TITLE: AN ORDINANCE FOR THE APPROVAL OF A CHANGE OF ZONE FROM RESIDENTIAL-TWO
(R-2), COMMERCIAL-ONE (C-1), AND AGRICULTURAL-ONE (A-1) TO RESTRICTED
COMMERCIAL ONE (RC-1) FOR PROPERTY LOCATED AT 4465/4475 KIPLING STREET,
CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application of Maurice F. Fox for approval of a change of zone in
Wheat Ridge Case No. WZ-79-17 and upon recommendation for approval from the Wheat
Ridge Planning Commission and pursuant to findings made based upon testimony and
evidence presented at public hearing before the Wheat Ridge City Council, Wheat
Ridge Zoning Maps are hereby amended to exclude from the Residential-Two (R-2),
Commercial-One (C-1), and Agricultural-One (A-1) zoning district and to include
within the Restricted Commercial-One (RC-1) zoning district the following described
land:
PARCEL A:
The North 108 feet of a plot of land described as follows: Beginning
at a point 1529.75 feet South and 30 feet West of the Northeast corner of
Section 21, Township 3 South, Range 69 West; thence South 208 feet; thence
West at right angles 208 feet; thence North at right angles 208 feet;
thence Easterly in a direct line 208 feet more or less to the point of
beginning, except that part deeded to the Department of Highways recorded
August 11, 1969 in Book 2124 at Page 186, Jefferson County, Colorado.
PARCEL B:
The South 100 feet of a plot of land situated in the Northeast corner of the
South 8 acres of that part of the East 1/2 East 1/2 Northeast 1/4 of
Section 21, Township 3 South, Range 69 West of the 6th P.M., lying North
of Center of West 44th Avenue Road, described as follows: Beginning at a
point 1529.75 feet South and 30 feet West of the Northeast corner of said
Section; thence South 208 feet; thence West at right angles 208 feet;
thence North at right angles 208 feet; thence Easterly in a direct line
208 feet more or less to a point of beginning, except that part deeded to
the Department of Highways in Deed recorded August 11, 1969 in Book 2124
at Page 186, Jefferson County, Colorado.
Section 2. This ordinance shall take effect 15 days after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 6 to 0 on this
27thday of August 1979; ordered published in full in a newspaper of
general circulation in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for September 17, , 1979, at 7:30 o'clock P.M. in the
Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final reading by a vote of 6
to 0 , this 17th day of September , 1979.
