':~-t9 Series of 1970 TITLE: AN ORDINANCE PROVIDING FOR A CIVIL SERVICE SYSTEM FOR ALL FULL TIME REGULAR EMPLOYEES _'OF THE POLICE DEPARTMENT EXCEPT FOR THE CHIEF OF POLICE; CLASSIFICATION OF ALL EMPLOYMENTS IN THE POLICE DEPARTMENT;, OPEN AND COMPETITIVE EXAMINATIONS AND INTER- VIEWS TO DETERMINE QUALIFICATIONS FOR EMPLOYMENT; EMPLOYMENT AND PROMOTIONS BASED ON MERIT, EXPERIENCE AND RECORD OF SERVICE; ES- TABLISHMENT OF PAY SCALES; ADOPTION OF CIVIL SERVICE RULES AND REGULATIONS AS ADOPTED BY SEPARATE ORDINANCE; AND SUCH OTHER MATTERS AS COUNCIL SHALL DEEM PROPER. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF'WHEAT RIDGE; COLORADO, THAT: Section 1._ Police Department - Who Constitutes- Duties and Powers. The Police Department shall be composed ❑f the 'Chief ❑ Police who shall be appointed by the City Council by majority vote. and such subordinate officers and policemen as shall be_autho_rized by City Council as necessary to preserve the peace, protect persons' and property, and enforce laws and ordinances. A11'members of the Department, except the Chief and his appointive Division Chiefs as hereafter provided for, shall be determined to be members of-the Classified Service and shall be appointed pursuant to Civil Service requirements. Section 2_. _The Classified Service of the Police Depart- ment shall consist of and onl of the following Ranks and Grades: Captain Lieutenant, . Sergeant Detective Corporal Senior Patrolman Patrolman 1st Class Patrolman 2nd Class Patrolman 3rd Class Recruit Dispatcher Additional grades or ranks may be created only by at least four (4) votes of City Council. When created, they shall become a grade in the Classified Service, subject to Civil Ser- vice regulations. Any grade, or rank shall be thereafter abolished by four (4) votes of City Council. Positions allocated to such grade or rank may only be filled pursuant to Civil Service examination and certification. • rr , Section 3. Chief of Police. The Chief of Police may be appointed from the ranks of the Classified Service and, in such an event, during the time he shall serve in such capacity he shall retain and have accrued to him said time-as active service in the Police Department and in the Classified Service,-thereof,, for all purposes in connection with retirement, pension benefits, sick leave, vacation leave, terminal pay, hospitalization, doctors, surgeons, nurses and medical carewhen injured_in-the line of duty, -leavesuf. absence when injured in the line of duty, benefits tohis wife and,depen- dent children upon death, and all other benefits of the Classified Service of the Police Department which may now be in force-or hereafter be provided, other then salary, on the same basis and = with the same effect as if during such time he had remained in active service in the Police Department and in the Classified Service thereof, in the rank which he held in the Classified Service when appointed. The-incumbent Chief of Police, who is holding said officeon the date this ordinance becomes effective, shall, upon passage of this ordinance, become a member of the Classified Service of rank of Captain and shall have accrued to him_ all the- Tights and benefits as any other member of the Classified Service holding the rank of Captain upon passage of this ordinances - Section 4. Chief of Police. The Chief of Police may, from time to time, with the-- approval of the Mayor, assign-not more than three (3) officers in the Classified Service of the rank of Captain or Lieutenant to perform the duties of Division Chiefs, each of whom shall perform such duties so, long as his services are satisfactory to the Chief of Police, and the latter shall see fit.to continue such assign- ment. Each officer so assigned shall receive a salary as set by City Council by ordinance;_ however, such salary must be at least one pay step higher than the salary paid to a Captain in the Classified. Service. During such period of time as a Captain or Lieutenant shall serve in such capacity, he shall retain and have accrued to him said time as active service in the Police Department and in the Classified Service thereof, for all purposes in connection with retirement, pension benefits, sick leave, vacation leave, terminal pay, hospitalization, doctors, surgeons, nurses and medical care when injured in the line of duty, leave of absence when injured in. the line of duty, benefits to his_ - wife.and dependent children upon death, and all other benefits of the Classified Service of the Police Department in existence at that time, or hereafter provided, other than salary, on the same basisand with the same effect as if during such time he had remained in active service in.the Police Department and in the Classified Service thereof, and the rank which he held in the Classified Service when appointed. -2- Section 5. Chief of Palica. The Chief of Police may from time. to time assign members of the Classified Service holding the rank of Sergeant, Lieutenant or Captain to the Detective Division; each of whom shall perform such duties so long as his services are-satisfactary to.the..ChieF 0 Police-and he latter shall see fit to continue such assignment. Every officer so assigned shall receive, in lieu of his salary, the salary of-the next highest step during the period he is so assigned. Section 6. Present Employees. Allpersons presently holding positions as members of _ the Wheat Ridge Police Department under present ordinance provi- sions-shall retain their respective ranks and positions without - tests.