AN ORDINANCE-TO PERMANENTLY.ESTABLISH.THE CITY.PARK AND RECREATION COMMISSION, SET FORTH THE DUTIES AND OBLIGATIONS OF THE COMMISSION, AND ADOPTING. BY REFERENCE THE CITY AND COUNTY OF DENVER, COLORADO DEPARTMENT OF`PARKS AND RECREATION CODE OF 1968, AS AMENDED AND PUBLISHED IN 1968, BY THE CITY-AND COUNTY OF DENVER, COLORADO. BE IT ORDAINEDBY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO THAT: Section 1. Organization. The Park and Recreation Commis- sion of the City of Wheat Ridge shall he made up of six (6) members, appointed by the City Council to serve without pay. They shall be appointed so as to provide equal representation for each geograph- ical section of the City as follows: Two .(2)_members-from Ward One, Two (2) members from Ward Two and Two (2) members from Ward Three. The first year-three (3) members shallbe appointed for a term of two (2) years and.-the other three_(3)_members shall he appointed for three._(3) years, thereafter-_each appointee shall serve a term of three (3) years. With the approval of City Council, members may be appointed to succeasiva terms. Section 2. Authority. The Mayor of the City ❑f Wheat Ridge does hereby authorize the Park and Recreation Commission to enforce theabove adopted code for the proper management, operation and control of the parks, parkways and other recreational facilities within the City of Wheat Ridge, Colorado. Section 3. Adoption. Persuant to Article 34 of Chapter 139, Colorado Revised-Statutes, 1963, as amended,-there is hereby adopted for the purpose of preserving and promoting the public peace and safety within the City of Wheat Ridge that certain primary code known as the City and County of Denver, Colorado, Department of Parks and Recreation Code of 1968, as amended, of which three (3)_ copies of the primary code are filed in the office of the City Clerk of the City of Wheat Ridge, and may be inspected during the regular business hours, the same being adopted as if set out at length save and accept the following_amendments and exclusions: Code Section 1 is hereby excluded and not adopted by reference as-part of the City Park. and Recreation y Code. Code Section 2 is amended to read as follow_s:, Rules and Regulations - General City Parks and Recreation City of Wheat Ridge, Colorado. The following rules and regulations alphabetically. - Paragraphs 1, 3, 4, 10, 36, 43, 77, 81, 831 84; and 103 of Code hereby excluded and not adopted of the City Park and Recreation are presented 60, 67, 72-7 73, Section 2-are by reference as-part Code. Paragraph 2 of Code Section 2 is amended to read: Public address or other amplification devises may be used only by special permit obtainable from the Mayor's office or his authorized representative. Paragraph 5 of CodeSection 2 is amended to read as - follows: Alcoholic Beverages: It shall be unlawful to sell or-,give away, and unlawful to consume; intoxicating liquor -of any kind within the parks or recreation areas,-except where per- mitted-by consession agreement. Paragraph 6 of Code Section 2 -is hereby amended to read as follows: Animals:- Animals not_properly attended in any park or ecreation area are subject to impound- ment. Paragraph -8 of Code Section 2 is hereby amended to read as follows: Archery: Archery shall be permitted only as spec- ified areas with written permission of the Parks Commission. Paragraph 12 of Code Section 2 ishereby amended to read as follows: Beer: Beer or Malt beverages shall not be stored or consumed onany athletic, fields or playgrounds. Paragraph 13 of Code Section 2 is hereby amended to read as follows: Begging and Soliciting: It shall be unlawful",to beg or solicit within any park or recreational area. Paragraph 16 of Code Section 2 is amended to read as follows: Campers: Campersshall not be permitted overnight except with written permission of the Parks Commission. Paragraph 17 of Code Section 2 is hereby amended to read as 'follows: Camping: Camping shall not be permitted except with written permissionof the Parks Commission. -2- - Paragraph 23 of Code Section is hereby amended to read as follows: Dances: Dances shall not be permitted except with r written permission from the ParK and Recreation Commission. Paragraph 32 of Code Sect2an 2 is hereby amended to read as follows The Parks Commission prescribes the State Game, Fish and Parks Department rules, and a state fishing license shall be required. Paragraph 45 of Code Section 2 is hereby amended to read as