(hereinafter referred to as Grantor) to THE
CI'!'Y OF \.'lllEl\T RIDGE, a munici!Jal corporation, (hereinafter referred
to as Grantee).
In and
for the consideration of the r~utual covenants and
benefits described herein,
Grantor does hereby arant,
bargain,
sell, assign and convey to Grantee an Easement to use and to enter
upon the real property described on Exhibit 1\, which lS attached
hereto and expressly incorporated herein,
for a sum of
$8.50.
It is expressly understood and agreed by and between the parties,
and lS expressly made a portion of the qrant hereby conveyed, that
the Easement hereby granted is for the purpose of allowinq Grantee
to
enter
upon
the
property
described
for
the
purpose
of
constructing flood control improvements which will be of benefit to
Grantor and other citizens of The City of Wheat Ridge, as well as
to residents of surroundinq areas.
The Easement granted hereby shall entitle Grantee to enter
upon the described property for the purpose of constructing such
ir,1prove[;lents
as
[;lay be
contemplated
and
required
bv Grantee.
During the term of this Easement, which shall continue during any
construction activities carried on and maintained by Grantee on
said
flood-control
project,
Grantee
agrees
that
it
shall
be
responsible to repalr or compensate Grantor for any danages caused
by Grantee's utilization of this Easement to Grantor's surrounding
property.

DESCRIPTION:
A parcel of land in Block 19, Berkeley Heights Subdivision Second
Filing, in the 5W 1/4 of Section 13, Township 3 South, Range 69
I~est of the 6th Principal ~1eridian, Jefferson County, Colorado,
containing 0.51 acres, more or less, and is more particularly des-
cribed as follows:
Beginning at a point on the North line of the tract of land
described in Book 132, at Page 126 of the Records of Jefferson
County, which is also the northeast corner of a permanent ease-
ment described in Book 2005, at Page 144, records of Jefferson
County, from whence the southeast corner of said SW 1/4 of
Section 13 bears S 560 18' 05" E. a distance of 1577.40 feet;
1. Thence N 750 28' 40" E. along said North line, a distance
of 80.62 feet;
2. Thence SOo-08' 05" W. a distance of 175.00 feet;
3. Thence 5.450 08' 05" 11. a distance of 46.67 feet;

described permanent easement, from which the southeast corner
of said S~1 1/4 Section 13 bears S. 590 23' 35" E. a distance of
1434.56 feet;
