TITLE. An ordinance adopting by reference the City of Arvada, Colorado
Building Code, as amended, published in 1969, which primary code adopts the
Uniform Building Code, 1967 Edition, Volumes III (11ousing), IV (Dangerous
Buildings Code), and V (Signs) of the Uniform Building Code, 1967 Edition, The
Uniform Mechanical Code, 1967 Edition, The Fire Prevention Code, 1965 Edition,
The Uniform Plumbing Code, 1967 Edition, and the National Electrical Code, 1968
Edition.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VHE_AT RIDGE, COLORADO:
Section 1. Adoption. Pursuant to :article 34 of Chapter 139, Colorado
Revised Statutes, 1963, there is hereby adopted for the purpose of providing
minimum standards to safeguard life or limb, health, property and public welfare
by regulating and controlling the design, construction, quality of materials,
use and occupancy, location and maintenance of all buildings, structures and
utilities within the City of Wheat Ridge that certain primary code knoi•m as the
City of Arvada Building Code, as amended, published in 1969, which primary code
adopts the following secondary codes:
1. The Uniform Building Code, 1967 edition.
2. Volume III, Uniform Building Code, 1967 edition (housing)
3. Volume IV, Uniform Building Code, 1967'"edition (Dangerous Buildings Code)
4. Volume V, Uniform Building Code, 1967 edition (Signs)
5. The Uniform Mechanical Code, 1967 edition
6. The Fire Prevention Code, 10,65 edition (Recommended by American
Insurance Addociation)
7. The Uniform Plumbing Code, 1967 edition, as adopted by the International
Association of Plumbing and Mechanical Officials.
8. National Electric Code, 1968 edition (Copyright by The National Fire
Protection Association), of which three (3) copies of the primary code and each

secondary codes are filed in the Office of the City Clerk of the City of Wheat
Ridge, and may be inspected during regular business hours, the same being adopted
as if set out at length save and except the following amendments and exclusions:
Code Section 7-4 is amended to read as follows:
RECORDS General file records in the Building Division shall
be open for public inspection, but may not be removed from the Building Division.
Specific investigation records on individual cases and license applications are
not open to the public except by direction of the Mayor or order from the court.
Plans on file in Building Inspection shall not be made available
to the Public for reproduction, tracing or copying. Nothing in this article is to
be interpreted as prohibiting the City from micro-filming any plans or specifications
for file purposes within the City.
Code Section 7-12.is amended to read as follows:
(E) Fee. Each application for a hearing before the Board shall
be accompanied by a fee as established by the Mayor.
(I) Decision. The Board shall render a written recommendation to
the Mayor within fifteen (15) days following the meeting. The Mayor shall thereupon
review this recommendation and shall issue a final administrative decision in the
case within ten (10) days following receipt of said written recommendation.
Code Section 7-13 is amended to read as follows:
7. Unsafe Buildings. It shall be unlawful for any person, firm,
or corporation to maintain or permit to be maintained, any building, structure
or utility when such building, structure or utility is unsafe in accordance with
the provisions of this Building Code. These requirements shall apply to buildings,
structures or utilities, now existing, under construction or being demolished.
Code Section 7-14 is amended to read as follows:
CITY shall mean City of Wheat Ridge, Colorado.
DIVISIO14 shall mean the Building Inspection Division of the Public
Services Department of the City of Wheat Ridge, Colorado.

