ORDINANCE NO. 172
Series of 1975
TITLE. AN ORDINANCE AMENDING ORDINANCE NO. 98, SERIES OF 1971, AN
ORDINANCE WHICH ESTABLISHED COMPREHENSIVE ZONING REGULATIONS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT.
SECTION 1. Subparagraph (1), paragraph B, Section Eighteen,
Ordinance no. 98, is amended to add a subordinate paragraph (c) reading:
"B, 1, c, Service Stations, Motor Fuel Filling Stations, Garages for
Repair of Motor Vehicle Entirely Within Enclosed Building."
SECTION 2. Paragraph D, 1, a, (9), (c), Section Twelve
Ordinance No. 98, is amended to add the following: "The following
requirements must be met:
(a) A minimum of ten per cent (10%) of any required (zoning
setback) yard space adjacent to a public street, if used for parking
or surfacing of any sort other than landscaping, shall be land-
scaped,
(b) A minimum five per cent (5%) of any required (zoning setback)
yard not fronting a public street, if used for parking or surfacing
of any sort other than landscaping, shall be landscaped; and
(c) Provided that all such landscaping shall not be less in
total than ten per cent (10%) of the gross lot area."
SECTION 3. Paragraph H, 1, i, Section Thirteen, Ordinance No.
98, is amended to add the following: "The following additional requirements
must be met,
(a) A minimum of ten per cent (10%) of any required (zoning
setback) yard space adjacent to a public street, if used for
parking or surfacing of any sort other than landscaping, shall be
landscaped;

(b) A minimum of five per cent (5%) of any required (zoning
setback) yard not fronting a public street, if used for parking
or surfacing of any sort other than landscaping, shall be land-
scaped; and
(c) Provided that all such landscaping shall not be less in
total than ten per cent (10%) of the gross lot area."
SECTION 4. Subparagraph 6, paragraph D, Sections Sixteen,
Seventeen, Eighteen, and Nineteen, Ordinance No. 98, is amended to in each
instance add: "Landscaping requirements shall be as follows:
(a) A minimum of ten per cent (10%) of any required (zoning
setback) yard space adjacent to a public street, if used for
parking or surfacing of any sort other than landscaping, shall
be landscaped;
(b) A minimum five per cent (510) of any required (zoning setback)
yard not fronting a public street, if used for parking or sur-
facing or any sort other than landscaping, shall be landscaped,
and
(c) Provided that all such landscaping shall not be less in total
than ten per cent (10%) of the gross lot area."
SECTION S. Paragraph D, 1, b, (3), Section Twenty, Ordinance No.
98, is amended to add: "The following requirements must be met:
(a) A minimum of ten per cent (10%) of any required (zoning
setback) yard space adjacent to a public street, if used for parking
or surfacing of any sort other than landscaping, shall be land-
scaped;
(b) A minimum five per cent (5%) of any required (zoning setback)
yard not fronting a public street, if used for parking or surfacing
of any sort other than landscaping, shall be landscaped; and
(c) Provided that all such landscaping shall not be less in total
than ten per cent (1010) of the gross lot area."

SECTION 6. Paragraph 11, 2, Section Twenty-One, Ordinance No.
98, is amended by adding and inserting after the sentence which begins:
"If said area is to be used for off-street parking," the following, "and
landscaping must meet the following requirements-
(a) A minimum of twenty per cent (200) of any required (zoning
setback) yard space adjacent to a public street, if used for parking
or surfacing of any sort other than landscaping, shall be land-
scaped;
(b) A minimum five per cent (50) of any required (zoning setback)
yard not fronting a public street, if used for parking or surfacing
of any sort other than landscaping, shall be landscaped; and
(c) Provided that all such landscaping shall not be less in total
than ten per cent (10%) of the gross lot area."
SECTION 7. Paragraph J, 1, b, (3), Section Twenty-One, Ordinance
No. 98, is amended to add: "landscaping requirements shall be as follows:
(a) A minimum of twenty per cent (200) of any required (zoning
setback) yard space adjacent to a public street, if used for parking
or surfacing or any sort other than landscaping, shall be landscaped;
(b) A minimum five per cent (5%) of any required (zoning setback)
yard not fronting a public street, if used for parking or surfacing
of any sort other than landscaping, shall be landscaped; and
(c) Provided that all such landscaping shall not be less in total
than ten per cent (10%) of the gross lot area."
SECTION 8. Paragraph A, Section Twenty-Eight, Ordinance No. 98,
is amended to add subparagraphs 3(a) and 23(a) reading:
"3(a) Building - Main The building(s) housing the principle
(primary and most important) use(s) permitted for the lot upon
which it is located and provided that to be classified as one
(1) main building, the total structure shall have a continuous
roof and continuous foundation.

"23(a) Landscaping Any combination of two or more of the following:'
grass, flowers, shrubbery, deciduous and coniferous trees, which
shall be maintained in an orderly manner, and in addition any
combination of bark, rock, artificial greenery, or ornamental object
not exceeding twenty per cent (20%) of the landscaped area may
be used."
SECTION 9. If any part or parts hereof is for any reason held to
be invalid, such shall not affect the remaining portions of this ordinance.
SECTION 10. Effective Date. This ordinance shall take effect
and be in force thirty (30) days after publication following final passage.
INTRODUCED, READ, ADOPTED AND ORDERED PUBLISHED AND POSTED on
first reading by a vote of 5 to 1 this 20th day of
