KNOW ALL MEN BY THESE PRESENTS, THAT Griffith, RoV L. Jr. & Judith L.
of Jefferson County, State of
Colorado , hereinafter called the "Grantor", for and in
consideration of the sum of ONE HUNDRED DOLl,ARS ($lOO.nn) and other valuable
considerations paid in hand by the CITY OF WHEAT RIDGE, COLORADO, hereinafter
called the "City", receipt of which is hereby acknowledged, has given and
granted and by these presents does hereby give and grant subject to the terms
and conditions contained within this agreement, unto the said City an option
to acquire a RIGHT-OF-WAY and EASEMENT on, along, over and across the following
described premises, to-wit: ~
A parcel of land situated in the SW ~ of the NE ~ of Section 22,
Township 3 South, Range 69 West of the 6th Principal Meridian in
Jefferson County, Colorado, which property is shown as the shaded
area on Attachment A affexed hereto and made a part and parcel of
this instrument and is more particularly described as follows:
Beginning at the northwest corner of Lot 34 of the Crestview
Park Subdivision (Amended), (which point is S210 17' west 50'
from a point in the center line of road on bridge at station
38+22.4 over Clear Creek); thence south 210 17' west for a
distance of 90 feet to a point on the west line of Lot 34
of said subdivision and thence south 680 40' east a distance
of 204 feet to a point thence north 690 13' east a distance of
128 feet more or less to the south ROW line of West 44th Avenue;
thence north 680 40' west along said ROW 294 feet more or less
to point of beginning containing 0.52 A. M/L and is the north-
west portion of Lot 34 of said subdivision.
FOR THE PURPOSE OF:
CONSTRUCTION OF BRIDGE AND RELATED APPURTANCES.
Subject to the following terms and conditions:
1. The City may exercise this option at its election at any
time prior to Januarv 1, 1975, by tendering to the "Grantor"
Fourteen Hundred Dollars ($1,400.00) prior to commencement
of construction.
2. Should the "City" so exercise its option said easement will
be in effect for six (6) months beginning from the date said
option is exercised.
3. Should the construction period extend beyond a six month
period of time the "City" shall pay over to the "Grantor"
the amount of Two Hundred and Fifty Dollars ($250.00) per
month or a pro rata amount thereof, but in no event shall
this easement continue in duration for a period of more
than one year from the date ~f the exercise of the option
referred to in numbered paragraph I above.
4. Should the "City" so exercise its option it will before
commencement of construction work erect and maintain during
the period of this easement a six (6) foot wooden fence
along the northern lot line of Lot 33, Crestview Park
Subdivision as illustrated on Attachment A hereto which
is incorporated by reference. Said fence will be at
"City" expense and will become the property of the "Grantor".
5. Should the "City" so exercise its option it will plant, 3Q
trees (10 Colorado Blue Spruce, 10 Seedless Cottonwood and
10 American Linden), within the Right-of-Way on W. 44th
Avenue adjacent to said easement for an aesthetics and a

noise barrier.
6. No permanent structures shall be erected by the "City" or the
"Grantors" on said easement during the period of easement.
7. Prior to completion of the project the temporary detour will
be removed and the easement will be restored equal to or
better than its original condition. Including, but not
limited to topsoil and a drought resistant seeding.
B. Rights bestowed to the "City" by this grant are personal and
cannot be assigned or transferred without the prior written
consent of "Grantors".
9. No temporary or permanent sanitary fac~lities shall be placed
on said easemen+'.
