HomeMy WebLinkAboutOrdinance-1976-0205 - Repeal WR Ord 55 - Rules and Regulations Governing Parks and Recreation Facilitiesrqr INTRODUCED BY COUNCILMAN Merkl ORDINANCE NO. 205 Series of 1976 TITLE: AN ORDINANCE REPEALING ORDINANCE NO. 55, SERIES OF 19701 AND RELATING TO RULES AND REGULATIONS GOVERNING PARKS AND RECREATIONAL FACILITIES WITHIN THE CITY OF WHEAT RIDGE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, THAT: Section 1. AUTHORITY. The Mayor of the City of WheEt Ridge does hereby authorize the Director of Parks and Recreation and the Parks and Recreation Commission to enforce the rules and regulations set forth in this Ordinance and all future rules and regulations adopted by the City Council of the City of Wheat Ridge for the proper management, operation and control of the Parks, Parkways and other recreational facilities within the City of Wheat Ridge, Colorado. Section 2. DEFINITIONS. As used in these rules and regulations, the following words and terms, unless the text clearly indicates to the contrary, shall have the meaning indicated below: Commission: The Parks and Recreation Commission of the Parks and Recreation Department of the City of Wheat Ridge, Colorado. City: City of Wheat Ridge, Jefferson County, State of Colorado. Department: The Department of Parks and Recreation of the City of Wheat Ridge, Colorado. Director: The Director of the Department of Parks and Recreation of the City of Wheat Ridge, Colorado. Director's Agent: Those employees assigned specific responsibilities and authority by the Director. Reference to any one park, parkway, or recreational area shall include all. Section 3. RULES AND REGULATIONS. A. GENERAL 1. Advertising - shall not be permitted in any manner unless authorized by the Director in writing or in concessionaire contracts for goods sold on the premises. 2. Amplification Systems - Public address or other amplification devices may be used only by special permit obtainable from the Director or his agent in charge of any program requiring sound amplification. 3. Animals - All animals must be on a leash or otherwise under control of the owner at all times. 4. Alcoholic Beverages - No fermented, vinous or intoxicating liquor of any kind shall be stored or consumed on any athletic field or playground within any park or recreation area. It shall be unlawful to sell beer within any park or recreation area except where permitted by concession agreement, or by Council authorization. W^ ORDINANCE NO. 205 - Continued -2- 5. Begging or Soliciting - It shall be unlawful to beg or solicit within any park or recreation area. 6. Cleats - Cleats or spikes on shoes are prohioited except in those specially designed athletic areas where program rules specifically permit their use. 7. Dances - Dances shall be permitted only by written permit issued by the Director. 8. Disturbance - It shall be unlawful within any park or recreation area of the City to disturb the peace of others by violent, tumultuous, offensive, or obstreperous conduct, or by loud or unusual noises or by unseemly profane, vulgar, obscene or offensive language or conduct, or to assault, strike or fight another, or to in any other way breach the peace. 9. Fires - Fires are permitted only in enclosed fireplaces or grills, provided for this purpose under such rules and regulations as may be proscribed by +he Director and any such fire shall be extinguished before leaving any park or recreation area of the City. 10. Flying Objects - It shall be unlawful to throw, strike, propel or otherwise operate flying or propelled objects of a potentially dangerous nature, including by way of example, without limitation, such things as model airplanes, rockets, horseshoes, arrows, golf balls, or rocks, except in areas designated for such use or part of an authorized sport or recreational activity or by a written permit of the Director. 11. Hours - Parks shall normally be open daily from 5:00 a.m until 11:00 p.m., and normally be closed from 11:00 p.m. to 5:00 a.m., except for activities and events sponsored by the Department or authorized by permission of the Director. Any park or recreational facility may be declared closed to the public by the Director at any time and for any interval of time, with a temporarily or stated intervals as the Director shall find reasonably necessary. It shall be unlawful to go upon area or part of any park or recreational facility of the City, when it has been declared to be closed to the public by the Director. 12. Lighted Fields - Artificially lighted athletic fields in the parks shall have the lights turned off at 10:00 p.m., except Wheat Ridge and Prospect Park, however, an inning in process may be completed, but no inning will start after 10:00 p.m., except Wheat Ridge and Prospect Park where no inning will start after 10:30 p.m. 13. Littering - It shall be unlawful to bring in, dump, deposit or leave any bottles, broken glass, ashes, papers, boxes, cans, dirt, rubbish, waste, garbage, refuse, or other trash upon any park or other recreational facility of the City. It shall be unlawful for any person utilizing the facility of any park or recreational facility of the City to leave such area without first having com- pletely extinguished fires, nor before all trash in the nature of boxes, papers, cans, bottles, garbage, and other refuse is placed in the disposal receptacles where provided. If no such receptacles are available, then the refuse and trash shall be carried away from the area to be properly disposed of elsewhere. 14. Meetings in Parks - Sponsors of public meetings of more than twenty-five (25) people must apply for and receive a permit from the Director. Meetings shall be orderly and law abiding. Authorized meetings shall have on hand a permit signed by the Director or his authorized agent. 15. Pavilions - Reservation of pavilions may be obtained by permit issued by the Director. Otherwise, all use of pavilions shall be on a first; come, first serve basis. ORDINANCE NO. 205 - Continued -3- 16. Permits - The Director is hereby authorized to issue permits relating to any use or accomodation of any park or recreation facility of the City. The Director shall set the requirements for the issuance of any permit and may include in those requirements any fee and/or deposit. The Director shall have the power and authority to cancel any permit for violation of the requirements of the permit and violation of any of the rules and regulations set forth herein. 17. Sales - It shall be unlawful to sell or offer for sale food and/or refreshments, souvenirs or any other merchandise unless a permit is obtained from the Director. 