ORDINANCE NO. 154
Series of 1974
TITLE: AN ORDINANCE REPEALING ORDINANCE 42, SERIES OF 1970, AND
ORDINANCE 62, SERIES OF 1970, AND PROVIDING FOR THE ORGANIZATION
AND OPERATION OF THE CITY IN ACCORDANCE WITH ORDINANCE 137, SERIFS
OF 1973.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. PURPOSE. The purpose of this Ordinance is to
repeal Ordinance 42 and Ordinance 62, Series of 1970, in their
entirety and to establish and clarify the organization and operation
of City departments and staff personnel to provide for an orderly
means of conducting the operations of the City government. It is
the intent and sense of the Council that cooperation and coordination
are required between all departments of the City and that such
coordination and cooperation can best be obtained by close liaison,
communication and cooperation between all departments, and coordination
with and through the City Administrator. All ordinances of the City
heretofore adopted, and the Ordinance herein shall be construed in
such manner as to foster and promote such cooperation, coordination,
and liaison of all departments with and through the office of the
City Administrator.
Section 2. ORGANIZATION PLAN. It is the purpose of this section
that the organizational plan of the City shall be substantially the
form illustrated by the attached schematic diagram entitled:
Functional Organization Chart, City of Wheat Ridge, April, 1974,
subject to such revisions as may be made from time to time by
Administrative Regulation issued by the City Administrator, and
confirmed by the City Council.
Section 3. POLICY
(a) Functions will be assigned by the City Administrator in
such a manner that maximum efficiency and economy are
achieved.
(b) Elected officials generally will perform those functions
designated by statute. The Mayor, as statutory Chief
Executive Officer, may delegate to the City Administrator
the authority to execute plans, policies and programs.
(c) Appointive statutory officers will be subject to the
administrative supervision of the City Administrator.
(d) Non-statutory officers of the City will serve at the
pleasure of the City Administrator.
(e) Except as otherwise provided by statute, all citizen
committees or commissions will be limited to advisory
functions.

(f) The normal chain of command will be from Section Chiefs
to Division Chiefs to Department Directors to the City
Administrator in accordance with the organization chart
incorporated herein. The City Administrator will keep
the Mayor, Council and other elected officials advised
on administrative matters.
Section 4. MAJOR FUNCTIONS OF ELECTED OFFICIALS INCLUDE:
4-1. MAYOR
4-1-1. Administration of the City except as delegated to the
City Administrator.
4-1-2. Presiding at City Council meetings.
4-1-3. Preserving law and order except as delegated to Chief of
Police.
4-1-4. Signing Ordinances, Resolutions or Contracts, Licenses,
and Permits granted by the authority of the City Council
and signing all Warrants drawn upon the City Treasury.
4-1-5. Issuance of proclamations.
4-1-6. Performing as ceremonial head of the City.
4-1-7. Causing Ordinances and Regulations to be obeyed.
4-1-8. Other duties as Council requests.
4-1-9. Serving as a member of the Police Pension Board of Trustees.
4-2. CITY CLERK
4-2-1. Maintaining a public file of all Ordinances and all Codes
adopted by reference and all official City records, Deeds
and Titles.
4-2-2. Along with the Mayor, certifying all City Ordinances within
forty-eight (48) hours and maintaining a book thereof.
4-2-3. Acting as custodian of the City Seal.
4-2-4. Publication of Ordinances and legal notices, keeping
citizens informed on Council actions, and attesting to
publication and posting.
4-2-5. Conducting City elections.
4-2-6. As Clerk of Council, maintaining a regular and correct
journal of the proceedings of the Council.
4-2-7. Acting as Deputy County Clerk for voter registration only.
4-2-8. Posting of the annual Treasurer's Report.
4-2-9. Signing all City Warrants.
4-2-10. Collecting fees for attesting certificates and transcripts
and posting a schedule of fees thereof and depositing said
fees with City Treasurer.
4-2-11. Issuing licenses and permits as assigned.
4-2-12. Preparing and distributing Council agendas and minutes.

