ORDINANCE NO. 365

TITLE: AN ORDINANCE ENACTING PROVISIONS FOR CABLE TELEVISION
SYSTEMS IN THE CITY OF WHEAT RIDGE, COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. The following general provisions are hereby enacted
for Cable Television Systems within the City of Wheat Ridge,
Colorado:
General Provisions - Cable Television Systems
(a) License Required. It shall be unlawful for any
person to construct, install, or otherwise operate any
cable television system within the municipal boundaries
of the City of Wheat Ridge, Colorado, without first
obtaining a license therefor in compliance with the
provisions of this chapter.
(b) License Approval. A license for operation of a
cable television system shall be approved by the City
Council by ordinance specifying the terms and conditions
of such license.
(c) Violation - Penalty. Violations of the provisions
of subsection (a) of this ordinance above shall be
punishable by a fine of not more than $300.00, by
imprisonment in the City Jail or County Jail for
not more than 90 days, or by both such fine and
imprisonment. Each day such violation shall continue
shall constitute a separate offense, each punishable
up to the limits prescribed in this section.
Section 2. Safety Clause. The City Council hereby finds,
determin s, and declares that this ordinance is promulgated
under the general police power of the City of Wheat Ridge, that
it is promulgated for the health, safety, and welfare of the
public, and that this ordinance is necessary for the preservation
of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance
bears a rational relation to the proper legislative object sought
to be attained.
Section 3. Severability. If any clause, sentence, paragraph,
or part of this ordinance or the application thereof to any
person or circumstances shall for any reason be adjudged by
a court of competent jurisdiction invalid, such judgment shall
not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.

Section 4. This ordinance shall take effect
after final publication.

ordered published in full in a newspaper of general circulation
in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for Monday, October 22 , 1979, at
7:30 o'clock ~.m., at Council Chambers, 7500 West 29th
Avenue, Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final
reading by a vote of 6 to 0 this 22nd day of
October , 1979.
