THIS EASEMENT granted this" day of '7/(1).<...: q<-{~, -.-/ 1985, by
DEVELOPMENT PROPERTIES, INC., (hereinafter referred to as
Grantors) to the CITY OF WHEAT RIDGE, a municipal corporation,
(hereinafter referred to as Grantee).
In and for the consideration of the mutual covenants and
benefits described herein, Grantors do hereby grant, bargain, sell,
assign and convey to Grantee an easement to use and to enter upon
the real property described on Exhibit A, which is attached hereto
and expressly incorporated herein, for a sum of ONE DOLLAR ($1.00)
and other valuable consideration. It is expressly understood and
agreed by and between the parties, and is expressly made a portion
of the grant hereby conveyed, that the easement hereby granted is
for the purpose of allowing Grantee to enter upon the property
described for the purpose of constructing flood control
improvements which will be of benefit to Grantors and other
citizens of the City of Wheat Ridge, as well as to residents of
surrounding areas.
The easement granted hereby shall entitle Grantee to enter
upon the described property for the purpose of constructing such
improvements as may be contemplated and required by Grantee.
During the term of this easement, which shall continue during any
construction activities carried on and maintained by Grantee on
said flood control project, Grantee agrees that it shall be
responsible to repair or compensate Grantors for any damages caused
by Grantee's utilization of this easement to Grantors' surrounding
property.

LEGAL DESCRIPTION OF LENA GULCH CONSTRUCTION EASEMENT NO. 5.101c
The South 630 feet, more or less, of the West 1/2 of Tract 13, Brook-
side Subdivision, Jefferson County, Colorado EXCEPT the following
described Acquisition No. 5.101:
ACQUISITION 5.101:
A portion of the West 1/2 of Tract 13, Brookside Subdivision, Jefferson
County, Colorado described as follows:
Commencing at the Southeast corner of said West 1/2, said
point lying on the North Right-of-Way of West 35th
Avenue;
thence North 375 feet along the East line of said West
1/2 to the True Point of Beginning;
thence Southwesterly on a deflection left of 111. 10',
150 feet more or less to a point on the West line of said
West 1/2 which is also the East line of the dedicated
road Right-of-Way in Book 2240 Page 846;
thence North 177 feet along said West line;
thence Northeasterly on a deflection right of 780 50',
68.5 feet;
thence on a deflection left of 19. 20',85 feet more or
less to a point on the East line of said West 1/2;
thence south 179 feet along said East line to the True
Point of Beginning, containing 23,989 square feet or
0.550 acres more or less.
Said Construction Easement containing 63,884 square feet or 1.47 Acres
more or less.
Said Construction Easement is contained in the property described in
Book 2268, Page 921 of the Jefferson County Records.