4-2-13. Clerical support of citizen advisory committees.
4-2-14. Serving as a member of the Police Pension Board of Trustees.
4-2-15. Acting as registrar for the Selective Service System of the
United States.
4-3. CITY TREASURER
4-3-1. Providing a performance and surety bond acceptable to
the City Council.
4-3-2. Receiving and accounting for all City monies as prescribed
by Statute and City Ordinance, and providing receipts for
all money received.
4-3-3. Provide for the recording of all assets, liabilities,
reserves, and fund balances, in addition to the prescribed
revenue and expenditure accounts.
4-3-4. Establish and maintain those funds consistent with legal
and operating requirements.
4-3-5. Providing periodic financial statements and reports to the
City Council showing the current condition of budgetary
and proprietary accounts.
4-3-6. Provide a comprehensive annual financial report covering
all funds and financial operations of the City and filing
such report as prescribed by Statute.
4-3-7. Provide for the proper and timely payment of all financial
obligations of the City, including all wages due employees,
and the maintenance of a register of all warrants and
disbursements.
4-3-8. Providing financial advice to the City Council in matters
regarding investments of City funds.
4-3-9. Filing with the City Clerk all paid warrants and financial
records as prescribed by Statute.
4-3-10 Serving as member and Treasurer of the Police Pension Board
of Trustees.
4-3-11. Issuance of City Sales Tax licenses.
4-3-12. Preparing and submitting annual Treasurer's budget.
Section 5. MAJOR FUNCTIONS OF STATUTORY OFFICERS REPORTING
DIRECTLY TO MAYOR AND COUNCIL INCLUDE:
5-1. MUNICIPAL JUDGE
5-1-1. Maintaining and executing traffic and criminal court
calendars and administering justice.
5-1-2. Maintaining records of bail bonds received and exonerations.
5-1-3. Selecting jury venires when required.
5-1-4. Preparing and submitting the annual Court Budget.
5-1-5. Collecting, counting, balancing and depositing of court
fines and preparing financial reports.
5-1-6. Execution of prescribed legal documents and forms.
5-1-7. Keeping the City Administrator advised concerning admin-
istrative matters affecting Municipal Court.

5-2. CITY ATTORNEY
5-2-1. Approval as to legality and form of City Ordinances.
5-2-2. Approval as to legality and form of agreements and contracts
on behalf of the City.
5-2-3. Advising all City officials, officers, and departments on
legal matters Concerning the City.
5-2-4. Representing the City in court.
5-2-5. Conducting training for police officers on legal matters
as required.
5-2-6. Drafting ordinances, leases, agreements, resolutions and
contracts as needed.
Section 6. MAJOR FUNCTIONS OF THE CITY ADMINISTRATOR AND STAFF
INCLUDE:
6-1. CITY ADMINISTRATOR
6-1-1. Subject to and except as otherwise provided by law or
Ordinance, he shall have the power to appoint and remove
all officers, Directors, and Merit or Civil Service em-
ployees of the City. Specifically excepted are elected
officials and Council or Commission appointees, including
City Attorney, Municipal Judge, City Treasurer, and City
Clerk. He shall have the power to dismiss, suspend and
discipline affected employees in accordance with Civil
Service Ordinance, Merit Ordinances or other policy.
6-1-2. To supervise the administration of the enforcement of all
laws and Ordinances of the City, save and except to the
extent that the administration of such enforcement is
confided to other City officials by law or Ordinances.
6-1-3. To be responsible to the City Council for the administration
of all departments of the City, save and except those
departments confided to the supervision of other City
officers by law or Ordinance; and to cooperate with and
supervise the administrative functions of such departments
to the extent requested or delegated by the City officers
having primary responsibility for the operation of such
departments.
6-1-4. To issue such administrative regulations and outline general
administrative procedures applicable to areas and departments
confided to his supervision in the form of rules which are
not in conflict with the laws of the state of Colorado or
other City Ordinances.
6-1-5. To prepare an annual budget and to submit the sane to Council.
6-1-6. In cooperation with the City Treasurer to keep the Council
fully informed as to the financial condition of the City.

6-1-7. To recommend to Council for adoption such measures as he may
deem necessary or proper for the efficient and proper
operation of the City, and to attend all City Council
meetings.
6-1-8. To prepare and submit to the Council an annual report of
the City's affairs, including a summary of the reports of
the operations of all City departments.
6-1-9. Subject to the requirements of statutes and Ordinances, and
in accordance with rules and regulations now or hereafter
promulgated by City Council, to purchase materials and
authorize expenditures of funds on behalf of the City.
6-1-10. To perform such other duties as may be prescribed by
Ordinance or by direction of the City Council.
6-1-11. To organize City departments, subject to Council approval,
in such a manner that maximum efficiency and economy are
achieved.
6-1-12. The City Council shall deal with that portion of the
administrative service of the City for which the City
Administrator is responsible through the City Administator.
Directives issued by the Council concerning policies or
operations of the City Council affecting the area of
responsibility of the City Administrator in the administra-
tion of any of these departments shall be made so as to
direct the City Administrator to accomplish the necessary
orders.
6-2. BUDGET AND PURCHASING OFFICER. Works under the immediate
supervision of the City Administrator in:
6-2-1. Preparing data for the annual budget as received from
departments and offices.
6-2-2. Performing budget analysis of revenues and expenditures.
6-2-3. Monitoring budget status and keeping the City Administrator
informed through periodic reports.
6-2-4. Preparing regular reports for the City Administrator con-
cerning budgetary matters for use in keeping the Mayor
and Council fully informed on budgetary matters.
6-2-5. Acting as purchasing officer for the City. Seeking and
establishing sources for the purchase of supplies, equipment
and materials needed for the operation of the City.
6-2-6. In cooperation with the Department Heads, preparing and/or
approving specifications for competitive bidding. Super-
vising the opening of bids and preparing reports to the
City Administrator on the results of competitive bidding
conducted by the City in accordance with City purchasing
policy and procedure.