-- No member of the Police Department, who was a member upon the date of the passage of this ordinance, shall thereafter be dismissed, except in accordance with the provisions of this ordinance and the rules provided hereunder by the Civil Service Commission. Section 7. Duties. It shall be the duty of the Police Force to _suppress all riots, disturbances and breaches.of thepeace and apprehend any and all persons in -the --act of committing any offense against the laws of the State or ofthe ordinances, and to forthwith bring such persons before the proper court or other competent authority for examination; and at all times, to diligently and faithfully enforce all_-such- laws, ordinances and regulations For the preservation.of good cider and the public welfare as-the City Council may enact. Every officer so authorized tomake arrests-or tn_serve process may, in the discharge of his duties, enter into all public places and, with or without-process, arrest any persons-upon probable cause that such persons have committed any crime or violated any City ordinance, and forthwith bring such persons before the proper court if said court be-then in session and, if not, then to convey such persons to the designated City Jail until such time as they can be broughtbefore said court, then to deliver them up for trial and examination. Section 8.Police-Department - Service Requirements - Disciplinary Procedures - Salaries. The service requirements, disciplinary procedures, and methods of establishing salary scales for members of the Classified Service shall be as outlined hereafter. Section 9. Grades of Policemen Probationary Appoint- ment. Every original appointment in the Classified Service shall be for one (1) year at the end of which time, if the conduct and capacity of the person appointed has-been satisfactory, he shall be permanently appointed; otherwise, he shall be out of.the Service. Service during;_the period,.of probation fallowing an -3- original appointment shall be deemed active service in the Classified Service of the Departments and shall be included and counted in determining eligibility for advancement, promotion, retirement, Pension, increased -salary or compensation,based on length of service, and other benefits of the Classified Service. A member of the Police Department is, during the period of probation following original appointment, a member of such Department in the Classified Service -for_all purposes, except for tenure of the employment or position to which he has been so.appointed. Any member of the Departments, while serving during the probationary period, may be separated from the Service in the following manner: (a) During the first six (6) months after the data ❑f appointment, he shall be separated at any time by written notifica- tion of the Chief of Police, indicating the.date of separation, and with the approval of the Mayor. (b) During the second six (6) months of the probationary period, and prior to the-first anniversary date of appointment, separation shall be in the same manner as outlined-in paragraph (a) above; however, such action must be approved by the Civil Service Commission. During the period of probationary appointment, and follow- ing proper training as a_recruit-for a period not to exceed six (6) weeks, the person appointed shall be classified as a Patrolman 3rd Class. A Patrolman 2nd Class shall be one who has served for more than one (1) year but-less than two (2) years in the service of the department; a Patrolman 1st Class shall be one who has served for more than two (2) years, but less than three (3) years in the service_ of the department, and a Senior Patrolman shall be one who has served more then three (3). years in the service of the department. When the force in either department is reduced, the person last certified to such department for employment, shall be the first laid Off; and when the force in such department is increased; persons laid off shall be reinstated in the order of their original certification; and, for the purposes of determining tenume_.and longevity, all-time served, whether or not interrupted, shall be computed. Service gained under previous employment of present employees-by the Jefferson County Sheriff's Office shall count for credit as set Out above. Section 10. Armed Forces Servi_ce., Involuntary servics_in the Armed Forces of the United. States shall be deemed and considered active service in the Classified Service of the. Police Department, if performed by a member of such department and while a member thereof; provided that, after his discharge from such service,- he has been readmitted-to-active service-in said department within such time and under such conditions -4- as are, ormay be provided for, by the rules of the Civil Service. Commission. If any period of probation following an .original appointment is interrupted by such service and the appointee is thereafter readmitted - to active service, he-shall complete the remaining portion of such period of--probation before being perman- ently appointed or before such appointment is made permanent. Any Chief of Police,- who is also a member of the ClassifiedService of the Police Department; shall be entitled to the same service - provisions as hereinabove outlined. Section 11. Promotion. All ranks in the Classified Service of the Police De- partment above the grades of Senior Patrolman shall beFilled by promotion fromwithin the respective departments, under such services requirements.