HomeMy WebLinkAbout06/29/1972 MINUTES June 29, 1972 The one hundred and sixty-fourth rEgular meeting of the Wheat Ridge City Council was callEd to order at 7 40 p.m. by Mayor Albert E. Anderson at 7390 West 38 Avenue AldermEn presEnt were Dr. Paul Abramson, Jack W. Bramble, Joseph Donaldson Robert Howard and Calvin Hulsey. Alderman Ray C PEpe was absEnt. Others attending were Mayor Anderson, City Clerk Louise F. Turner, Acting City Attorney Edward Walters staff members and interested citizens. CitiZEn Comments were made by David Lvnch of 3125 XEnon Street, Chairman of the GovErnmental Affairs Committee of the Wheat Ridge Chamber of Commerce. Mr. Lynch read a letter which referred to and asked amendments to two sections of Ordinance No. 98 as it pertains to signs in display windows and portable or wheeled signs. A copy of the letter is attached to the Minutes. In answer to questions he stated there will be a study of the entire Ordinance and will come back at a later time, if there are additional recommendations. Discussion established that the Ordinance had come from Denver Regional Council of Governments, that Paul Walker, Planning Director would prepare amendments, that amendments would go to the Planning Commission for consideration on July 10, 1972 and then to Council for action. Motion by Alderman Bramble "I move that there be a moratorium on those sections of thE Ordinance (E.8 and F.2 of Ordinance No. 98) until it can be amended or amendments considered." Motion was seconded by Alderman Donaldson and passed 5-0 E D. Mattox of 4050 Zephyr Drive who stated that the poor condition of 38 Avenue and the east side of Pierce Street since the installation of the storm drain was a reflection on the Council and the Mayor. He said the proper tamping had not been done and that the surfacing had been repaired in 5 places. He said that much of next year's street budget would have to go for repairing these streets and that the storm sewer contract should have been written so that it contained specifications that would have left the streets at least as good as they were before. Mr. Mattox agreed with Mr. Lynch that the Sign Code hurts the businessmen and added that it reduces the sales that provide the sales tax. He said laws should be thoroughly studied before they are passed. Resolution No. 175 was introduced by Alderman Donaldson and read. Motion by Alderman Bramble "I move that Resolution No 175 (Pertaining to the investment of funds in Majestic Savings and Loan and Capitol Federal Savings and Loan) be passed" Motion was seconded by Alderman Donaldson and passed 5-0. Ordinance No. 110 pertaining to a street vacation was brought up for sEcond consideration and the title read. Motion was made by Alderman Bramble, seconded by Alderman Abramson and passed 5-0 "That the Clerk dispensE with reading the rest of the Ordinance." Motion by Alderman Donaldson and be ordered published and Hulsey and passed 5-0. "I move that Ordinance No. 110 be passed posted." Peter5 the applicant asked about issuance of a deed and was told that no deed would b8 issu8d, but that th8 Ordinanc8 would be r8cord8d. Paul Walker, Planning Director requested clarification of a Council Motion regarding Rezoning Case WZ-72-o7. He asked whether the Case which Council had sent back to Planning was to be heard as Residential- Three or Planned-Residential-Development. After discussion, it was determined that the Case would be posted as Planned-Residential-Development, and that Council had no objection to its being heard as Planned-Residential-Development or being amended by the applicant to Residential-Three, if he chose to do so when the Case is heard on July 10, 1972. Ambulance Report was given by Alderman Jack Bramble. He said the ambulance service which is using the original police station-wagon and is manned by the Fire Department had been a big success. He said there are plans to buy a new ambulance, but before this can be done it is necessary to have ground on which to house it and this has not been assured. The only cost to the citizens is the cost of the vehicle and the old vehicle would be kept for standby. Mayor Anderson announced that Paul Walker had received a request from Regional Transportation District that a meeting with City Council be set up within two weeks for a presentation of long range plans. Other pending meetings were referred to and no time was set. City Clerk Louise Turner told Council that there had been changes made in the General Election Precincts which would make it necessary to change City Ward and Precinct boundaries. She presented recommendations to Council and asked that they be approved and be effective as of July 19, 1972. She also asked that Council authorize the use of voting machines for City elections before the July 18, 1972 election. Motion by Alderman Bramble "I move we authorize voting machines for City Elections." Motion was seconded by Alderman Hulsey and passed 5-0. Acting Attorney Edward Walters stated that precinct changes could be made only by a unanimous vote of the total Council and approval of the Mayor. It was noted that Alderman Pepe was absent. Motion by Alderman Bramble "I move we table the matter until we can have a unanimous vote." Motion was seconded by Alderman Donaldson and passed 4-1. Alderman Abramson voted "nay." Motion by Alderman Bramble "I move that Civil Service Representative Kent Davis of 8080 Melrose Drive be reappointed to the Civil Service Commission for a six year term and said term to expire July 26, 1978 " Motion was seconded by Alderman Hulsey and passed 5-0. We also fully recognize that in a document of this magnitude and scope, that it would be impossible to foresee all of the possible implications prior to its enactment and subsequent enforcement ~~7"k During this period of enforcement it appears that certain pro- visions are restricting to our ability to serve the citizens of Wheat Ridge and also creating a financial har~shi~ to the businessman Our ability to advertise,gFeat~y enhances our ability to serve We therefore respectfully submit to Council dations for am~ndment to the Ordinance. SECTION ~8 Signs in the display window: the following recommen- be amended to read Signs in the display window of a business shall not exceed fifty percent (50%) of the total window area glass, and will be of design which will present a neat appearance SECTION F2 Signs not permitted: be amended to read: Portable or wheeled advertizing devices, excepting licensed motorized vehicles and licensed trailer~used for business purposes.
