AN ORDINANCE AMENDING SECTION TWENTY-FIVE OF ORDINANCE NO. 98, SERIES OF 1971, RELATING TO NON-CONFORMING LOTS OF RECORD. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: SECTION 1. Paragraph D, Section Twenty-Five, Ordinance No, 98, Series of 1971, is hereby amended to read as follows: D. NON-CONFORMING LOTS OF RECORDS - In any district any building may be erected on any single lot of record which exists as such at the time of adoption of this ordinance. Such lot must have been in separate ownership and not of continuous frontage with other lots under the same ownership. This provi- sion shall apply even though such lot fails to meet the require- ments of the district in which it is located for area, or width, or both provided however that the requirements of the district for minimum yard dimensions shall be met unless a variance to said requirement has been granted by the Board of Adjustment. If two or more lots or combinations of lots and portions of lots with continuous frontage in single ownership are of record, the time of passage or amendment of this ordinance, and part or all of said lots do not meet the requirements of the district in which they are located as to minimum area or frontage or both, the lands shall be considered for the purpose of this ordinance to be an undivided parcel and no portion of said parcel shall be sold or used in a manner which diminishes compliance with lot width and area requirements established by this ordinance. SECTION Z. Subparagraph 1, paragraph F, Section Twenty Five, Ordinance No. 98, Series of 1971, is hereby amended to read in whole as follows: F.1 Any such structure may be enlarged, altered, or added to, provided that any such enlargement, alteration, or addition meets all building setback and lot coverage require- ments of the zoning district in which the structure is located. SECTION 3. A new paragraph H is hereby added to Section Twenty-Five, Ordinance No. 98, Series of 1971, to read as follows: H. Non-conforming lot(s) - Any legal non-conforming lot which is non-conforming due to ingress/egress, landscaping, parking or street related improvements, which has located on it a building housing a non-conforming use within the zoning district may be repaired and/or maintained in accordance with paragraph I of this Section. Where the use of the building is in conformance with the zoning district or where initial building development is proposed, the building may be erected, enlarged, altered, or added to, provided that any such new building, enlargement, alteration or addition meets all building setback and lot coverage requirements of the zoning district in which the building is located, and provided that the requirements for ingress/egress, landscaping, parking and street and related ORDINANCE NO. 186 -2- improvements be provided unless a waiver of part of all of these requirements is recommended by the Planning Commission. SECTION 4. Paragraphs H, I and J, Section 2S, Ordinance No. 98, Series of 1971, are hereby retitled paragraphs I, J and K, respectively.. SECTION S. The retitled paragraph I is hereby amended to read as follows: I. Nothing in this ordinance shall be deemed to prevent the strengthening or restoring to a safe condition of any building or part thereof declared to be unsafe by any official charged with protection of the public safety. SECTION 6. Effective Date. This ordinance shall take effect thirty (30) days after final publication.