-and examination-praceduress'as shall hereafter be outlined by the Civil Service commission; provided that all such rules and regulations outlining-qualifications and service require- ments, for both applicants for original appointment and for promotion, must be promulgated without any reference to political or religious-opinions or affiliations, or race, creed Or color.. - - All promotions shall be made by appointing the first man on the . eligible list for.the position as certified by the Civil_S.ervice Commission.---The man so appointed shall complete a probationary period after appointment of six (6) months' duration, at the end of which period he shall either be permanently appointed tosaid grade or rank or demoted to his former position,-in accordance with the.following procedure: In the event an officer, having been duly certified and promoted, fails to satisfactorily_ perform the duties of - the position to which he was promoted, in the opinion of-the Chief of the depart- ment and the Mayor, upon the expiration of _a six (6) month-probation- ary period-fallbwing this promotion, the Chief of the Department shall prepare a written order of demotion, filing the original with the Civil Service Commission and serving a copy on the affected officer.- She----_ order of demotion_shall_state as specifically as possible the -reasons. said officer did not satisfactorily perform his duties and shall be . approved -by -the -Mayor. Within five (5) days after receipt of an order of demotion, the Civil Service Commission shall approve or disapprove said. action, and the decision of the Commission in this matter shall be final. Section 12. Organizational Charts---,Creation of and Filling Vacant Positions- Elioible Lists. The Chief of the Department, with approval of the Mayor, shall annually, at budget time, supply City Council with an organi- zation chart setting-forth the number of positionsin the Classified. -5- 0 Service which will be necessary to perform the duties assigned to the department. The City Council shall, in accordance with authority vested in them, determine thereafter the number of positions to be allocated, based upon the budget available to said department. A position having been created, or One which shall have become vacant by the promotion, death, retirement, or discharge of tfr- holder.thereof, shall be filled within sixty (60) days from the eligible registerpf the Civil Service Commission - or said position sha11 be declared abolished for the remainder of the budget - year. Nothing in-this provision shall prevent City Council from creating new positions at any time, as the needs of the respective departments may require;"however, any new positions so created shallbe filled in accordance with Civil-:Service Commis- sion requirements and with the terms of this section. In the event the Civil-Service Commission doesnot have an eligible list for-certification to a vacated or newly created position, the sixty (60) day period within which said position.must be filled or abolished shall not begin to run until such list shall become available. All eligible, lists, for both original appointment and for promotion to positions in the Classified,S.ervice -of the depart- ment, shall expire after one (1) year, except, that in the event a vacancy should exist.in the department and the eligible list for that position is scheduled toexpire under the one (1) year limita- tion., the Civil Service Commission may extend such list for a period not to exceed ninety (90) days. Section 13. Disciplinary Procedure. The rules-.governing the conductof the members of the Classified Service in the Police Department shall be set forth as written_rulas and regulations by the Chief of the department, with the approval of the Mayor; provided, however, that such rules and regulations shall not contain any political, religious,- race or creed qualifications or disqualifica- tions. Any member of the Classified Service shall be subject to discharge, reduction in grade, fine and suspension for a violation of such rules and regulations, in accordance with procedure here- after-set forth. The Chief of the Police Department shall have the power and authority to suspend any - member of the Classified Service for a period of time no longer than ten (10) consecutive days (but in no event may the period of suspension result in a loss of more than one-third (113) of a month's salary to the officer suspended) wherever such suspension shall he in accordance with the internal rules and regulations of.the department. The procedure for the discharge, reduction in grade, or fine and suspension of any member of the Classified Service, for more than ten (10)days without pay, shall be as follows: -6- 4b The Chief of Police shall, within his command, initiate disciplinary action by written command ordering the specific - disciplinary action, which written command shall be submitted to the Mayor, for approval, together with a written specification of charges and a written report setting forth, in summarythe evidence and reason for such charges, which written report shall include a summary of the disciplinary record of the person -charged, and which written