TITLE: AN ORDINANCE PROVIDING FOR THE COVERAGE OF CERTAIN EMPLOYEES
AND OFFICERS OF THE CITY OF WHEAT RIDGE UNDER THE FEDERAL OLD-AGE,
SURVIVORS DISABILITY, AND HEALTH INSURANCE SYSTEM PURSUANT TO
SECTION 218 OF TITLE 11 OF THE SOCIAL SECURITY ACT AND COLORADO 1951
SESSION LAWS, AS AMENDED.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
JEFFERSON COUNTY, COLORADO, THAT:
Section 1. AUTHORITY.
As the 38th General Assembly of the State of Colorado, in
regular session,_enacted Chapter 237, 1951 Session Laws, (now known
as CRS 111-7, 1963, as amended) to enable political subdivisions
of the State to voluntarily take all action necessary to effectuate
coverage of certain employees and officers under the Old-Age, Survivors,
Disability, and Health Insurance System pursuant to Section 218 of
Title 11 of the Social Security Act, as amended; and, as the Division of
Employment of the Colorado Department of Labor and Employment is the
designated authority to implement and administrate the State Public
Employees' Social Security program to provide for the coverage of certain
employees and officers under the said Old-Age, Survivors, Disability,
and Health Insurance.system; be it ordained by the City Council of the
City of Wheat Ridge that it is the considered opinion of this body that
the extension of the Social Security System to certain employees
and officers of the City of Wheat Ridge will be of great benefit, not
only to these employees of the City by providing that said certain em-
ployees and officers may participate in the Old-Age, Survivors, Disability,
and Health Insurance-System, but will also be of great benefit to the City
of Wheat;Ridge by enabling it to attract and retain in employment the
best of personnel and thus increase-the.efficiency of its government.
`The Mayor of the City of Wheat Ridge is hereby authorized to
execute and deliver to the Division of Employment of the Colorado
Department of Labor and Employment, a plan, or plans, and agreement,
required under Section 5 of said enabling Act and the Social Security
Act, to extend coverage to certain employees and officers of the City
of Wheat Ridge and do all other things to effectuate coverage of
certain employees and officers under the Old-Age, Survivors, Disability,
and Health Insurance System.

Section 2. PROCEDURE.
The City Treasurer is hereby authorized toestablish a
system of payroll deduction to be matched by payments by the City
of Wheat Ridge to be paid into the Contribution Fund of the State
through the Division of Employment of the Colorado Department of
Labor and Employment, and to make charges of this cost to the fund,
or funds, from which wage or salary payments are issued to employees
of the City of Wheat Ridge. Such payments are to be made in accor-
dance with the provisions of Sections 3101 and 3111 of the Federal
Insurance Contribution Act of 1954 on all services which constitute
employment within the meaning of that Act.- Payments made to the
Division of Employment of the Colorado Department of Labor and
Employment shall be due and payable as the Division may require,
and such payments which are delinquent shall bear interest at the
rate of six per cent per annum until such time as payments due are
made.
Section 3. APPROPRIATION.
Appropriation is hereby made from the General Fund of the
City of Wheat Ridge in the required amount to pay into the Contri-
bution Fund as provided in Section 5 (c) (1) of the enabling Act
and in accordance with the Plan, or Plans, and agreement.
Section 4. AGREEMENT.
Authority is hereby given to the Mayor and the Treasurer of
the City of Wheat Ridge to enter into an agreement with the Division
of Employment of the Colorado Department of Labor and Employment,
which agreement shall be in accordance with CRS-111-7, 1963, as
amended, and with Section 218 of Title 11 of the Social Security
Act. Such plan and agreement shall provide that the participation
of this City of Wheat Ridge shall be in effect 'as of October 1,-1969.
Section 5. SEVERABILITY CLAUSE.
If any clause, sentence, paragraph or part of this Ordinance
or the application thereof to any persons or circumstances shall
for any reason, be adjudged by a Court of competent jurisdiction
invalid, such judgment shall not affect, impair or invalidate the
remainder of this Ordinance, or its application to other persons or'
circumstances. Any provision of the City of Wheat Ridge in conflict
herewith, or any part hereof, shall be and the same is hereby repealed.
Section 6. EMERGENCY CLAUSE.
The provisions of this Ordinance are necessary for the
immediate preservation of the public health, safety, and welfare of
the City for the following reasons:
1. No previous Ordinance establishing the Old-Age, Survivors,
Disability and Health Insurance System as provided herein has been
adopted, the City having incorporated August 20, 1969.

2. An Ordinance establishing the Old-Age, Survivors,
Disability and Health Insurance System for designated City employees
is required.
Section 7. EFFECTIVE DATE. This Ordinance shell take effect
and be in force five (5) days after publication following final
passage, providing it shall have been passed by an affirmative vote
of three-fourths (3/4) of the members of the City-Council; otherwise,
said Ordinance shall take effect thirty (30) days after publication,
following final passage.