6-2-7. Supervising the disposal of obsolete or wornout equipment
or other items no longer needed by the City.
6-2-8. Maintaining property records of the City.
6-2-9. Coordinating the submission of Federal or State grants.
6-2-10. Serving as Affirmative Action Program Director.
6-2-11. May serve as Civil Defense Coordinator as assigned.
6-3. ADMINISTRATIVE AND PERSONNEL OFFICER. Works under the
immediate supervision of the City Administrator in:
6-3-1. Managing and supervising the City telephone system.
6-3-2. Operating City mail and message center services.
6-3-3. Providing forms management and reproduction.
6-3-4. Maintaining City Regulations.
6-3-5. Managing all personnel functions required to carry out
a comprehensive personnel program including position
classification, recruitment, testing and preparing certi-
fication of candidates for various positions; conducting
training and safety programs and the administration of
fringe benefit programs, except as otherwise assigned by
Ordinance.
6-3-6. Maintaining permanent personnel files and providing the
Treasurer with work and assignment data as it affects pay.
6-3-7. Assembling and publishing monthly and annual Activity
Reports.
6-3-8. Operating and maintaining central City copy reproduction
facilities.
6-3-9. Supervising janitorial services.
6-3-10. Handling special administrative matters assigned by the
City Administrator including the drafting of ordinances
pertaining to personnel matters.
Section 7. MAJOR FUNCTIONS OF LINE DEPARTMENTS INCLUDE:
7-1. PARKS AND RECREATION DEPARTMENT. Works under the immediate
supervision of the City Administrator to perform the
following functions:
7-1-1. Administration of all aspects of the park system and
recreation programs.
7-1-2. Proposing and maintaining a long range City Park and
Recreation/Open Space Plan working in cooperation with
other City departments.
7-1-3. Providing advice and guidance at City Council, Arborist
Board, and Park and Recreation Commission meetings, when
required, in matters relating to the Department.
7-1-4. Preparing plans and related documents and information for
the acquisition and construction of parks and recreation
facilities.

7-1-5. Maintaining all City parks and grounds as assigned to the
Department in an aesthetic and functional manner.
7-1-6. Providing an adegjate recreation program to serve all
residents of the City.
7-1-7. Collecting reasonable charges or making requirements for
reasonable refundable deposits, for expendable crafts
materials or recreation equipment, for electric power and
other utilities used by special groups for the use and/or
reservation of specific park areas of recreation facilities
in accordance with schedules and policies approved and
adopted by the City Council.
7-1-8. Recommending on the acceptance of donations of land, property,
equipment, cash, and labor for park and recreation purposes;
keeping a full account and record of all such donations.
7-1-9. Recommending agreements with school, county, state, other
governmental jurisdictions and private parties for the
development and use of properties for park and recreation.
7-1-10. In cooperation with the Police Department and in accordance
with City Council policies, enforcing rules and regulations
on use and conduct in the parks and recreation facilities,
including the scheduling and reservation of special facilities.
7-1-11. Recommending contracts concerning the operation of concessions,
recreation facilities and programs as the department finds
are in the best interests of the City.
7-1-12. Preparing grant applications and supporting data as directed
and administrating county, state, and federal grants-in-aid
for the development of park and recreation facilities.
7-1-13. Assisting and advising on various City beautification
programs.
7-1-14. Preparing and justifying the annual parks and recreation
budget and administering all funds appropriated for the
Department.
7-2. POLICE DEPARTMENT. Works under immediate supervision of
the City Administrator to perform the following functions:
7-2-1. Maintaining law and order, protecting life and property.
7-2-2. Directing and controlling traffic.
7-2-3. Investigating and apprehending law violators and maintaining
of police records.
7-2-4. Regulating and inspecting required licenses.
7-2-5. Cooperating with other law enforcement agencies.
7-2-6. Coordinating with all groups and governmental units on law
enforcement matters.
7-2-7. Preparing drafts of proposed regulatory Ordinances and laws
regarding public safety and enforcement of laws.

