BLEVINS (hereinafter referred to as "Grantor") to THE CITY OF WHEAT RIDGE, a municipal corporation, (hereinafter referred to as "The City"). WHEREAS, Grantor lS the owner of the real property described in Exhibit A, which is attached hereto and incorporated herein as lS fully set forth, which real property is situate, lying and being in the County of Jefferson, State of Colorado; WHEREAS, The City wishes to purchase a Temporary Construction Easement over, upon and to said real property; WHEREAS, it is the intent of The City to develop, construct and maintain drainage and flood control improvements on the property for the general health, safety and welfare of Grantor and other citizens of The City of Wheat Ridge; WHEREAS, the real property described herein is necessary for the development, construction, and maintenance of said flood control improvements; NOW, THEREFORE, Grantor, for herself, her successors and assigns, does hereby agree as follows: 1. Grantor does hereby grant and convey to The City a Temporary Construction Easement to the property described above, said Easement to continue for six (6) months from the date of execution hereof, which Temporary Construction Easement shall authorize The City to come upon the property described herein for the purpose of constructing and maintaining any flood control channels, structures, or other improvements deemed necessary by The City to fully and successfully implement the Lena Gulch Flood Control project contemplated by The City. 2. The Temporary Construction Easement granted hereby includes, without limitation, a grant of authority to The City to come upon the property for the purpose of surveying and inspec- tion, to go across the property to allow construction of such improvements, including channelization, embankments, maintenance roads, and other flood control improvements deemed necessary by The City to complete the project; to come upon and over the property for purposes of inspecting and maintaining such improvements, as well as any other uses not enumerated herein which are consistent with the purposes of this Easement. 3. The City agrees that, during the term of this Easement, it shall repair and maintain any damage which it causes to Grantor's remaining property during construction or repair of any improvements made pursuant to this Easement. 4. This Easement shall terminate automatically on April 13 1980. 5. As consideration for the granting of this Easement, The City agrees to pay to Grantor the sum of $194.00. , -)1 "v~ V MARY ~.
