The one hundred and twenty-eighth regular meeting of the Wheat Ridge
City Council was called to order at 7 30 P m at 7390 West 38 Avenue
by Mayor Albert E Anderson.
Aldermen attending were Dana Bowling, Jack Bramble, Joseph Donaldson,
Robert Howard, Calvin Hulsey and Ray C Pepe.
Also attending were Mayor Anderson, Clerk Louise Turner, City Attorney
Maurice Fox and interested citizens.
Citizen's Comments were made by
Ben Loye who requested a continuance of Case WZ-71-23 from
October 14, 1971 to November 11, 1971.
Motion by Alderman Donaldson "I move that Case No. WZ-71-23 be con-
tinued to November 11, 1971 and be republished and reposted " Motion
was seconded by Alderman Hulsey and passed 6-0.
Other Comments were made by
Paul Abramson who read the State Statutes saying that City
Council approves or denies a Land Use Plan presented by the Planning
Commission and stated he had gotten an interpretation from the Attorney
General that Council could approve or deny but not amend such a plan.
Alderman Hulsey requested that Attorney Fox contact the Attorney General
for an opinion and report back to Council.
Ordinance No. 93 pertaining to adoption of the revised Zoning Map was
brought up for second consideration and read Changes in the map were
discussed.
Thomas Carney, Attorney, of 1717 Washington, Golden representing Henry
Zarlengo questioned the designation of a piece of property north of
the Green Valley Subdivision and south of Clear Creek immediately west
of Kipling Street He stated that the property in question was shown
as Restricted-Commercial on the original zoning map and as Agricultural-One
on the new map, and that Mr Zarlengo had checked the zoning at the time
he had purchased the property and had been told by the Planning Department
that it was Restricted-Commercial Mr Carney presented a letter signed
by James 0 Mier, former Director of Planning, stating that he had
advised Mr Zarlengo in the latter part of 1970 that "that property was
zoned Restricted-Commercial in accordance with the then Wheat Ridge Zoning
Regulations as they had been adopted from Jefferson County The map
showed the property was zoned Restricted-Commercial from the subdivision
to the Creek on the west side of Kipling, going west a distance of ap-
proximately 1300 feet "
Mr. Walker of the Planning Department said the original map adopted by
the City was not accurate, that the creek was in a different place and
had been drawn correctly on the new map and that legal descriptions in-
dicated that the property in question was agricultural
Motion by Alderman Bramble "I move the matter be tabled for two weeks
and a decision rendered on the 21st of October 1971" Motion was seconded
by Alderman Pepe and passed 6-0
Ordinance No. 94 pertaining to a vacation of a portion of Reed Street
was brought up for second consideration and read
Motion by Alderman Howard "I move that Ordinance No. 94 pertaining to
vacation of a portion of Reed Street be passed on second reading and
be published and posted." Motion was seconded by Alderman Bramble
and passed 5-0
It was announced that a Motion of Appeal on the denial of permits for
wells in Paramount Park and a hearing request was filed on September 30, 1971

It was also announced that 1,000 copies of a map of proposed bikeways
be printed for trial and comments
An evaluation program of past citizen requests was discussed
Motion was made by Alderman Donaldson "I move that up to $500 00 be
authorized out of Account No 425 for a self-evaluation program of
Citizen Requests" Motion was seconded by Alderman Hulsey and passed
4-2 with Aldermen Pepe and Howard voting "nay"
Additional two-way radios for the Public Works Department were discussed.
Motion by Alderman Bramble "I move that the Treasurer be authorized to
purchase fuurtwo-way radios, charged to the appropriate account, and
not to exceed $2,573 00." Motion was seconded by Alderman Donaldson and
passed 6-0