18. Tents - No tents shall be erected upon any park or recreation facility except as part of a department sponsored activity, or unless a permit is issued authorizing the same by the Director. 19. Workmen and Work Areas - The use of any park or recreation area shall be relinquished to any City or Park employee carrying out work assignments. Public use of work and maintenance areas is not permitted. B. WINTER SPORTS. 1. Ice Skating - No ice skating on any water body supervised by the Department or included in any park or recreation facility is permitted unless the specific area to be used is so posted or public announcement has been made by the Director allowing such activity. When such areas are open for use, they are subject to rules and regulations on program and safety as issued by the Director. 2. Ice Hockey - Ice hockey shall not be permitted except in desig- nated areas as part of a department sponsored activity or by permit issued by the Director. 3. Sledding - Within any park or recreation facility of the City, sledding shall he prohibited on water areas, on vehicle roadways or uphill from any water area or roadway where sleds would coast across said water areas or roadways. 4. Snowballs - Throwing of snowballs is prohibited in any park or recreation area within the City. 5. Vehicles on Ice - All vehicles of any kind and description are prohibited from any lake, stream or water area within any park or recreation area in the City. 6. Snowmobiles - It shall be unlawful to use snowmobiles in any park or recreation facility or area within the City. C. RECREATION CENTERS AND BUILDINGS. 1. The Director or his agent is hereby authorized and empowered to enforce all rules and regulations in this ordinance or issued by the Department in accordance with the authority granted in this ordinance. 2. The Director may restrict the hours, days and weeks of use of any recreation center or building and the Director or his agent may restrict or remove any user, individual or group for violation of any of the rules and regulations set forth herein. ORDINANCE NO. 205 - Continued -4- D. WATER AREAS. 1. Wading - Wading is prohibited in all areas except where specifically designated. 2. Swimming - Swimming is only allowed as part of a scheduled and supervised recreational program, sponsored by the Department or authorized by department permit. Any allowed swimming activity shall be subject to any specific rules and regulations which may be issued and enforced by the Director or his agent. 3. Boating or Rafting - No boat or raft or floating device of any kind or description shall be used on any lake, stream or water area in the park or recreation area except by permit issued by the Director or as part of a department sponsored activity. This shall include, without limitation model boating. E. VEHICLES. 1. Motor Vehicles - It shall be unlawful for any person operating a vehicle in any park or recreation area of the City to fail or refuse to obey all traffic signs, or other traffic control devices regulating the operation, stopping or parking of vehicles. It shall be unlawful for other than authorized personnel to park or drive on lawns, fields or any other places other than upon roadways and parking areas clearly constructed and established for such purposes within the parks, parkways or other recreational facilities of the City. Laws pertaining to streets and highways pertain also to park roads, except that pedestrians shall have the right of way over vehicles in park areas. 2. Parking - Parking shall not be permitteddLuing regular closing hours or in any area closed by the Director. It shall be unlawful to park so as to obstruct access roadways and parking areas or areas designated by sign for emergency vehicle use only. Vehicles may be parked in park and recreation areas only if the occupants are engaged in activity connected with the area. 3. Washing or Servicing of Vehicles. Washing or servicing of vehicles in any park or recreation area in the City is prohibited. 4. Bicycles - All bicycle riders shall obey traffic signs and laws regulating the operation stopping or parking of vehicles. Bicycle riding will be governed further by safe riding practices and consideration for the use of park and recreation areas, trails and pathways by others. Bicycle riding is prohibited on playgrounds, tennis courts and game courts, in pavilions, or in any area where other activities are in progress. F. TENNIS. 1. Tennis courts shall be reserved only by written permit except for department sponsored programs. 2. Use of tennis courts shall be subject to specific rules and regulations posted on such courts. G. ATHLETIC FIELDS. 1. The Director or his agent shall enforce all rules and regu- lations pertaining to activities upon any athletic field in any park or recreation facility of the City. The Director shall have the power to issue rules and regulations governing such athletic fields, and copies of such rules and regulations shall be on file with the Department of Parks and Recreation and the City Clerk. All teams or individuals shall relinquish play on any athletic field to any individuals or teams to whom permits for use of such facility shall have been issued by the Director or his agent. 3. The Director or his agent may restrict or remove any player, players, teams or leagues from all public fields for a specified time forviolations of rules and regulations set forth in this ordinance or issued by the Director under the authority of this ordinance. 4. The Director or his agent shall have the authority to close any or all public fields or play areas when use of such area shall create maintenance problems as a result of weather or other conditions. H. EQUESTRIAN ACTIVITIES. 1. Horseback riding shall be permitted only upon the authorized bridle path unless other areas are specifically designated by the Director or his agent. Section 4. PENALTIES. Penalties for Violation. Every person convicted of a violation of any provision of this ordinance shall be punished by a fine of not exceeding one hundred dollars ($100.00). Section 5. APPLICATION OF ORDINANCE. This ordinance shall apply throughout the municipality of Wheat Ridge, Colorado. Section 6. EFFECT OF ORDINANCE. If any part or parts of this ordinance are for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance in each part or parts thereof, irrespective of the fact that any one part or parts be declared invalid or unconstitutional. Section 7. EFFECTIVE DATE. This ordinance shall take effect thirty (30 days after final publication. INTRODUCED, PASSED, ADOPTED AND ORDERED PUBLISHED on first reading this 9th day of February , A.
