WITNESSETH, that tile Party of the rirf:t Part, for himself, his
heirs and assigwo, \]rants and umveys unto the PiJrty of the Second
Part its heirs and assigns, an e~sement in, to, upon, and over all
that real property described as follows:
A tract of land located in the Northwest Quarter (N~), Southeast
Quarter (S.E.%), Section 29, Township 3 Suuth, Range 69 West of the
Sixth Principal Meridian, said tract being a portion of Lot Two (2)
of Mountain Shadows Subdivision-First Filing as recorded in Jefferson
County Plat Book 21, Page 39, said tract all being located in the
City of Wheat Ridge, County of Jefferson, State of Colorado and being
more particularly described as follows: Beginning at the ceBter
Section 29, Township 3 South, Range 69 West; thence North 89 31'
12" East along the East-West centerline Section 29, Township 3
South, Range 69 West a distance of 166.45 feet, thence South 000 41' 08"
East a distance of 30.000 feet to a point on ~he Southerly Right-of-
Way line of West 32nd Avenue; thence North 89 31' 12" East along
the Southerly Right-of-Way line of West 32nd Avenue a distance of
134.000 feet to the North Westerly corner of Lot 2, said corner
being the true point of beginning: Thence North 890 31'12" East
along the Southerly Right-of-Wa~ line of West 32nd Avenue a distance
of 49.000 feet; thence South 44 23' 30" West a distance of 37.770
feet; thence South 190 DO' West a distance of 32.220 feet; th~nce
North 710 DO' Wc~t B distance of 30.000 feet; thence North 19 DO'
East a distance of 50.000 Feet to the true point of beginning.
Said easement is given for the sole purpose of ingress and egress
and construction purposes, and it is agreed and understood that it is
not to be construed as an easement given to the exclusion of the Party
of the First Part, his heirs and assigns, or to others later granted
a similar right.
To have and to hold the said right of way easement unto the Party
of the Second Part for a period of six (6) months.
The Party of the Second Part agrees to repair all damages occasioned
by the construction activities.
IN WITNESS WHEREOF, the parties hereto have duly executed this
Agreement.
