AN ORDINANCE VACATING A CERTAIN PART OF A STREET LOCATED WITHIN THE CITY OF WHEAT RIDGE: I.E. VACATING A CERTAIN PORTION OF A STREET LYING IN PART OF THE EAST HALF (E 1/2) OF THE NORTHWEST QUARTER (NW 1/4) OF SECTION 22, TOWNSHIP 3 SOUTH, RANGE 69 WEST OF THE SIXTH (6TH) PRINCIPAL MERIDIAN. WHEREAS, by Plat of Hoyt Subdivision as recorded in Book 22 at Page 57 of the Jefferson County Records, a certafh street was dedicated to the public; and WHEREAS, that part of the following described street known as a cul-de-sac and lying within Tracts A and B, Hoyt Subdivision is no longer necessary for use by the public; and WHEREAS, said street is within the limits of the City of Wheat Ridge; and WHEREAS, no land would by a vacation of that part of said street known as a cul-de-sac and lying within Tracts A and B, Hoyt Subdivision would be left without an established public road connecting it with another established public road; and WHEREAS, the Wheat Ridge Planning Commission has approved the vacation of that part of said street known as a cul-de-sac and lying within Tracts A and B, Hoyt Subdivision. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. That part of the following described street known as a cul-de-sac and lying within Tracts A and B, Hoyt Subdivision in the City of Wheat Ridge, Colorado be vacated, to wit: Tracts A and B, Hoyt Subdivision as recorded in Plat Book 22 at Page 57 of the Jefferson County Records. And the same is hereby approved and that part of the described street known as a cul-de-sac and lying within Tracts A and B, Hoyt Sub- division is hereby vacated. 1.- 3 • RECEPTION NO. 87073693 • Section 2. Emergency Clause. The provisions of this ordinance are necessary to the immediate preservation of the public health and safety of the citizens of the City of Wheat Ridge for the following reasons: 1. No ordinance has been previously passed relating to the vacation of that part of this street known as a cul-de-sac and lying within Tracts A and B, Hoyt Subdivision because the City having just completed incorporation August 20, 1969, has not heretofore adopted any ordinances vacating this street. 2. An ordinance vacating that part of this street known as a cul-de-sac and lying within Tracts A and B, Hoyt Subdivision is necessary to allow the orderly development of this area. Section 3. Effective Date. This ordinance shall take effect and be in force five (5) days after publication following final passage providing it shall have been passed by an affirmative vote of three- fourths (3/4) of the members of the City Council; otherwise, said or- dinance shall take effect thirty (30) days after publication following final passage.
