TITLE. AN ORDINANCE VACATING A CERTAIN PART OF A STREET
LOCATED 1.'ITHIN THE CITY OF 1,''HEAT RIDGE, COLO) :DO, I.E.,
VACATING A CERTAIN DESCRIBED STREET LYING IN PART OF THE
NORTH WEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 1S,
TOWNSHIP 3 SOUTH, RANGE 69 LEST, OF THE 6TH PRINCIPAL
MERIDIAN.
WHEREAS, by deed recorded in Boo': 2246, Page 745,
of the Jefferson County, Colorado Records, a certain street
was dedicated to the public; and
WHEREAS, the following described part of said.
street is no longer necessary for use by the public; and
WHEREAS, said street is within the limits of the
City of Wheat Ridge; and
WHEREAS, no land would, by a vacation of said
street, be left without an established public road connecting
it with another established public road; and
WHEREAS, the Wheat Ridge Planning Commission has
approved the vacation of said street.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. The following described street in the
City of Wheat Rie, Colorado, be vacated to wit:
Beginning at a point an the West line of the Northwest Quarter of the
Southwest Quarter (NWY4SWya) of Section Fifteen (15), Township Three (3)
South, Range Sixty-nine (69) West of the 6th Principal Meriden, which
lies 1225.55 feet South,002' East of the Northwest Corner of the North-
west Quarter of the Southwest Quarter of Section 15; thence North 770
18'20" East, 921.40 feet to a point of tangency to a curve to the left
which has a radius of 500 feet, and an internal angle of 77020'20";
thence along said curve to the left 674.91 feet to a point of tangency;
thence North 0 02'West 270.93 feet; thence North 87048'East 5.0 feet to
the existing West right of way line of Independence Street; thence South
002' East along said right of way line 385.13 feet; thence North 89058'
East 25.0 feet; thence South 0002' East 66.83 feet to a point of inter-
section with a curve to the right which lies parallel to and 60 feet from
the curve described previously in this description; thence along this
curve to the right a distance of 332.54 feet to a point on the North
riraht of way line of Public Service Company of Colorado; thence South
74 20' West along said right of way line 1170.31 feet to a point on the
West line of the Northwest Quarter of the Southwest Quarter of Section
15; thence North 0002' West along said West line, 72.14 feet to the
point of beginning, for road purposes,
And the same is hereby approved and the described
street is hereby vacated; provided, however, said vacation
shall be subject to the following conditions and reservations:
There is reserved to the City of Wheat Ridge and
to utility owners the continued use and right to construct,
operate and maintain sewer, power, telephone, and gas lines
in said vacated street.

Section 2, The provisions of this Ordinance are
necessary to the immediate preservation of the public health
and safety of the citizens of the City of Wheat Ridge.
Section. 3. Effective Date. This ordinance shall
take effect thirty (30) days after publication following
final passage.

AND POSTED, on first reading by a vote of 4 to 1, this
