(hereinafter referreu to as Grantor) to THE
CI'l'Y OF WHENI' RIDGE, a municipal corporation, (hereinafter referred
to as Grantee).
In and for the cunsideration of the mutual covenants and
benefits described herein, Grantor does hereby grant,
bargain,
sell, assign and convey to Grantee an Easement to use and to enter
upon the real property described on Exhibit A, which 1S attached
hereto and expressly incorporated herein, for a sum of
$34.07.
I t is express ly understood and agreed by and between the parties,
and is express ly made a portion of the grant hereby conveyed, that
the Easement hereby granted is for the purpose of allowing Grantee
to
enter
upon
the
property
described
for
the
purpose
of
constructing flood control improvements which will be of benefit to
Grantor and other citizens of The City of Wheat Ridge, as well as
to residents of surrounding areas.
The Easement granted hereby shall entitle Grantee to enter
upon the described property for the purpose of constructing such
improvements
as may be contemplated and required by Grantee.
During tne term of this Easement, which shall continue during any
construction activities carried on and maintained by Grantee on
said flood-control project,
Grantee
agrees
that
it
shall be
responsible to repair or compensate Grantor for any damages caused
by Grantee's utilization of this Easement to Grantor's surrounding
property.

LEGAL DESCRIPTION OF LENA GULCH CONSTRUCTION EASEMENT NO. 2.107c
A parcel of land located in the Northwest 1/4 of the Northeast 1/4 of Section 28,
Township 3 South, Range b9 west of the 6th P.M., Jefferson County, Colorado,
described as follows:
Beginning at a point on the South right-of-way line of west 38th Avenue which lies
30 feet Southerly and 25 feet westerly from the Northeast corner of said Northwest
1/4, Northeast 1/4;
thence westerly along said South right-of-way line 39.0 feet;
thence on a deflection left of 390 48' 20.2". 46.86 feet;
thence on a deflection left of 500 II' 39.9". 33.0 feet;
thence on a deflection right of 280 48' 38.9". 22.83 feet;
thence on a deflection right of 580 48' 11.7". 16.30 feet;
thence on a deflection right of 310 II' 48.3". 42.95 feet;
thence on a deflection left of 280 48' 38.9". 71.12 feet, to a point on the East
line of Tract A. Horace Heights Subdivision;
thence along said East line 14 feet, more or less, to a point on the North bank of
Lena Gulch also known as Dry Creek which point is an angle paint of said Tract A;
thence on a deflection left of 660 15' 01.a", 27.31 feet along said North bank;
tnence on a deflection left of 230 44' 53.2", 76.0 feet;
thence on a deflection left of 110 46' 05.8", 24.52 feet;
thence on a deflection left of 420 23' 38.6", 22.20 feet;
thence on a deflection left of II" 52' 30.6", 29.55 feet;
thence on a deflection right of 21" 02' 15.0", 35.36 feet;
thence on a deflection right of 250 08' 41.2", 38.28 feet to the Point of Beginning,
containing 3,407 square feet or 0.078 Acres, more or less.
Said Construction Easement is contained in the property described in Book 1287 Page
163 of the Jefferson County Records.