report shall-also include a showing that the member of the Classified Service-affected.thereby_ was-advised oF the intention to initiate disciplinary action and that such Classified Service member was given an opportunity to make-a_ statement after the charges against him were read and explained, and any statement which said membershall choose to make shall be included in, and made a part of, the report submitted to the Mayor for approval. The Mayor, with reasonable dispatch but, in any event, within five (5) days, shall approve, modify or disapprove the written order of disciplinary action. The Mayor shall take_ such-action by a written order which shall takeeffect immediately at the.time of-his signing. A Departmental Order of Discplinary Action, after approval as outlined above by the Mayor, shall be subject to review by the Civil Service Commission, in accordance with the provisionhereinafter set forth in this Amendment. A copy of the Departmental Order of Disciplinary Action shall be served on the person affected thereby. If personal service of the-said charges cannot be mBd-e within-five (5) days because of inability to_ldcate said person with the City of-- Wheat Ridge, the copy of the said charges shall_be_mailed by certi- fied mail, return receipt requested, to the last known address of said person as shown by the records of his department. Said service shall be complete upon return _of _the mailing receipt whether accepted or not. Within ten (10) days from the date of service of _-a depart- mental disciplinary order the member of the Classified__Service.against whom said order has been issued may file, with the Civil Service Commission, a written complaint requesting a review of--the said order. Such complaint shall contain the name and addressof the complainant, a description of the order complained of, and a brief summary of the, claimant's objections to the departmental order. A copy of the complaint shall be filed in the office of the Mayor on the same day that it is filed with the_Civil-Service Commission. The Mayor and the Chief-of the department shall, within five (5) calendar days _from- the date of receipt of a copy ofsuch complaint, transmit to the- office-of the Civil Service-Commission a complete copy of the specification of charges and the written report in support thereof, and any written answer and/or affidavits_ which may have been filed by the person affected. These documents shall constitute a part of the record of the proceedings before the CivilService Commission. Upon receipt of thesaid documents from_.the..Mayar_and the Chief.of, the.Police Department, the Civil ServiceCommission shall seta-hearing which -7 shall be held not less than ten (10) days nor more than thirty (30) days from the date said report is received. The Civil Service Commission shall specify whether or not the hearing will he public. After the date has been set, as herein-provided, it may only be continued upon agreement of all parties and approval of the Civil Service Commission. No con- tinuance shall be granted over the objection of one of the parties, ex- cept in the'case of a dire emergency. However, the agreement to a continuance requested by the complainant shall not be unreasonably with- held by the Department if it appears apparent that the complainant needs the time requested to properly present his case. At such hearing before the Civil Service Commission, the complainant, in person or by counsel, may offer evidence in support of the objections contained in his com- plaint. The Mayor and Chief of the Police Department, through the Office of the City Attorney as counsel, shall offer evidence and just- ification of the departmental action. The hearing shall be stenograph- ically reported and a full record made., The Civil Service Commission shall, by its rules, provide that a hearing may be conducted by two (2) or more-members of the Commission. In reviewing the disciplinary action, the Civil Service Commission shall give due weight to the necessity for maintaining administrative control of the police depart- ment by the Chief of said department. The Commission shall view the full record before it and shall make written findings affirming, reversing or modifying disciplinary action, in whole or in part 0 The decision of the Commission-shall be concurred in by a majority of its members, who shall-reduce it to writing and mail a copy to the Mayor, to the Chief of the Police Department, and to the Complainant. Either the-member of the Classified Service affected, or the Mayor, may seek a judicial review of the findings and decision of the Civil Service Commission by certiorari in accordance with the Colorado Rules of Civil Procedure than in effect. Allsuch actions for a review of the finding and the decision of the Civil Service Commission shall to brought within twenty (20) days of the decision of-the Civil Service Commission, and if such action is not brought within such time it shall be forever barred.