AN ORDINANCE ESTABLISHING A CITY PLANNING COMMISSION; THE APPOINTMENT OF MEMBERS THERETO; THEIR TERM OF OFFICE; THE ELECTION OF ITS OFFICERS AND ITS RULES OF CONDUCT; ITS POWERS AND DUTIES GENERALLY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Membership; appointment of members; term of office. The city planning commission shall consist of seven (7) members who shall be as follows: Five members shall serve as full members of the planning commission. Two members shall serve as alternate members of the planning commission and attend and participate in meetings as members of the planning commission only when called by the Chairman to sit in the place of an absent regular member. The members of the planning commission shall be appointed by the mayor with the approval of the council, and shall serve at the pleasure Of the council. All members shall be selected from among the duly qualified electors Of the city. The term of each appointed member shall be five years or until a successor takes office, except that the terms of the members first appointed shall provide that one member will be appointed for a five year term, one member. for four years, one member for three years, one member for two years, one member for one year, one alternate shall be appointed for a three year term and one alternate shall be appointed for a five year term. After said initial appointments all subsequent appointments shall be for five year terms in order to provide for the appointment Of at least one member of the commission each year, provided that any appointments to fill unexpired terms shall be for the balance of the term of the member being replaced and in the same manner pre- scribed in this section. Section 2. Chairman; rules for transaction of'business• records to be kept. The city planning commission shall elect its chairman from among the appointed members and create slid fill such other of its offices as it may determine. The term of the chairman shall be one year, with eligibility for reelection. The commission shall hold at least one regular meeting in each month. It shall adopt rules for transaction of business and shall keep a record of its resolutionp, transactions, findings and determinations, which record shall be a public record. Section 3. Powers and duties generally. The city planning commission shall have all of the powers and perform each and all of the duties specified by chapter 139, articles 59 and 60, of the 1963 _ Colorado Revised Statutes, as amended, together with any other duties or authority which may hereafter be conferred upon them by the laws of the state. The performance of such duties and the exercise of such authority is to be subject to each and all the limitations expressed in such legislative enactments. Section 4. Emergency clause. The provisions of this ordinance are to establish a planning commission pursuant to Chapter 139, Atricle 59, of the Colorado Revised Statutes, 1963, as amended for the following reasons: A. This ordinance is necessary for the immediate preservation of the public health or safety. B. No ordinances establishing a planning commission exist in the city because the city, having completed incorporation August 20, 1969, has not heretofore adopted any ordinance establishing a planning commission. Section 5. Effective Date. This ordinance shall take effect and be in force five (5) days after publication following final passage providing it shall have been passed by an affirmative vote of three fourths (3/4) of the members of the City Council; otherwise said ordinance shall take affect thirty (30) days after publication following final passage. - 2 - • INTRODUCED, READ, ADOPTED AND ORDERED PUBLISHED AND POSTED on first reading by a vote of 5 to 0 this 6th day of November, A.
