TITLE: AN ORDINANCE AMENDING SECTIONS 1 - 2, SECTION 2, SECTION
4-- 2, SECTION 4 - 9, SECTION 5 - 1, SECTION 5 - 2, SECTION 5 - 39
SECTION 5 - 4, SECTION 5 - 5, SECTION 5 - 6, SECTION 5 - 12, AND
SECTION 6 - 4, AND ADDING SECTION 5 - 18 AND SECTION 5 - 19, ORDIN-
ANCE 46, SERIES OF 1970, RELATING TO: INCLUDING CIVIL SERVICE AND
DIRECTORATE PERSONNEL UNDER SPECIFIED PROVISIONS OF ORDINANCE 46,
SERIES OF 1970; ADDING DEFINITIONS; ELIMINATING TEMPORARY MERIT
STEPS; PROVIDING FOR SUPERIOR PERFORMANCE AWARDS; CHANGING OF AUTH-
ORIZED HOLIDAYS; PROVIDING FOR SPECIAL EMPLOYEES; PROVIDING FOR DE-
FINITION OF WORKDAYS IN HOURS; CLARIFYING EMERGENCY, EDUCATION AND
INJURY LEAVE; CLARIFYING INSURANCE RIGHTS; CLARIFYING POLITICAL
RIGHTS; PROVIDING EXTRA VACATION FOR SHIFT PERSONNEL: PROVIDING
FOR EDUCATIONAL REEMBURSEMENT AND DEFINING RIGHTS OF EMPLOYEES WHEN
THEY APPEAL.
Section 1. Purpose. Amendments and additions are hereby
adopted to include Civil Service and Directorate personnel under
specified provisions of Ordinance 46, Series of 1970; to add clarify-
ing definitions; to eliminate temporary merit step increases; to
allow sustained superior performance awards; to delete Colorado Day
and add Washington's birthday as a holiday; to designate and provide
pro-rata holiday, vacation and sick leave benefits for special em-
ployees; to provide accounting of work days by hours rather than
days; to clarify emergency leave, education leave, injury leave,
political and insurance rights; to grant two additional days vacation
leave for shift personnel; to add a section concerning appeals by
employees concerning suspension, dismissal or demotion and to add a
provision for reembursement of educational expenses.
Section 2. Persons Covered by Rules.
Add to Section 1 - 2, Ordinance 46, the following
sentence:
Benefits and rights for department heads shall
be included under the following designated portions
of Ordinance 46: Section 5 - 1 Holidays; Section
5 - 2 Vacation Leave: Section 5 - 3 Sick Leave:
Section 5 - 4 Emergency Leave: Section 5 - 5 Injury
Leave; Section 6 Obligations; and Section 8 Adminis-
trative. Hiring policies will follow merit principles,
with screening by the Personnel Committee.
Civil Service Personnel shall be granted benefits and rights under
the following designated portions of Ordinance 46:
Section 1 - 5 Classification Plan; Section 2
Definitions Cif not previously provided by Ordinance
40); Section 4 Pay Policy; Section 5 Employee Rights,

except those included in Section 5 - 14 and
Section 5 - 15; and Section 8 Administrative.
Section 3. Definitions.
The following definitions shall be added to Section
2, Ordinance 46:
Appeal: The right of an employee covered under
the Merit Rules to file with the Citizens Personnel
Committee an appeal from an action relating to sus-
pension, demotion, or dismissal. Ordinance 40 shall
continue to apply to Civil Service employees covered
by Ordinance 40.
Employee - Regular (Permanent): A full time em-
ployee who has been appointed.to a position in the
classified service in accordance with the Merit
System Rules and has successfullg_completed his
initial probationary period. Hourly and temporary
employees are not included in this category. Ordin-
ance 40 shall continue to apply to Civil Service
employees covered by Ordinance 40.
Employee - Special: An hourly employee who has
completed one year of steady City service on less
than a full-time basis and has consistently exceeded
20 hours per week for one year.
Employee - Temporary: Seasonal employees paid
at the established hourly rate for less than 20 hours
per week average or 1,040 hours per year.
Employee - Probationary: An individual in a
position who has been appointed from an eligible list,
but who has not yet completed his probationary period.
Complaints: A grievance, misunderstanding, or
disagreement between an employee and his employer,
the City of Wheat Ridge, arising out of a belief on
the part of the employee that he is being treated
unfairly in regard to the terms or conditions of
his employment. Ordinance 40 shall continue to
apply for Civil Service employees covered by Ordin-
ance 40.
Grade: The identifying number for a range of
pay rates established in the pay plan.
Probationary Period: A working test period of
no less than six months during which an employee is
required to demonstrate his fitness for the duties
to which he is.appointed by actual performance of
the duties of the position. Ordinance 40 shall con-
tinue to apply to Civil Service employees covered by
Ordinance 40.
Step: A single rate of pay within a pay grade.
Vacancy: An authorized position which is not
occupied and for which funds have been provided and
are available.