follows: Hours: Hours of the parks shall normally be open daily from 5:00 a~m.,to 11:0➢ p:m:; and normally-be-cidsed from =11:00 p.m. to 5:00 a.m. Exceptions are for closure, in case of an emer- gency, by_the_Mayor or Parks Commission. Var- iation in_hours=are-allowed by permit from the Mayor or the Parks Commission. Any park, or section_of,any park, parkway, or recreational facility may be declared closed to the public by the Mayor or_ Parks Commission. Any park, or section of any park,-parkway, or recreational facility may be declared closed to the public by the Mayor or Parks,Commission at any time and for any interval of time, whether temporar- ily or at a regular and stated interval(s) as - shall be-reasonably recessaryc Paragraph 54 of Code Section 2 is.hereby.,amended to read as follows, Meetings in-Parks: Sponsors of public meetings of more than twenty-five (25) people must apply"for and receive.a permit.. Meetings must be orderly and.-law-abiding. Authorized meetings will have on hand a signed permit by the Mayor, or Parks Commission. -Applications areMade to the Mayor or Parks Commission in writing, and specific in- formation is..required. Exception: Permits are not generally written for picnics or department programs'. Paragraph 56 of Code Section 2 is hereby amended to read as follows: Model Boats: Electric, gas or sail powered model boating is permitted only in"spedified areas aff- designated by the Parks Commission. Paragraph 63 of Code Section 2 is hereby amended to read - as follows: Parades: Parades within the City's parks and recreatioT7a1 facil_itias;shall be permitted-with a written permit acquired from the Mayor 6r Parks Commission. -3- Paragraph 74 of Code Section 2 is hereby amended to read as follows: Selling: Selling Of-refreshments or other items is prohibited except by concession agreement. This limitation applies to street or sidewalk sells within three hundred feet (3001) outside any park or recreation area boundary. Approved uenders will be in building locations or will carry a Parks Commission permit indicating area_ of operation. Paragraph 76 of Code Section 2 is hereby amended to read as follows: _ Useof Parks: The general rule of first-came, first-served will govern in use of the parks. Roping, blocking off, or in any way restricting access to any park area is not permitted, except by permission of the Mayor or Parks Commission. Paragraph 86 of Code Section 2 ia.hereby amended to read as follows: Snowmobiles: Snowmobiles shall be prohibited in all parks and recreation areas. Paragraph 105 of Code Section 2 is hereby amended to read as follows: Boating, Swimming, Ice-skating-arid Ice-fishing: No boating, swimming, ice-skating, ice-fishing or other use-of any water body supervised by the Parks Commission is.permitted unlessthe specific= area to be used is so posted or public announce- - ment has been made by the Mayor or the Parks Com- mission. When such. areas are open for use, they are subject tospecial rules on program and safety. Code Section 3 is hereby excluded and not adopted by ref- erence Be part of the City Parks and Recreation Code. Code Section 4 is hereby'excludsd andnot adopted by ref- erence as part of the City Parks and Recreation Code. Code Section 5_is`hereby excluded and not adopted by ref- erence as part'of the City Parks and Recreation-Code. Code Section 6 is.amended__to read as follows.:_. Rules and Regulations for Ice-skating: _Ice-skating areas are announced only in season when safe cond tions exist -=Public announcement will be made at these times, otherwise all areas are closed to ice-skating. In addition, the Parks Commission shall enforce the following rules: 1. No sleds, skis, or other sliding or wheeled. vehicles-shall be permitted on ice. 2. No chain, whip, train, high speed or erratic tag games shall be permitted on the ice. -4- QE'.G~ ~ s-s • 3. ace=Ytickey shall be permitted only in specified areas, only in daylight, with adult supervision. 4. All designated areaa, signs and safety barriers will be observed and followed. Code Section 7 is hereby amended to read as follows:-- HLIl Buildings: 1 The Supervisor in-charge of recreation- centers, the Center Director and Recreation Leader shall be agents of the Parks Commission and shall enforce all department rules and regulations.- 2. The Parks Commission_may restrict the.. hours, days-and weeks of use forany center. The Parks Commission may_.restrict any user,_individual or group for violation of rules and regulations. 