7-2-8. Preparing and justifying the annual budget for law enforce-
ment services.
7-2-9. Preparing studies relating to public safety and providing
input to Traffic Engineering and Planning.
7-2-10. Conducting crime prevention programs.
7-2-11. Providing a member to the Police Pension Board.
7-2-12. Directing the animal control program.
7-2-13. Preparing law enforcement assistance grant applications
and administering grant funds.
7-2-14. Working with the Civil Service Commission on hiring and
disciplinary procedures.
7-2-15. Providing central dispatching services for fire district
and police vehicles.
7-3. PUBLIC WORKS DEPARTMENT. Works under the immediate super-
vision of the City Administrator to perform the following
functions:
7-3-1. Planning, organizing, supervising and performing of pro-
fessional engineering in the design and construction of
streets, traffic signals, sidewalks, curb and gutter,
drainage systems, bridges, culverts, and other City
structures and coordination of utility construction
programs.
7-3-2. Preparing estimates and contract specifications and
provisions for City contracted construction work.
7-3-3. Providing coordination and consultation regarding all
proposed construction projects affecting the City.
7-3-4. Supplying details relating to formation, construction,
and assessments associated with special public improvement
districts.
7-3-5. Reviewing and approving deeds, property descriptions,
subdivision plans, and preparing specifications for
public works improvements in subdivision development
including the inspection and acceptance of such work.
7-3-6. Maintaining of map files and related records and surveying
as required to maintain an accurate inventory of City
property.
7-3-7. Performing engineering services for other City departments
when requested.
7-3-8. Recommending and approving design, materials and processes
proposed in connection with major repairs and new construction.
7-3-9. Preparation of supporting data as required to support Highway
Users Tax funds when needed by the City Treasurer.
7-3-10. Preparing traffic control studies, planning, design and
installation.

7-3-11. Maintaining of all City vehicles and other motorized
equipment.
7-3-12. Planning, organizing and directing the maintenance, repair,
and cleaning of City streets and rights-of-way and relating
facilities, including storm drainage, alleys, gutters,
parkways, and miscellaneous non-park public property.
7-3-13. Supervising street lighting programs and installations.
7-3-14. Making or directing field inspections of all municipal
construction and repair work and issuing permits for sane,
as applicable.
7-3-15. Preparing and justifying the budget of the Public Works
Department.
7-4. COMMUNITY DEVELOPMENT DEPARTMENT. Works under the immediate
supervision of the City Administrator to accomplish the
following functions:
Providing professional advice and guidance to the City
Planning Commission on all matters relating to planning
and zoning.
7-4-2. Presenting the findings and decisions of the City Planning
Commission to the Board of Adjustment and City Council.
7-4-3. Reviewing and checking of all matters relating to proposed
annexations and making recommendations thereto.
7-4-4. Reviewing and checking subdivision plats in preliminary
and final form and assigning addresses in platted and
unplatted areas.
7-4-5. In coordination with the City Engineer, reviewing all
matters relating to City streets, easements, right-of-way,
and changes of street names and preparing information for
any required Ordinances relating thereto.
7-4-6. Reviewing all rezoning applications, both in the City and
within the City planning area and making recommendations
to the City Planning Commission relating thereto.
7-4-7. Reviewing and processing all petitions relating to assigned
functions.
7-4-8. Preparing and presenting special commission reports.
7-4-9. Developing and maintaining the City Comprehensive Plan.
7-4-10. Developing and maintaining official zoning maps and
publications.
7-4-11. Developing City long-range planning, including land use
planning, physical development of the City and community,
and developing and implementing State and Federal grant
programs relating to assigned functions.
7-4-12. Maintenance of files and a library as required to support
all functions and to provide prompt assistance to both
public and private agencies and individuals concerned
with physical development of the City and area.
7-4-13. Inspecting all new construction in the City including
additions to structures.

7-4-14. Checking the plans for building construction.
7-4-15. Providing public information on building safety and
construction regulations.
7-4-16. Checking the quality of construction material.
7-4-17. Determining the qualification of contractors for licenses
and advising the Mayor on issuance of said licenses.
7-4-18. Organizing and directing the City's code enforcement
program to include nuisance abatement, complaints, sign
control, and building occupancy enforcement standards.
Section 8. SEVERABILITY CLAUSE. If any clause, sentence,
paragraph or part of this ordinance or the application thereof to
any persons or circumstances shall for any reason be adjudged by a
court of competent jurisdiction invalid, such judgment shall not
affect, impair or invalidate the remainder of this ordinance, or its
application to other persons or circumstances. Any provision of the
City of Wheat Ridge in conflict herewith, or any part hereof, shall
be and the same is hereby repealed.
Section 9. EFFECTIVE DATE. This ordinance shall become effective
thirty (30) days after publication following final reading. Ordinances
42 and 62, Series of 1970, shall remain in effect until the effective
date of this ordinance.
