HomeMy WebLinkAbout08/28/1972 MINUTES August 28, 1972 A Special Meeting of the Wheat Ridge City Council was called to order at 5 10 p.m. by Mayor Albert E. Anderson at 7390 West 38 Avenue for the purpose of considering a liquor code violation at PRk-N-Pik Liquors at 9345 West 44 Avenue. Aldermen present were Robert Howard, Calvin Bramble was absent. Dr. Paul Abramson, Joseph Donaldson, Hulsey and Ray Pepe. Alderman Jack Also present were Mayor Anderson, City Clerk Louise Turner, City Attorney Maurice Fox, Lt. Ernest Canfield and Lt. J.D. Wallace and Detective Leonard Post of the Wheat Ridge Police Department, Mr. William Poltera of Prk-N-Pik Liquors and Mr. George A.Holley attorney for Mr. Poltera. Motion by Alderman Donaldson "I move We hear testimony from the Police Department and allow cross examination by the attorney for Prk-N-Pik Liquors in regard to a summary hearing." Motion was seconded by Alderman Abramson and passed 5-0. Detective Leonard Post of the Wheat Ridge Police Department stated That at 11 11 p.m. on August 25, 1972, Howard Jaquay of the Wheat Ridge Police Department had observed an individual, Michael Leist, age 18, carrying out a package containing 5 quarts of 5% beer which had been sold to him by Dominic J. Diclementi an employee of Prk- N- Pik Liquors. Detective Post said charges will be filed on Michael Leist and Dominic Diclementi. Attornev George Hollev pointed out that this was all hearsay and City Attorney Fox stated that hearsay can be considered. Alderman Abramson stated he was reluctant to impose a summary suspension without hearing directly from the officer involved. Motion by Alderman Howard "I move that the pckg. liquor license for Prk-N-Pik Liquors at 9345 West 44 Avenue be suspended for a period of ten (10) days effective at noon tomorrow and a Public Hearing be held in these chambers on September 14, 1972 at 7 30 p.m." Motion died for lack fo a second. Motion by Alderman Abramson "I move that a Public Hearing be set for August 31, 1972 at 7 30 p.m. regarding the alleged violation of Prk-N-Pik Liquors." Motion was seconded by Alderman Donaldson and passed 4-1. Alderman Howard voted "nay" and Alderman Bramble was not present. Alderman Pepe asked why Officer Jaquay was not present and was told the meeting was called on short notice and he could not be reached. Alderman Abramson requested that the following people be present at the hearing Officer Jacquay, Detective Post, Michael Leist, Mr.Stuart Jeoffrey Patterson, and Mr. Dominic Diclementi.