- Judicial review proceedings hereunder shall not be further than to determine if the Civil Service Commission has exceeded its jurisdiction or abused its discretion under the provisions of this ordinance and the Statutes of the State of Colorado. The Chief of the police department shall have the power and authority to suspend any member of the Classified_Servics pending an investigation and the initiation of disciplinary action, provided that a specification of charges as heretofore set out, must be filed with the Mayor, or such suspension must.be terminated within ten (10) days. Where a specification of charges is filed in accordance with provisions hereto- fore set forth, and-before the. expiration of ten (10) days, such suspension shall remain in effect pending final disposition of the charges, including the final disposition of any appeal of the departmental disciplinary order. -8- Indictment of a member of the Classified Service, or the filing of an Information against him by a District Attorney, charging any :f6loriyor other crime involving moral turpitude, shall be cause for indefinite suspension without pay upon order of-the Chief of the Department, provided that such suspension shall-be terminated by restor- ation to the service or by discharge as soon as the decision of the court becomes final. If the member ofthe Classified Service is restored to his position, he shall receive full pay for the entire period of such suspension and his eligibility for other benefits of the Service shall not be deemed to have been interrupted by such suspension. The conviction of a member of the Classified Service, for a felony or other crime involving moral turpitude, shall be grounds for discharge. The refusal of any member of the Classified Service to testify before a grand jury or in any proceeding, or his refusal to make a full and complete disclosure to any court of competent jurisdiction, superior officer, or other body, officer or agency having a legally competent interest therin pertaining to the performance of his official duties, or pertaining to the commission, or omission of any act which might be in conflict with his duties and obligations as a member of the Classified Service and an officer of the City of Wheat Ridge, or the claiming by any member of the Classified Service of the right to refuse to testify or to make-a full disclosure as herein provided, on the basis that his testimony or statement might tend to incriminate him shall Constitute grounds for discharge from the Classified Service. -9- Section 14. Salaries. The salaries for the members of the Classified Service shall be established by the City Council by Ordinance. For the purposes of this Ordinance, the salaries of the respective ranks and grades of the positions in the Classified Service of each department shall be the same as are presently provided by Ordinance, upon the date of passage of this Ordinance. The City Council shall thereafter, annually, at budget time, review the pay scales of the grades and ranks of the Classified Service and shall, at all times, endeavorto maintain the pay scales, including fringe.benefits, equal to generally prevailing -salary scales for similar work. Section 15. Civil Service Commission - Members - How Appointed - Duties - Powers. There is hereby created a Civil Service Commission composed of three (3) members who.shall serve six (6) year over- lapping terms, and who will be charged with the responsibility of administering the Civil Service system hereby created and covering the members of the Classified Service of the Police Department of the City of Wheat Ridge. The Commissioners shall be residents of the qualified electors in-the City of Wheat Ridge prior to their. appointment as Commissioners, and should they cease to be a resident and elector of the City of Wheat Ridge, they shall resign as Commissioner and their successor shall be appointed as hereafter provided. Section 16. How Appointed - By Whom. Within thirty (30) days after the passage of-this Ordin- ance, three (3) Commissioners shall be appointed - one by the Mayor and two by the City Council. The appointee designated by the Mayor shall serve for a period of two (2) years. One appointee designated by the City Council shall serve for a period of four (4) years. The other appointee designated by the City Council shall serve for a period of six (6) years.' Upon the expiration of the first term herein provided, all appointments shall be for a six (6) year period. Thereafter, the successors of the members so appointed shall be selected and appointed by a majority vote of the full City Council. No member of the Civil Service Commission may hold any other position in the City of Wheat Ridge for which he receives either per diem or salary compensation and this provision may not be circumvented by a waiverof any such compensation, nor may he be an appointive member of any other board or Commission serving the City of Wheat Ridge. Each member of the Civil Service Commission shall serve without pay. The Mayor with - 10 - p.G~p # yG oE~.T. f F approval of-City Council, may remove any Commissioner-appointed under this Act For incompetency, inefficiency, neglect, or viola- tion of the provisions of this-Act,-or the rulesand regulations in force hereafter, or-any of them, or for any other cause which renders him unfit for the position, after first specifying in writing-the particulars of the incompetency, inefficiency, neglect of duty or violation or any other cause_chargsd, and after giving said-Commis- sioner an_apportunity to_make_a personal explanation and be heard in self-defense. Section 17. Duties - Powers. The Civil Service Commission shall be responsible far examination and certification of all applicants to positions in the Classified Service of.the Police Department. They shall