TEMPORARY CONSTRUCTION EASEMENT
The ADOLPH COORS COMPANY, a Colorado corporation, hereinafter
called the "GRANTOR", hereby acknowledges receipt of $10.00 (TEN AND
NO/lOO'S DOLLARS) from the CITY OF WHEAT RIDGE, hereinafter called the
"GRANTEE" whose legal address is
Wheat Ridge, County of Jefferson, State of Colorado, in consideration of
which Grantor grants unto said Grantee, their successors and assigns, a
temporary right-of-way and easement, for a period of time not to exceed
6 months from the date hereof, for construction purposes to install a
storm sewer through, under, across and along the premises described
herein. Said storm sewer shall be located on the following described
premises to wit:
A 30 foot wide strip of land located in the Southwest one-quarter
of Section 21, Township 3 South, Range 69 West of the 6th Principal
Meridian, in the City of Wheat Ridge, County of Jefferson, State of
Colorado, more particularly described as follows:
BEGINNING at a point 316 feet South and 528 feet West of the NE
corner of the SW 1/4 of Section 21, T 3 S, R 69 W of the 6th P.M. said
point also being the Southeast corner of Book 757, Page 368, and the
TRUE POINT OF BEGINNING; thence along the following four courses, the
bearings of which are based on the assumed direction from the SW corner
to the South 1/4 corner of said Section 21 as being N 89 degrees 28.8
minutes E: S 50 degrees 19.0 minutes E, 172.0 feet, to a point along
Clear Creek; thence N 77 degrees b.2 minutes E, 37.9 feet, along the
North edge of Clear Creek; thence N 50 degrees 19.0 minutes W, 220.0
feet to a point common to the East line of Book 757, Page 368; thence
S 00 degrees 3.0 minutes E along said East line of Book 757, Page 368,
39.1 feet to the True Point of Beginning, all within the NE 1/4 of the
SW 1/4 of Section 21, T 3 S, R 69 W of the 6th P.M.
Together with the right to enter upon said premises to survey and
construct said storm sewer. The Grantor reserves the right to use and
occupy said easement for any purpose consistent with the right and
privileges granted above. In case of the abandonment of the easement
for a period of one year, all right, privilege and interest herein
granted shall terminate.
The work of installing and constructing said storm sewer shall be
done in good workmanlike fashion and completed with reasonable
diligence. The ground surface along the easement shall be restored to
its original level and condition. Grantee shall reasonably and fully
cooperate with relocating the easement and any related fixtures and
devices thereon, at Grantor's expense, if so requested by Grantor in
writing.
Grantor shall grant unto said Grantee a 30 foot wide permanent
right-of-way and easement for said storm sewer, the legal description of
which is to be established by an As-Built survey. Upon receipt of the
As-Built legal description, Grantor shall replace this Temporary
Construction Easement with a Permanent Easement in substantially the
same form.
