ORDINANCE NO. 338
Series of 1979
TITLE: AN ORDINANCE PROVIDING FOR THE USE OF A CERTAIN PARCEL
OF LAND IN THE VICINITY OF INDEPENDENCE COURT, CITY
OF WHEAT RIDGE, COLORADO, FOR THE PURPOSE OF INSTALLING,
MAINTAINING AND HAVING ACCESS TO A CERTAIN FOOTBRIDGE.
WHEREAS, the City of Wheat Ridge, Colorado, desires to
install and maintain a footbridge across Clear Creek in the vicinity
of Independence Court; and
WHEREAS, the citizenry of the City of Wheat Ridge, Colorado,
desires to have access to, from and across said footbridge; and
WHEREAS, the Estate of Van Hooser is the owner in fee
simple of that parcel of land necessary for the installation,
maintenance and providing access for the use of said footbridge;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. The City of Wheat Ridge, Colorado, hereby enters into
an agreement with the Estate of Van Hooser for the use of said
property as is necessary for the installation, maintenance and
access to, from and across said footbridge, described as follows,
to-wit:
A parcel of land located in the Southeast 1/4 of the
Northwest 1/4 of the Southwest 1/4 of Section 22,
Township 3 South, Range 69 West of the Sixth Principal
Meridian, all being located in the City of Wheat Ridge,
County of Jefferson, State of Colorado, more particularly
described as follows:
Commencing at the West Quarter (W 1/4) Corner of Section
22, Township 3 South, Range 69 West; thence South 00°14'
30" West along the West line of the Northwest Quarter
(NW 1/4) of the Southwest Quarter (SW 1/4) of Section
22, Township 3 South, Range 69 West a distance of 1134.17
feet; thence North 89050'30" East along the centerline
of West 41st Avenue a distance of 1126.75 feet to a point
on the West Right-of-Way line of Independence Court;
thence North 00°14'00" West a distance of 150 feet
to the Northeast (NE) corner of the East Valley Subdivision
that is recorded in Book 17, Page 34 of the Jefferson
County Records; thence South 89°50'30" East a distance
of 19.00 feet to the true point of beginning of a 12-foot
lease; thence North 00014'00" West a distance of 258.96
feet; thence South 85018'17" East along the Southerly
line of property recorded in Book 2411, Page 924 of the
Jefferson County Records a distance of 12.04 feet thence
South 00°14'00" East a distance of 257.92 feet thence
South 89°50'30" West a distance of 12.00 feet to the true
point of beginning.

Section 2. The City of Wheat Ridge, Colorado, hereby authorizes
its appropriate agents to enter into such agreement for the
reasonable life of the footbridge, which is determined to be
twenty (20) years or until sooner terminated by the City of
Wheat Ridge, at the rate of $100.00 per year for the necessary
use of the parcel of land.
Section 3. This ordinance shall take effect 1 day after
final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of
6 to 0 on this 18th day of June , 1979;
ordered published in full in a newspaper of general circulation
in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for July 9, , 1979, at
7:30 o'clock _.m., at Council Chambers, 7500 West 29th
Avenue, Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final
reading by a vote of 6 to 0 this 9th day of
July , 1979.
