ORDINANCE NO. 137
Series of 1973
TITLE: AN ORDINANCE ESTABLISHING THE POSITION OF CITY ADMINISTRATOR,
QUALIFICATIONS OF THE ADMINISTRATOR, AND THE DUTIES, FUNCTIONS AND
POWERS OF THE CITY ADMINISTRATOR.
Be it ordained by the City Council of the City of Wheat Ridge,
Jefferson County, Colorado that:
Section 1. Establishment of Position.
There is created and established the position of City
Administrator of the City of Wheat Ridge.
Section 2. Qualifications and Pav.
The City Administrator shall be selected by City Council
solely on the basis of his executive and administrative qualifica-
tions. If not a City resident at the time of appointment, he will
remove to the City and thereafter shall reside in the City during
his tenure. He shall be compensated for his services as Council may
from time to time determine.
Section 3. Power to Appoint and Remove.
Subject to and except as otherwise provided by law or
Ordinance, he shall have the power to appoint and remove all
officers, Directors, and Merit or Civil Service employees of the
City. Specifically excepted are elected officials and Council or
Commission appointees, including City Attorney, Municipal Judge,
City Treasurer, and City Clerk. He shall have t-ie power to dismiss,
suspend and discipline affected employees in accordance with Civil
Service Ordinance, Merit Ordinances or other policy.
Section 4. Functions and Duties.
The City Administrator shall have the following addi-
tional functions and duties:
(1) Td supervise the administration of the enforcement
❑f all laws and Ordinances of the City, save and except
to the extent that the administration of such enforce-
ment is confided to other City officials by law or
Ordinances;
(2) To be responsible to the City Council for the
administration of all departments of the City, save and
except those departments confided to the supervision of
other City officers by law or Ordinance; and to cooper-
ate with and supervise the administrative functions of

such departments to the extent requested or delegated
by the City officers having primary responsibility for
the operation of such departments;
(3) To issue such administrative regulations and
outline general administrative procedures applicable
to areas and departments confided to his supervision
in the form of rules which are not in conflict with
the laws of the state of Colorado or other City
Ordinances;
(4) To prepare an annual budget and to submit the
same to Council;
(5) In cooperation with the City Treasurer to keep
the Council fully informed as to the financial condi-
tion of the City;
(6) To recommend to Council for adoption such
measures as he may deem necessary or proper for the
efficient and proper operation of the City, and to
attend all City Council meetings;
(7) To prepare and submit to the Council an annual
report of the City's affairs, including a summary of
the reports of the operations of all City departments;
(8) Subject to the requirements of statutes and
Ordinances, and in accordance with rules and regula-
tions now or hereafter promulgated by City Council,
to purchase materials and authorize expenditures of
funds on behalf of the City;

(9) To perform such other duties as may be prescribed
by Ordinance or by direction of the City Council;
(10) To organize City departments, subject to
Council approval, in such a manner that maximum
efficiency and economy are achieved.
Section 5. Council-City Administrator Relationship.
The City Council shall deal with that portion of the
administrative service of the City for which the City Administrator
is responsible through the City Administrator. Directives issued
by the Council concerning policies or operations of the City Council
affecting the area of responsibility of the City Administrator in
the administration of any of these departments shall be made so as
to direct the City Administrator to accomplish the necessary orders.
Section 6. Severability Clause.
If any clause, sentence, paragraph, or part of this
Ordinance or the application thereof to any persons or circumstances

shall for any reason be adjudged by a Court of competent jurisdic-
tion invalid, such judgment shall not affect, impair or invalidate
the remainder of this Ordinance, or its application to other
persons or circumstances. Any provision of the City of Wheat Ridge
in conflict herewith, or any part hereof, shall be, and the same is
hereby repealed.
Section 7. Effective Date.
This Ordinance shall become effective thirty (30) days
after publication following final reading.

POSTED on first reading by a vote of 5 to 0 this 13th
day of September , A.D., 1973.
