HomeMy WebLinkAbout06/15/1972 MINUTES June 15, 1972 The one hundred and sixty-third regular meeting of the Wheat Ridge City Council was called to order at 7 40 p.m. by Mayor Albert E. Anderson at 7390 West 38 Avenue. Aldermen present were Dr. Paul Abramson, Jack Bramble, Joseph Donaldson, Calvin Hulsey and Ray C. Pepe. Alderman Robert Howard was absent. Also attending were Mayor Anderson, City Clerk Louise Turner, City Attorney Maurice Fox, staff personell and interested citizens. Citizen Comments were made by Benjamin Love representing the Marshall Street Bridge Assoc. who stated 1. That he had contacted Robert Kessler of the Department of Transportation who would check locally and in Washington and Joe Montano who would check with Mr. Heathcote for the possible location of available funds. 2. That he had talked with the Arvada Council and that he knew the Wheat Ridge staff was speaking with the County. 3. That the Association was not "trying to supplant the City" but hoping to add its weight to whatever the City might do. 4. And that he looked for an answer within three weeks. Mrs. Marv Harlow of 4660 Estes who said 1. That she was speaking for people who lived between 44 Avenue and 1-70 from Carr Street to Garrison who were seeking exclusion from North Jeffco Recreation District. 2. That about 2500 people live in the area. 3. That 300 had signed petitions to be given to North Jeffco. 4. Citizens in this area are paying double for recreation, and because of new arrangements, all Wheat Ridge citizens can use North Jeffco facilities. 5. That the publication for exclusion would cost $700.00. 6. That shortly before the meeting with North Jeffco, she was informed that the City was not going to provide the necessary money, as had been promised earlier. She asked that the City "take over our fight for exclusion of the area" and presented a list of the names of the people who had signed the petitions. Aldermen Hulsev and Pepe stated th~ favored paying the cost of publication. City Attornev Fox said he would need to research the matter to determine the legality of such action. Motion by Alderman Bramble: "I move we allow ample time for the City Attorney to explore the matter and report to Council with a recommendation on the route to take in the matter of exclusion of this area from North Jeffco District." Motion was seconded by Alderman Hulsey. Motion was made by Alderman Abramson, seconded by Alderman Pepe and passed 5-0 that the Motion be amended to include "July 6, 1972" as the time when the report would be given. Council was polled on the amended Motion and Motion passed 5-0. Motion by Alderman Hulsey "I move that the North Jeffco Park and Recreation District on these residents from North Jeffco District." add "and that Aldermen Hulsey, Donaldson and make up the Committee" Motion was seconded and passed 5-0. City start talks with the matter of excluding Motion was amended to Bramble and Mayor Anderson by Alderman Donaldson Ordinance No. 112 pertaining to placing the question of an additional 1% sales tax for acquisition of park land on the ballot was introduced by Alderman Abramson and read. u ) / -.J....._ MINUTES - June 15, 1972 - Continued -2- Alderman Abramson explained that unless the City starts proceedings prior to similar action by the County, it cannot do so. Alderman Pepe stated it would be a hardship on the many senior citizens in his ward. He also, questioned the legality of earmarking funds. He said it was alot of money for parks and that it could not be used for something else in case of a problem like the Marshall Street Bridge, and that if put to a vote it might be carried because of the vote in Wards Two and Three, inspite of Ward One. Attorney Fox said the legality could be determined prior to the second reading. Alderman Hulsey said additional funding was necessary if parks are to be expanded, that a sales tax is the fairest kind of tax and that passing the Ordinance would "just be putting it tovthe Deople." a vote oj' Alderman Bramble said~~greed with Alderman Pepe that too high a sales tax could drive business out of the City. Also, that if it were not earmarked he would ~ake another look at it." Alderman Donaldson said his thinking was similar to Alderman Pepe's but that it would be used totally within the City unlike the proposed County sales tax. Motion by Alderman Abramson: "I move that Ordinance No. 112 be passed on first reading and be published and posted." Motion was seconded by Alderman Hulsey. Alderman Abramson stated the people should have the chance to make the decision and that passing it on first reading would allow time for study prior to second reading. Question was called and Motion to pass Ordinance No. 112 was defeated 3-2 with Aldermen Hulsey and Abramson voting "aye" and Aldermen Pepe, Bramble and Donaldson voting "nay." WZ-72-12 Rezoning Case came up for decision. Motion by Alderman Pepe "I move that Case WZ-72-12 request by Richard and Joanne Glassman at 4495 Vance Street be denied for the following reasons 1. Residential-Two should remain as a buffer. 2. Restricted-Commercial-one would result in greater traffic, and 3. the Planning Commission recommended denial." Motion was seconded by Alderman Donaldson and passed 6-0 to deny. Alderman Howard had submitted a sealed vote to deny the rezoning and is attached to the Minutes. A Public Hearing was held for a 3-way liquor license for Jim P. Mola dba Village Inn Pancake House at 4700 Kipling Street. Jim P. Mola was present and was represented by Jay G. Colby, attorney. Complete pro- ceedings were recorded by Court Reporter Harve Clements. Upon completion of the presentation, Mr. Colby asked that since there would be no meeting on the following Thursday that Council act on the matter that night. Motion by Alderman Abramson "I move that Council take a ten minute recess to discuss the matter." Motion was seconded by Alderman Donaldson and passed 3-1. Alderman Pepe voted "nay" and Aldermen HOWI'd and Bramble were absent. Alderman Abramson stated that based on the fact that there would be no meeting the following week, he would make the following Motion "I move that a 3-way liquor license for Jim P. Mola dba Village Inn Pancake House at 4700 Kipling Street be approved." Report indicatEd that 44.6% of anticipated revenue had been received and 44.2% of the appropriations had been expended. Resolution No. 171 pertaining to the transfer of funds to savings accounts was introduced by Alderman Pepe and read. Motion by Alderman Pepe "I move that Resolution No. 171 transferring funds into savings accounts be passed." Motion was seconded by Alderman Donaldson and passed 4-0. Resolution No. 173 was introduced by Alderman Abramson and read. Motion by Alderman Pepe "I move that Resolution No. 173 pertaining to permitted minor USeS in the Flood Plain be passed." Motion was seconded by Alderman Abramson. It was established that study of the Resolution was necessary and changes were needed. Motion was defeated 3-1. Alderman Pepe voted "aye" and Aldermen Hulsey, Abramson and Donaldson voted "nay." Resolution No. 174 commending Dick Mac Ravey of the Colorado Municipal League was read. Motion by Alderman Pepe "I move that Resolution No. 174 be adopted." Motion was seconded by Alderman Hulsey and passed 4-0. Ordinance No. 113 was introduced by Alderman Abramson and read. Motion by Alderman Abramson "I move that Ordinance No. 113 amending Ordinance No. 37 be correcting a legal description be adopted on first reading and be published and posted." Motion was seconded by Alderman Donaldson and passed 4-0. Alderman Abramson read a quote from the Mayor of Rapid City, South Dakota who in reference to the recent flooding had said that the dam above Rapid City had been adequate for their purposes but that "the planners hadn't anticipated the amount of water the flood brought. It was a once in a hundred years phenomenon." Alderman Abramson said "because we are trying to protect the citizens' and because he felt "Judge Priest's ruling was technically wrong" he would make the following Motion "I move that the City Attorney be authorized to appeal the ruling on Bauer Townhouses."