3. Certain public usage, -other than planned program by recreation personnel, is permitted by application to.and receipt of permission from the Parks Commission. Code Section -8 is hereby amended to read as follows: Rules and Regulations for Square Dancing and Folk Dancing: 1. Reserved use of dance areas for department sponsored programs will be-available by permission of the Parks Commission. 2. Permission for any dance activity will-- include presence of duly authorized personnel. 3. Rules particular or necessary to any, particular site or situation..shall be either posted or in the hands of the Parks Commission. Code Section 9 is hereby amended to read as follows: Rules and Regulations for Swimming 1. The supervisor-in charge of swimming; the pool manager, the head lifeguard and the park foreman shall be agents of the Parks Com- mission'and the. Mayor and shall enforce all department' rules and regulations pertaining to swimming. Copies of-these rules and regulations will be-posted or on file at every approved swimming pool. 2. Fees are established by ordinance and each user shall secure a ticket before entering the swimming area. The wading pools are not considered swimming areas. 3. The Parks Commission or other agents of the Mayor may restrict a swimmer or swimmers from all municipal pools for a specified time for flagrant or_ repeated violation of rules and regulations. Code Section 12 is hereby amended to read as follows:' ~~H Rorni]Rtions for Baseball, Softball, Soccer, Fcotball_ Touch-football and La-crosse: 1. Agents of the Mayor 'shall enforce all rulesand regulations pertaining to the above named activities. Copies of these rules and regulations are on file with the City Clerk of the City of Wheat Ridge. -5- t • 2. Agents of the Mayor shall issue permits to protect league competition and team practice. All teams or individuals.shall relinquish the play area to the permittee during the designated date and time on the permit. 3. The agents of the Mayor may restrict a player, players, teams and leagues from all _ publicfields for a specified time for flagrant or repeated violations of the,rules_and regulations. 4. The-authorized-representatives or agents of the Mayor may._close any or-all public fields or play areas when due to weather or any other con- dition, the use of such fieldswill create-main- tenance problems: Section 13. Penalties for Violation- The following penalties, herewith set:-forth in-full, shall apply to the provisions of the City Parks and Recreation Code herein adopted: A. It is unlawful for any person to.violate any of the provisions of the City Parks and Recreation Code and any such violation shall be punished as is herein after provided. B. Every person convicted of a violation of any provision of this ordinance shall be punished by a fine not ex- ceeding,thres hundred dollars ($300.00),. or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment. Section 14._- Application of Ordinance This ordinance shall apply throughout the municipality of Wheat Ridge. v, Section 15. Effect of Ordinance. If any part or parts of this ordinance are for any. reason held to be invalid or uncon- stitutional, such decisions shall not affect the validity or con- stitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance in each part or parts thereof, irrespective of the fact, that any one part or parts be declared invalid or unconstitutional. Section 16. Short Title. This ordinance may be known and cited as the City Parks and Recreation Code. Section 17. Emergency Clause. The provisions of this_-., ordinance are necessary.to-the immediate preservation of the public health and safety of the citizens of Wheat Ridge for the following reasons: 1. No previous ordinance gooerning parks and re- creation areas, has been written because the City having just com- pleted incorporation August 2D, 1969; has not heretofore passed an ordinance relating to parks and recreation areas. 2.. Ordinances governing parks and recreation areas are necessary to preserve the public health and safety of the City of Wheat Ridge. Section 18. Effective Date. This ordinance shall take effect and be in force five (5) days after publication following final passage providing it shall have been passed by an affirmative vote of.three fourths (3/4) of the members of the City Council, otherwise, said ordinance shall take effect thirty (30) days after -6- publication following final passage.
