THIS AGREEMENT, made
State of Colorad , on
WITNESSETH, that the Party of the First Part, for himself, his heirs and
assiqns, grants and conveys unto the Party of the Second Part its heirs and
assigns, an easement in, to, upon, and over all that real property described
as follows:
A tract of land located in the Northwest Quarter (NW 1/4), Southeast Quarter (SE 1/4),
Section 29, Township 3 South, Range 69 West of the Sixth Principal Meridian, said
tract being a portion of Lot Two (2) of Mountain Shadows Subdivision-First Filing
as recorded in Jefferson County Plat Book 21, Page 39, said tract all being located
in the City of Wheat Ridge, County of Jefferson, State of Colorado and being
more particularly de~cribed as follows:
Beginning at the center of Section 29, Township 3 South, Range 69 West,
thence North 890 31' 12" East alonq the East-West center line of Section 29,
a distance of 166.45 feet; thence South 000 41' 08" East a distance of 30.0 feet
to a point on the Southerly Right-of-Way line of West 32nd Avenue; thence North
890 31' 12" East along the Southerly Riqht-of-Hay line of ~Jest 32nd Avenue a
distance of 134.0 feet to the Northwesterly corner of Lot 2, said corner being the
true point of beginning; thence North 890 31' 12" East along the Southerly
Right-of-~Iay line of Vlest 32nd Avenue a distance of 49.00 feet; thence
South 440 23' 30" Vlest a distance of 37.77 feet; thence South 190 00' West a
distance of 60.0 feet; thence South 410 54' 36" West a distance of 15.41 feet;
thence South 190 00' West a distance of 41.843 feet; thence South 890 31' Vlest
a distance of 11.24 feet to the Northerly Right-of-Way line of the Denver
Municipal \.Jater Works Riqht-of-Way; thence North 480 05' 24" ~!est along said

a distance of 35.58 feet to its intersection with the Westerly property line of
said Lot 2; thence North 890 31 I East a distance of 20.55 feet; thence
North 190 00' East a distance of 116.38 feet to the true point of beginning.
Said Easement is given for the sole purpose of inqress and eqress and
construction purposes, and it is agreed and understood that it is not to be
construed as an Easement qiven to the exclusion of the Party of the First Part,
his heirs and assigns, or to others later granted a similar right.
To have and to hold the said Right-of-Way Easement unto the Party of the
Second Part for a period of six (6) months.

The Party of the Second Part agrees to repair all damages occasioned by the
construction activities.