Work Week: The total Of scheduled work days
in a seven day period as determined by departmental
rules and regulations. Work week is 40 hours.
Section 4. Merit Salary Increases.
The following sentence shall be deleted from Section
4 - 2, Ordinance 46:
"When an employee is temporarily assigned to a
position having a grade classification higher than
the grade he holds, a temporary one-step increase
in the employee's own grade may be authorized if
recommended by his supervisors".
Section 5. Total Pay.
The following sentence shall be added to Section
4 - 9, Ordinance 46:
"The City may make awards for sustained superior
performance."
Section 6. Holidays.
The second sentence from Section 5 - 1, Ordinance
46, shall be deleted as follows:
"They shall be granted with pay to all employees:
New Year's Day
Memorial Day
Independence Day
Colorado Day
Labor Day
Thanksgiving Day
Veteran's Day
Christmas Day"
In place of the above deleted sentence the following
sentence shall be added:
"They shall be granted with pay to probational
or regular employees:
New Year's Day
Washington's Birthday
Memorial Day
Independence Day
Labor Day
Thanksgiving Day
Veteran's Day
Christmas Day"
The following sentence shall be added to Section 6:
"Special employees will be allowed a pro-rata
number of hours pay for each approved holiday based
on their average workday. Departments which do not
close on these holidays will give the holidays off

at the mnienience- of the .Department."
The first sentenced third paragraph of Section 5-1,
Ordinance 46, shall be deleted as follows:
"The Court must also be closed on Lincoln's Birthday,
February 12; Washington's Birthday, February 22; Columbus Day,
October 12; and Election Days."
In place of the above deleted sentence the following
sentence shall be added:
"The Court shall also be closed on General Election
Days, Lincoln's Birthday (February 12); Columbus Day (2nd Monday of
October); and Colorado Day (1st Monday of August)."
Section 7. -Vacation Leave.
The following paragraph shall be added as the second
paragraph of Section 5-2, Ordinance 46:
"One day, for purposes of this section is defined as
eight hours. Personnel assigned regularly to shift duty shall -be
given two additional days (16 hours) of leave each year in addition
to their regular vacation leave. Special employees will begranted
a pro-rata number of-hours annual vacation leave as authorized regular
employees, based on theiraverage workday."
Section 8. Sick Leave.
The following shall be added as the second paragraph
of Section 5-3, Ordinance 46:
Delete Section 8, Sick Leave, Ordinance 102 as passed -
on first reading as follows;
"For purposes of this section one day is 8 hours and -
sick leave records will be maintained as hours. Sepcial employees
will be allowed a pro-rata share of the leave granted regular employees,
based on their average workday."
Delete the last sentence of Ordinance 46, Section 5-3,-
Sick Leave as fbllows:
"No payment will be made for unused sick.leave."
The following sentences shall be added as Section 8,
Ordinance 102:
"Accumulations Over 60 days willbe paid at the rate
of one full day (8 hours) for each two days (16 hours) Of-unused
sick leave. No conversion will be made for unused sick leave under
60 days (480 hours). For purposes of this section one day is 8 hours
and leave records will be maintained as hours. --Sepcial employees
will be allowed a pro-rata share of the leave granted regular.emplOyees,
based on their average workday."
Section 9. Emergency Leave.
The following phrase shall be-added to Section 5-4,
Ordinance 46:

"Only regular and probational employees qualify
under this section."
Section 10. Injury'Leave.
The following phrase shall be added to the first
sentence of Section 5-5, Ordinance 46:
"Pending a determination of pension rights, if
applicable. Sepcial employees will be allowed a pro-rata numberof
hours pay based on their average workday."
Section 11. Education Leave.
The following sentence shall be added to Section 5-6.
Ordinance 46:
"Only regular full time employees qualify under this
section."

Section 13. Appeals.
The following subsection shall be added to Section
5-15, Ordinance 46, paragraph D:
"The employee shall be assured freedom from restraint,
interference, coercion, discrimination, or reprisal in presenting his
appeal."
Section 14. Employee Rights.
The following phrase shall be added to Subsection 6-4C:
"Unless prohibited by Federal Law."
Section 15. Education Reimbursement.
The following paragraph shall be added to Section 5,
Ordinance 46:
115-16 When budgeted the City will reimburse regular -
employees for tuition up to $200 per year when accredited courses
approved in advance by the department head for job related courses -
are taken providing a grade of "C" or better is attained and providing
that the training is not otherwise subsidized.- If training is subsidized
paragraph 4-3, Ordinance 46, does not apply."
Section 16. Severability Clause.
If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or-circumstances

shall for any reason-be adjudged by a court of competent jurisdiction
invalid, such judgement shall npt_affect, impair or.invalidate the
remainder of this ordinance or its application to other persons or
circumstances.
Section 17.:Effective Date.
The following sentence shall be deleted in Section 17,
Ordinance 102, as passed on first reading:
"This Ordinance shall become effective thirty (30)
days after publication following final reading."
The following sentence shall be added to Section 17,
Ordinance 102:
"This Ordinance shall take effect and be in force five
(5) days after publication following final passage providing that it
shall have been passed by an affirmative vote of three-fourths (3/4),
members of the City Council; otherwise, said Ordinance shall take
effect thirty (30) days after publication following-final passage."
