village Apartments, Wheat Ridge, Colorado, 80033
And the Grantors hereby covenant with the City that they have good title to the afore described premises, and that
