KNOW ALL MEN BY THESE PRESENTS, that Barbara L. Binkley of 2816 Te '\., ,-
Street, Wheat Ridge, of Jefferson County, State of Colorado, hereinafter
called the "grantor", for and in consideration of the sum of Ten Dollars
($10.00) and other valuable consideration to her in hand paid by the
City of Wheat Ridge, hereinafter called "City", does hereby give and
grant unto said City, TEMPORARY RIGHT-OF-WAY and EASEMENT on, along,
over and across the following described premises to-wit:
The South fifteen (15) feet of a tract of land recorded in Book
898, page 19, at Jefferson County and a fifteen (15) foot par-
cel of land beginning at a point seventy-five (75) feet North
of the Southwest corner of Lot 3, MORTENSON RESUBDIVISION and
proceeding in a Northeast direction toward the center of 28th
Place cul-de-sac (see attached exhibit). Said Lot 3, MORTENSON
RESUBDIVISION is recorded in Book 11, page 29, at Jefferson
County. Both said parcels of land being in the Southeast
one-quarter of Section 26, Township 3 South, Range 69 West.

For construction and maintenance of an open channel ditch. This ditch is
for the purpose of moving existing inlet drainage from Teller Street to
28th Place where concurrently constructed curb and gutter will facili-
tate this drainage.
Subject to the following terms and conditions:
This Temporary Easement shall expire on or before January 1, 1987. Prior
to this expiration, the property shall be restored to original or better
condition. This restoration shall be completed in conjunction with the
construction of a storm sewer along Teller Street south of 28th Avenue
to 26th Avenue.