Code Section 7-21 is amended to read as follows:
SUSPENSION OR REVOCATION OF LICENSES
A. Authority. The Mayor may upon recommendation of the Chief Building
Inspector suspend or revoke a license when the licensee commits one or more of the
following acts or omissions:
1. Failure to comply with any of the licensee responsibilities
as outlined in Section 7-19.
2. Knowingly combining or conspiring with a person, firm or
corporation by permitting one's license to be used by such person, firm or
corporation.
3. By acting as agent, partner, associate or in any other capacity
with persons, firms, or corporations to evade the provisions of this Building Code.
4. Violation of any provisions of this Building Code.
B. Procedure. When any of the acts or omissions as herein enumerated
are committed by a license holder and the Mayor deems that such license shall be
suspended or revoked, the procedure shall be as follows:
1. The licensee shall be notified, in writing, by certified mail
or by personal service, at least sever (7) days prior to suspension or revocation.
2. Upon receipt of the notice, the licensee may request a hearing.
Such request shall be in writing to the Mayor within seven (7) days of receipt of
notice.
3. If a hearing is requested by the licensee, the Mayor shall set
a time, date and place and so notify the licensee.
4. When a hearing is conducted, the licensee and other interested
parties may be in attendance. Upon completion of the hearing, the Mayor shall
take all evidence admitted under advisement and shall notify the licensee of his
findings and ruling in writing by certified mail.
C. Emergency Suspension. If the Mayor finds that cause does exist for
suspension or revocation of a license, he may enter an order for immediate
suspension of such license, pending further investigation. The licensee may, upon
notice of such suspension, request an mediate hearing before the Mayor and the
hearing shall be conducted in the manner prescribed by other sections of this
Building Code.

D. Delegation of Authority. In the event of a hearing, the Mayor may
appoint a qualified employee of the Division to sit in his stead as the hearing
commissioner to conduct said hearing. Final decision shall be rendered by the
Mayor.
Code Section 7-23 is amended to read as follows:
I. Permits not to be issued under certain conditions. The Mayor
or the Director of Public Services may order, in writing, that the Chief Building
Inspector temporarily stop issuing building permits to a certain ovmer, person,
firm or corporation, in the case of millful and repeated violation of this Building
Code, the City Engineer's Standards and Specifications or other City regulations.
Code Section 7-24 is amended to read as follows:
D. Permits Not Requiring Fees. The Government of the United States
of America, the State of Colorado and its political sub-division, the City of :dheat
Ridge and all agencies and departments thereof, shall be exempt from the payment
of fees for work performed on buildings, structures or utilities ocmed wholly by
such agencies or departments and devoted exclusively to governmental use.
Code Section 7-26 is amended to read as follows:
C. Approval Required. Work shall not be performed on any portion
of a building, structure or utility beyond the point indicated in each successive
inspection without first obtaining the approval of the Building Inspection Division.
Such approval shall be given.only -after an inspection shall have been made of each
successive step in the construction as indicated by each of the inspections in this
Article.
Foundation cork, reinforcing steel or structural framework of any
part of any building, structure or utility shall not be covered or concealed in any
manner whatever without first obtaining the approval on every building, structure
or utility when the same is complete and ready for occupancy.
Code Section 7-29 is amended to read as follows:
(h) The provisions of the above bond shall be such that, if the
work on the building or structure is completed and the building is ready for
Certificate of Occupancy within one hundred twenty (120) calendar days after
such time as the structure enters the corporate limit of the City of Wheat Ridge,
then the bond shall become void, however, if said work is not complete within

the said 120 days, the entire principal sum shall be paid over to the City of
Wheat Ridge.
Section 2806 (a) shall be amended as follows: Append a new
sentence to the first paragraph to read "frost line in the City of Wheat Ridge
is hereby established as three feet (31012) below grade.
Section 7009
Part 4. Wheat Ridge is hereby established as being within
seismic zone one.
Code Section 7-34 is amended to read as follows:
Adoption of Uniform Building Code, Volume IV 1967 edition (Danger-
ous Buildings Code). The Uniform Building Code, Volume IV 1967 edition (Dangerous
Buildings Code) is hereby adopted by reference thereto and incorporated into this
Section as though fully set out herein as the Dangerous Buildings Code of the
City of Wheat Ridge. Except as otherwise provided in this Article, such Code is
adopted in full, including the outline of contents and the index contained therein.
Code Section 7-38 is amended to read as follows:
A. Part One, 05.
5. Sec. 1.10. To Whom Permits May Be Issued, is amended by
deleting all of Subsection (a) and inserting the following therefor: (a) No
permit shall be issued to any person to do or cause to be done any plumbing work
regulated by this Code, except to a person holding a valid, unexpired and unrevoked
plumbing contractors license as required by Article III of the Building Code of
the City of Wheat Ridge and see. 2.2 (as amended) of this Plumbing Code. Sub-
section (b) and (c), no change.
B. Part Two, Sec. 2.1, Sec. 2.2.
Sec. 2.1. Plumbing Defined. Plumbing is the installation of
the pipes, fixtures, and other apparatus necessary either for supplying water or
for removing liquid and water borne wastes,or both. The term is also used to
denote installed fixtures, drainage, vent, water-distribution systems, and taps
for underground sprinkler systems. Provided that this definition shall not be
construed to include installation, alteration and/or repair of domestic appliances
equipped with backflow preventers, water heating appliances, building heating