determine qualifications for, and examine for promotion within the Classified Service of the Police Department. Promotions in the Classified Service shall -be from-within-the respective departments and those eligible for taking a promotional examination must be members of the Classified. Service of the-rank or grade immediately below the rank or grade for which they are being_examined, except for the rank of Sergeant and Detective onthe Police Department, for which position Senior Patrolmen with the proper length of service in grade shall be eligible, unless it shall be determined by the Civil Service Commission that-there are no qualified members within the Classified Service to take such promotional examinations. In such an event, the Civil Service Commission may undertake either open recruitment or designate additional ranks or grades _wha may be eligible for that particular examination only. -All .examinations- for promotion shall be competitive among such members of each department as are qualified and desire to submit themselves to examination. The Commission shall submit to the appointing author- ity the list with the names of all members who have satisfactorily passed the_entire examination., in-the order in which their grades placed them, and the appointing autocity, after having received a list..duly certified, shall make promotions therefrom in the order in which. they appear.- The method of examining, the rules governing the same, and the method of certifying I may be the same, as near as possible, as provided for applicants for original appoint- ments. The Council shall furnish the Commission with suitable offices, office furniture, examination roams, books, stationery, blanks, and all other necessary supplies and provide for the pay- ment of the same as may be necessary in carrying out the provisions of this ordinance. The Commission shall be provided with sufficient funds to hire a Commission Secretary who will also be the chief examiner for the Commission and will serve at the Commission's pleasure and perform such dutes as they shall, from time to time, assign him. Such other employees as shall be approved by Council, -11- and shall be needed by the Commission from time to time, may be provided, and any such employees shall serve at the pleasure of the Commission. The Commission shall have the power to make and enforce rules for the purposes of carrying out the provisions of this ordinance, which rules shall be printed for distribution and a copy provided for each person having the right to employ any person in the Classified Service. The Commission shall have the power to investigate all breaches of this ordinance and to conduct hearings in disciplinary matters as herein provided and while conducting such an investigation or hearing the Commission shall have the authority to compel the attendance of witnesses and the production of books and papers. The Civil Service Commission, with approval of the Mayor, may make use of existing City facilities and, as circumstances might dictate, temporarily use other City employees to aid and assist the Commission Secretary and Examinder in performing his duties. Section 18. Severabil.ity Clause. If any clause, sentence, paragraph or part of this ordinance or the application thereof to any persons or circum- stances shall for any reason, be adjudged by a Court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance, or its application to other persons or circumstances. Any provision of the City of Wheat Ridge in conflict herewith, or any part hereof, shall be and the same is hereby repealed. Section 19. Authority to Pass Ordinance. This Ordinance is passed by City Council under authority of Chapter 139, Article 47 of the Colorado Revised Statues of 1963, as amended, and under the provisions of this Article, the Council hereby states it intends to adopt a system that is compatible with the present duly formed and organized police department that presently carries out its duties within the City. Section 20. Mandatory Section. As required by 139-4-5 CRS 1963 as amended thefollowing sections are hereby adopted: (1) No person holding an office or place in the police department placed by the legislative body under civil service system, pursuant to the provisions of this article, shall seek or accept election, nomination or appointment as an officer of a political club or organization, or take an active part in a county or munici- pal political campaign, or serve as a member of a committee of such club, organization or circle or seek signatures to any petition provided for by any law, or act as a worker at the polls, or distribute badges or pamphlets, dodgers or handbills of any kind -12- favoring or opposing any candidate for election, or for nomination to a public office, whether county or municipal, Nothing in this article shall be construed to prevent any such officer or employees from becoming or continuing to be a member of a political club or organization, or from attendance at a political meeting, or from enjoying entire freedom from all interference in casting his vote. (2) Any willful violation of this section or violation through culpable negligence, shall be sufficient grounds to authorize the discharge of any police department employee. Section 21. Effective Data- This ordinance shall become effective thirty (30) days after publication following final reading.
