ORDINANCE NO. 225
Series of 1976
TITLE: AN ORDINANCE ADOPTING A CODIFICATION OF ORDINANCES NO. 1
THROUGH 205 OF THE CITY OF WHEAT RIDGE, COLORADO AND
ENTITLED "THE CODE OF THE CITY OF WHEAT RIDGE, COLORADO"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO THAT:
Section 1. There is hereby adopted by the City Council of Wheat
Ridge, Colorado, that certain Code entitled "The Code of the City of
Wheat Ridge, Colorado", containing Ordinances No. 1 through 205 as
compiled, consolidated, codified and indexed in Chapters 1 to 22,
both inclusive, of which Code not less that three copies gave been
and now are filed in the office of the City Clerk of the City of
Wheat Ridge, Colorado.
Section 2. The provisions of such Code shall be in force on and
after January 15, 1977, and all Ordinances adopted on final reading
and passage on or before March 8, 1976, and not contained in such
Code are hereby repealed from and after January 15, 1977 except as
hereinafter provided.
Section 3. The repeal provided for in the preceding section of
this Ordinance shall not affect any offense or act committed or done
or any penalty or forfeiture incurred or any contract or right estab-
lishd or accruing before January 15, 1977; nor shall it affect any
prosecution, suit or proceeding pending or any judgment rendered prior
to January 15, 1977; nor shall such repeal affect any Ordinance or
resolution promising or guaranteeing the payment of money for the City
or authorizing the issue of any bonds of the City or any evidence of
the City's indebtedness or any contract or obligation assumed by the
City; nor shall it affect any annual tax levy; nor shall it affect any
right or franchise conferred by ordinance or resolution of the City
Council on any person or corporation; nor shall it affect any ordinance
adopted for purposes which have been consummated; nor shall it affect
any ordinance which is temporary, although general in effect, or special,
although permanent in effect;norshall it affect any ordinance relating
to the salaries of the City officers or employees; nor shall it affect
any ordinances annexing territory to the City; nor shall it affect any
ordinance naming, renaming, opening, accepting or vacating streets or
alleys in the City; nor shall it affect any ordinance rela-L-ing to zoning;
nor shall it affect any ordinance adopted on final reading and passage
after March 8, 1976.
Section 4. This codification of Ordinances No. 1 through 205 of
the City of Wheat Ridge shall not affect Ordinances No. 2n6 through
227, which were adopted after March 8, 1976. Further, it is recognized
that Ordinances No. 206 through 227 may have an effect on the Ordinances
which are the subject of this codification ordinance and may in effect
modify this code.
ORDINANCE NO. 225
Section 5. Whenever in the Code of the City of Wheat Ridge any
act is made or declared to be unlawful, an offense, nuisance or mis-
demeanor, where no specific penalty is provided therefor, any person
who shall be convicted of the violation of any such j.rovision of the
Code adopted by this ordinance or other ordinance of the City or of
such orders, rules or regulations shill be punished by a fine of not
more than three hundred dollars ('6300.00) or by imprisonment in jail
not exceeding ninety days or by both fine and imprisonment. Each day
any violation of such Code or any other ordinance of the City or any
order, rule or regulation promulgated under the provisions of such
Code or other ordinances of the City shall continue, shall consititute
a separate offense.
Section 6. It is hereby declared to be th, intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases
of this ordinance and the Code hereby adopted are severable, and if
any phrase, clause, sentence, paragraph or section of this ordinance
or the Code hereby adopted shall be declared unconstitutional or other-
wise invalid by the valid judgment or decree of a court of competent
jurisdiction, such unconstitutionality or invalidity shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance or the Code hereby adopted.
Section 7. Emergency Clause. The provisions of this Ordinance
are necessary for the preservation of the health, safety and welfare
of the citizens of Wheat Ridge, Colorado for the following reasons:
a. That it is imperative that the City of Wheat Ridge have
its Ordinances embodied into a Code of Laws.
b. It is necessary for the Code of Laws to take effect prior
to the passage of future ordinances, so that as many ordinances as
possible can be embodied in the Code.
c. That it is necessary for this Ordinance to take effect
as soon as possible.
Section 8. Effective Date. This Ordinance shall take effect and
be in force on January 15, 1977, provided the same has been published
following final passage.
INTRODUCED, READ, APPROVED AND ORDERED PUBLISHED ON first reading
by a vote of 5 to o , this 13th day of December, 1976.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 6 to 0 , this 10th day of January , 1977.