appliances and systems, fire protection and air conditioning installation, and
water conditioning appliances, where such appliances, systems and installations
are not connected to the sewer; and profided further that such appliances,
systems and installations are connected to the water supply under permit, subject
to inspection and by persons licensed in accordance with the ordinances of the
City of Wheat Ridge.
Sec. 2.2. License Required. It shall be unlawful for a person
to conduct or carry on or engage in the business, trade, or calling of Plumbing
or to install plumbing in connection with the dealing in or selling of plumbing
material and supplies, in the City of Wheat Ridge, without first having obtained
a contractors license as required in Article III of the Building Code.
Code Section 7-42 is amended as follows:
A. General. The maximum size of signs permitted in Wheat Ridge
is hereby extablished as sixty (60) square feet per face and any reference to
signs of a larger size shall be deleted from the Uniform Building Code, Volume V.
Part B. 3. All setbacks, projections, sizes, heights set forth in
01 v the Uniform Building Code, Volume V shall be amended to conform to the Zoning

gods of the City of Wheat Ridge.
Code Section 7-42, section 3 is hereby excluded and not adopted by
reference as part of the Wheat Ridge Penal Code.
Section Penalties for violation. Whenever in any Section of
this Building Code, or any Section of a rule or regulation promulgated hereunder,
the doing of any act is required, prohibited, or declared to be unlawful and no
definite fine or penalty is provided for the violation therof, any person, firm
or corporation who shall be convicted of a violation of any such Section shall,
for each offense, be fined in ,a sum not more than three hundred dollars ($300.00)
or imprisoned not to exceed ninety (90) days, or both so fined and imprisoned.
The suspension or revocation of any license, certificate, permit
or other privileges conferred by the City shall not be regarded as a penalty for
the purposes of this Building Code.

Section Application of ordinance. This ordinance shall
apply throughout the municipality of Wheat Ridge.
Section _ Effect of ordinance. If any part or parts of this
ordinance are for any reason held to be invalid or unconstitutional, such
decision shall not effect the validity or constitutionality of the remaining
portions of this ordinance. The City Council hereby declares that it iould have
passed this ordinance and each part or parts therof, irrespective of the fact
that any one part or parts be declared invalid or unconstitutional.
Section Short Title. This ordinance may be known and cited as
the Wheat Ridge Building Code.
Section _ Emergency Clause. The Provisions of this ordinance
are necessary to the immediate preservation of the public health, safety and
welfare of the citizens of Wheat Ridge for the following reasons:
1. No Building Ordinances exist in the City because the City
having just completed incorporation August 20, 19601, has not heretofore adopted
any ordinances relating to the licensing of contractors, control of building,
establishment of permit values, license and permit fees, or methods of
enforcement.
2. Building Ordinances are necessary to preserve the public
health, safety and welfare of the City of Wheat Ridge.

Section Effective date. This ordinance shall take effect and
be in force five (5) days after publication following final passage providing
it shall have been passed by an affirmative vote of three-fourths (314) of the
members of the City Council; otherwise, said ordinance shall take effect thirty
(30) days after publication following final passage.
