TITLE. AN ORDINANCE FOR THE REGULATION OF TRAFFIC WITHIN THE CITY OF
WHEAT RIDGE, COLORADO, ADOPTING BY REFERENCE THE "MODEL TRAFFIC CODE
FOR COLORADO MUNICIPALITIES" AS APPROVED AND PUBLISHED IN 1966 BY THE
COLORADO HIGHWAY SAFETY COUNCIL (NOW FUNCTIONING WITHIN THE STATE
OFFICE OF THE COORDINATOR OF HIGHWAY SAFETY) AND INCLUDING IN SAID
CODE-REFERENCES TO A SECONDARY CODE OFFICIALLY TITLED "UNIFORM TRAFFIC
CONTROL DEVICES FOR ALL CLASSES OF STREETS AND HIGHWAYS" ❑F CURRENT
ISSUE AS ADOPTED BY THE STATE DEPARTMENT OF HIGHWAYS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY.OF WHEAT RIDGE, COLORADO:
Section 1. Adoption. Pursuant to Article 34 of Chapter 139,
Colorado Revised Statutes 1963, there is hereby adopted for the purpose
of regulating traffic within the City of Wheat Ridge_ that certain
primary code known as the "Model Traffic Code for Colorado Municipalities"
embodying references to a secondary code-of traffic control devices as
described above in the title of this ordinance and hereinafter jointly
referred to as the "Municipal Traffic Code," of which three (3) copies
of both primary code and secondary code, together with traffic control
schedule of designated streets, are now filed in the office of the City
Clerk of the City of Wheat Ridge, and may he inspected during regular
business hours, the same being adopted_as -.f set out at length save
and except the following amendments and exclusions:
Code Section 15-5(f) is amended to read as follows:
Vehicular traffic facing a steady red signal alone
shall stop before entering the crosswalk on the near
side of the intersection or at a sign or pavement
marking indicating where the stop shall be made, or
in the absence of any such crosswalk, sign, or
marking, than before entering the intersection and
shall remain stopped or standing until a green
indication is shown; except, that the driver of any
such vehicle, after coming to a stop and after yield-
ing the right-of-way to pedestrians and other traffic.

official sign has been erected prohibiting such right
turn.
Section 2. Penalties for violation. The following penalties,
herewith set forth in full, shall apply to the provisions of the
Municipal Traffic Code herein adopted:

(a) It is unlawful for any person to violate any of the
provisions of the Municipal Traffic Code and any such violation shall
be punishable as is hereinafter provided.
(b) Every person convicted of a violation of any provision
of this ordinance shall be punished by a fine not exceeding three
hundred dollars (8300.00), or by imprisonment not exceeding ninety (90)
days, or by both such fine and imprisonment.
Section 3. Application of ordinance. This ordinance shall
apply to every street, alley, sidewalk or sidewalk area, driveway,
park, and to every other public way or public parking area within the
corporate limits of this municipality, the use of which this municipality
has jurisdiction to regulate. The provisions of Sections 5-1, 5-2, 15-12,
and 23-3 of the Municipal Traffic Code respectively concerning careless
driving, reckless driving, unauthorized devices, and accident investi-
gation shall apply not only to public places and ways but also throughout
the municipality of Wheat Ridge.
Section 4. Effect of ordinance. If any part or parts of this
ordinance are for any reason held to be invalid or unconstitutional,
such decision shall not affect the validity or constitutionality of the
remaining portions of this ordinance. The City Council hereby declares
that it would have passed this ordinance and each part or parts thereof,
irrespective of the fact that any one part or parts be declared invalid
or unconstitutional.
Section 5. Short Title. This ordinance may be known and
cited as the Municipal Traffic Ordinance.
Section 6. Emergency Clause. The provisions of this ordinance
are necessary to the immediate preservation of the public health and
safety of the citizens of Wheat Ridge for the following reasons:

(a) No public health and safety ordinances exist in the
City because the-City, having just completed incorporation August 20,
1969, has not heretofore adopted any ordinances controlling public
health and safety within the municipality.
(b) Are necessary to allow police officers of the City of
Wheat Ridge to enforce the regulations within the City of Wheat Ridge.
Section 7. Effective date. This ordinance shall take effect
and be in force five days after publication following final passage
providing it shall have been passed by an affirmative vote of three
fourths of the members of the City Council; otherwise said ordinance
shall take effect thirty days after publication following final passage
after Public Hearing.
INTRODUCED, PASSED ON FIRST READING, and notice of public
hearing ordered published on the 16th day of September, A. D. 1969.
PUBLICATION FOLLOWING FIRST READING-AND public hearing ordered
this 2nd day of October, A. D. 1969.
PASSED, ADOPTED AND ORDERED PUBLISHED on second and final
reading this 28th day of October, A. D. 1969.
