HomeMy WebLinkAboutOrdinance-1975-0178 - Repeal WR Ord #'s 41, 46, 56, 64, 88, 102, 105, 116, 117, 134, & 166 - Personnel Rules/RegulationsINTRODUCED BY COUNCILMAN Merkl ORDINANCE NO. 178 Series of 1975 TITLE: AN ORDINANCE REPEALING ORDINANCES NO. 41, SERIES OF 1970; NO. 46, SERIES OF 1970; NO. 56, SERIES OF 1970; NO. 64, SERIES OF 1970; NO. 88, SERIES OF 1971; NO. 102, SERIES OF 1971; NO. 105, SERIES OF 1972; NO. 116, SERIES OF 1972; NO. 117, SERIES OF 1972; NO. 134, SERIES OF 1973; AND NO. 166, SERIES OF 1974; AND FURTHER AUTHORIZING THE ESTABLISHMENT OF PERSONNEL RULES AND REGULATIONS FOR THE GENERAL EMPLOYEES OF THE CITY OF WHEAT RIDGE, COLORADO, AND SHALL REMAIN IN EFFECT HEREAFTER UNTIL CHANGED BY ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OFWHEAT RIDGE, JEFFERSON COUNTY, COLORADO, THAT: Section 1. Ordinances No. 41, Series of 1970; No. 46, Series of 1970; No. 56, Series of 1970; No. 64, Series of 1970; No. 88, Series of 1971; No. 102, Series of 1971; No. 105, Series of 1972; No. 116, Series of 1972; No. 117, Series of 1972; No. 134, Series of 1973; and No. 166, Series of 1974 are hereby repealed. Section 2. Policy, Purpose, and Application. 2-1. Policy. In order to assure efficient and economical administration of City services and to provide equal opportunity for all qualified persons to compete for positions in the City employment, the City of Wheat Ridge hereby recognizes the merit principle in personnel administration. It shall be the policy of the City of Wheat Ridge to appoint qualified employees and to make possible a career service by making promotions on the basis of efficient work performance and by providing tenure of office to those who give satisfactory service to the City. 2-2. Purpose. The purpose of this Ordinance is to allow for the estab- lishment of a Rules and Regulations manual which shall be adopted by a voice vote of a majority of all the City Council members. Said Rules and Regulations manual will be consistent with the following principles: 1. Recruiting, selecting, and advancing employees on the basis of their relative ability, knowledge, skills, and performance on the job, including open competition of qualified applicants for initial employ- ment; 2. Establishing pay rates consistent with the principle of providing comparable pay for comparable work, and based on generally prevailing rates for like work in other cities in the Metro Denver area; 3. Training employees, as needed, to assure high quality performance; 4. Retaining employees on the basis of the adequacy of their per- formance, correcting inadequate performance, and separating employees whose inadequate performance cannot be corrected; 5. Assuring fair treatment of applicants and employees in all aspects of personnel administration without regard to political affiliation, race, color, creed, age, national origin or ancestry, sex, or religion. ORDINANCE NO. 178 - Continued 2-3. Application. The Rules and Regulations shall apply to all officers and employees of the City of Wheat Ridge, except: 1. Mayor, 2. All other elective officers of the City, 3. City Administrator, 4. Members of Boards or Commissions who are not City employees, 5. Department heads, 6. Staff personnel in the Mayor's Office or City Administrator's Office, 7. All Civil Service employees, 8. Municipal Judges, 9. Municipal Court Clerks, 10. Bailiff, 11. Court Reporter. Section 3. Personnel Commission Established. There is hereby established a Personnel Commission for the City of Wheat Ridge. The Personnel Commission shall be composed of no more than five (5) members. 3-1. The members of the Personnel Commission shall be appointed by the City Council and shall serve three (3) year overlapping terms. Members of the Commission shall be United States citizens and be actual bona fide residents of the City of Wheat Ridge, Colorado, and be eighteen (18) years of age or over. 3-2. Should any member of the Commission fail to fulfill his term for any reason, the City Council shall appoint a qualified replacement to fill the remainder of the term. 3-3. Members of the Commission shall not hold an elective government office or be employed by the City of Wheat Ridge during tenure as a member of the Commission. 3-4. The Director of Administrative Services shall serve the Commission as Secretary and Chief Examiner without additional compensation and will not have voting rights. Section 4. Duties and Responsibilities of Commission. 4-1. In addition to other duties set forth elsewhere in this Ordinance and the Rules and Regulations, the Commission shall handle appeals on matters pertaining to violations of personnel rules, discrimination, disciplinary actions, reductions in force, and to preserve, protect, and promote the standard of merit in City personnel administration. 4-2. In all matters, the Commission shall act through the Director of Administrative Services in dealing with the employees, except appeal hearings and discrimination hearings. In those cases, the Commission shall follow the rules then in force and effect. 4-3. Amendments to the Rules and Regulations may be adopted by majority vote of the Commission, subject to approval by a majority of the City Council. -2- ORDINANCE NO. 178 - Continued Section 5. Annually, the City Administrator shall cause a compensation schedule to be made. Such compensation schedule must be reviewed and approved by the Personnel Commission and submitted to the City Council for ratification in ordinance form. Such compensation schedule will be based on experience in recruiting for positions, the prevailing rates of pay for the service performed, and for comparable services in public and private employment, cost of living, the City's financial condition and policies, and such other facts as are necessary. Section 6. Budget of Commission. An annual budget for the Personnel Commission will be included within the budget of the Department of Administrative Services. Section 7. Emergency Clause. The provisions of this Ordinance are necessary for the preservation of the public health and safety of the Citizens of Wheat Ridge for the following reasons: (1) The maintenance and continued development of a strong personnel system under this Ordinance is considered of vital public interest; (2) Personnel Rules and Regulations are needed to promote the continuation of the strong personnel system; (3) These Rules and Regulations have a direct bearing on the productivity and morale of employees and are, therefore, in the public interest for immediate implementation. Section 8. Effective Date. This Ordinance shall take effect and be in force five (5) days after publication following final passage providing it shall have been passed by an affirmative vote of three-fourths (3/4) of the members of the City Council; otherwise, said Ordinance shall take effect thirty (30) days after publication following final passage.
