TITLE: AN ORDINANCE TO REPEAL ORDINANCE NO. 37 AND TO RE-ENACT AN ORDINANCE-
VACATING A CERTAIIV DESCRIBED STREET-.LYING IN THE SOUTHEAST ONE-QUARTER, SOUTH-
WEST ONE-QUARTER, SECTION 14, TOWNSHIP-3 SOUTH, RANGE 69 WEST OF THE 6th PRIN-
CIPAL MERIDAN IN ORDER TO CORRECT AN ERRONEOUS LEGAL DESCRIPTION CONTAINED-IN
ORDINANCE NO. 37.
WHEREAS, Ordinance No. 37 erroneously delineated certain streets for__va-.
cation purposes; and
WHEREAS, this Ordinance is enacted to repeal Ordinance No. 37; and
WHEREAS, the following described street is no longer necessary for use by
the public; and
WHEREAS, no land would be left without an established public road connect-
ing it with another- public road; and
WHEREAS, said street-is within the City of Wheat Ridge; and
WHEREAS=, the City of Wheat Ridge Planning Commission had recommended pre-
viously the vacation of said street.
BE IT ORDAINED-BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,-THAT:
Section 1: Ordinance No. 37 is hereby repealed.
Section 2: The following described street in the City of Wheat Ridge,- - ,
Colorado-,. be vacated, to wit:
That part of the SEI/4, SIT/ of Section 14, Township 3 South, Range 69
West, of the City of Wheat Ridge, County of Jefferson, State of
Colorado, described as follows:.
Beginning at the Southwest, corner of the SO/,+, SWJ!4 of Section 14, thence
North 00101 east a distance of 2..4 feet to a point, thence east and
parrallel to the south line ❑f Section 14 a distance of-10.,0 feet to a
point, thence north 0010' east parallel to the west line of the SEA/4,
SWY4 of.Se.ction 14 a distanceof 249.4 feet to a point on the southerly
right-of-way of Interstate Highway 70, thence south 72045' west along
southerly right-of-way a distance of 27.7.feet to a point 16.5 feet
west of the SE/A, SW1/4 of Section 14, thence south 00101 wast parallel
to west line of SEy4, SW/4 of S.ection 14 a distance F3f,243.7 feet to a
point on the south line of Section 14, thence east along south line
of Section 14 a distance of.lE.5 feet to the point of beginning.
And the same is hereby approved and the described street is hereby vaca-
ted; provided, however, said vacation shall be subject-to the following con_d_i _
tions and reservations:
There is reserved to the City of Wheat Ridge-and - to._utility owners__the
continued right to construct, operate, and maintain sewer, water, drainage,
power, telephone and gas lines-in--said vacated street.
Section 3: Effective Date:, This Ordinance. shall take effect and.ba in
force thirty (30) days after publication following final passage.
